MUNNA TIWARI\n   ALL SONS OF DEODUTT TIWARI, RESIDENT OF VILLAGE DIGHARA\n   RAMPUR SAH, POLICE STATION SADAR, DISTRICT MUZAFFARPUR\n                                ********\n<\/pre>\n<p>2    18\/07\/2011             Heard Counsel for the petitioner and the A.P.P.<\/p>\n<p>                  appearing on behalf of the State.\n<\/p>\n<p>                            The petitioner is aggrieved by the order dated<\/p>\n<p>                  02.04.2008 passed in Criminal Revision No. 187 of 2007<\/p>\n<p>                  by which the Additional Sessions Judge, Fast Track<\/p>\n<p>                  Court No.       !V, Muzaffarpur has set aside the order<\/p>\n<p>                  initiating proceedings under Section 188 of the Indian<\/p>\n<p>                  Penal Code passed by the Sub Divisional Magistrate,<\/p>\n<p>                  Muzaffarpur on 10.07.2007.\n<\/p>\n<p>                            A proceeding under Section 144 of the Code of<\/p>\n<p>                  Criminal Procedure was initiated and the Opposite<\/p>\n<p>                  Parties appeared in the proceeding. During the pendency<\/p>\n<p>                  of 144 proceeding, a prohibitory order was passed under<\/p>\n<p>                  Section   114    of   the   Code   of   Criminal   Procedure.<\/p>\n<p>                  Ultimately, the proceeding under Section 144 of the Code<\/p>\n<p>                  of Criminal Procedure was dropped on the ground that it<\/p>\n<p>                  was a residential house.\n<\/p>\n<p><span class=\"hidden_text\">                             2<\/span><\/p>\n<p>                  Counsel for the petitioner submits that during<\/p>\n<p>        the pendency of the 144 proceedings, the Opposite<\/p>\n<p>        Parties were violating the prohibitory orders by making<\/p>\n<p>        construction over the lands in question and as such the<\/p>\n<p>        order dismissing the claim of the petitioner ought to be<\/p>\n<p>        set aside by this Court.\n<\/p>\n<p>                  This Court finds that since the premises had<\/p>\n<p>        been declared as a residential house, it would serve no<\/p>\n<p>        purpose to hold that there was a violation of prohibitory<\/p>\n<p>        orders during the pendency of the proceedings. Once, it is<\/p>\n<p>        held   that   it   is   a residential   house,   then   further<\/p>\n<p>        construction on the residential house cannot amount to<\/p>\n<p>        really violating any terms of the prohibitory order.<\/p>\n<p>                  I do not see any illegality in the order<\/p>\n<p>        impugned.
