SIRI JAGAN, J.\n                - - - - - - - - - - - - - - - - - - - - - - -\n                   W.P.(C)No. 31720 of 2010\n                - - - - - - - - - - - - - - - - - - - - - - -\n        Dated this the 18th day of November, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>     The petitioner retired as a Forester from the Forest<\/p>\n<p>Department of the Government of Kerala on 31.03.2010.<\/p>\n<p>The petitioner submits that, on a trivial charge, disciplinary<\/p>\n<p>proceedings have been initiated against the petitioner by<\/p>\n<p>Ext.P1.   But the petitioner&#8217;s retirement benefits are not<\/p>\n<p>being disbursed to the petitioner. The petitioner therefore<\/p>\n<p>seeks the following reliefs:\n<\/p>\n<blockquote><p>     &#8220;i.  issue a writ of mandamus or such other writ, order or<br \/>\n          direction, directing the respondents to release the<br \/>\n          retiral\/pensionary    benefits    due    to    the  petitioner<br \/>\n          forthwith.&#8221;<\/p><\/blockquote>\n<p>     2.   The learned Government Pleader on instructions<\/p>\n<p>submits that, disciplinary proceedings are pending against<\/p>\n<p>the petitioner and therefore under Rule 3A of Part III of<\/p>\n<p>K.S.R., retirement benefits cannot be disbursed to the<\/p>\n<p>petitioner. The counsel for the petitioner points out that,<\/p>\n<p>Rule 3A does not authorise withholding of provisional<\/p>\n<p>W.P.(C)No. 31720 of 2010<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>pension atleast.        He further submits that, after his<\/p>\n<p>retirement more than seven months have already elapsed<\/p>\n<p>and it is unjust to prolong disciplinary proceedings and<\/p>\n<p>withhold retirement benefits due to the petitioner.<\/p>\n<p>      3.    Having heard both sides, I dispose of this writ<\/p>\n<p>petition with the following directions:<\/p>\n<blockquote><p>      The petitioner shall be paid provisional pension as<\/p>\n<p>      contemplated under Rule 3A of Part III of K.S.R.<\/p>\n<p>      within one month from today. The disciplinary<\/p>\n<p>      proceedings initiated against the petitioner shall<\/p>\n<p>      be completed as expeditiously as possible, at any<\/p>\n<p>      rate within four months from the date of receipt of<\/p>\n<p>      a copy of this judgment.       If the disciplinary<\/p>\n<p>      proceedings are not completed within the said<\/p>\n<p>      period, the entire retirement benefits due to the<\/p>\n<p>      petitioner shall be disbursed to the petitioner<\/p>\n<p>      within one month thereafter, after obtaining a<\/p>\n<p>      bond as contemplated under Rule 116.<\/p><\/blockquote>\n<p>                                               S.
