Justice P.N.RAVINDRAN\n\n Dated :02\/12\/2009\n\n O R D E R\n                      P.N.RAVINDRAN, J\n                          -------------------\n                      W.P.(C).20423\/2009\n                          --------------------\n            Dated this the 2nd day of December, 2009\n\n                          JUDGMENT\n<\/pre>\n<p>      Heard Sri.P.C.Sasidharan, the learned counsel appearing<\/p>\n<p>for the petitioner and Sri.M.Sasindran, the learned standing<\/p>\n<p>counsel appearing for the Kannur University.<\/p>\n<p>      2.   The petitioner appeared for the Final BDS Part-I<\/p>\n<p>Degree Examination conducted by the Kannur University in<\/p>\n<p>September 2008.      On the ground that         the answers to two<\/p>\n<p>questions in the subject &#8216;Orthodontics&#8217; Section A are similar to<\/p>\n<p>that in the text book of Orthodontics by Balaji, the Controller of<\/p>\n<p>Examinations issued Ext.P2 memo dated 20.11.2008 calling<\/p>\n<p>upon the petitioner to show cause why action should not be<\/p>\n<p>taken against him for malpractice in the examination.          On<\/p>\n<p>receipt of the said memo, the petitioner submitted Ext.P3 reply<\/p>\n<p>dated 9.12.2008 denying the said allegation. This writ petition<\/p>\n<p>was thereafter filed challenging Ext.P2 and seeking a writ in the<\/p>\n<p>nature of mandamus to the respondents to publish the result of<\/p>\n<p>the Final BDS examination. The petitioner contends that the<\/p>\n<p>mere similarity in the answers to the contents of the text book<\/p>\n<p>of Orthodontics cannot be a ground to hold that he had<\/p>\n<p>W.P.(C).20423\/09<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>committed malpractice in the examination and that in the<\/p>\n<p>absence of an allegation that he had copied from a book or<\/p>\n<p>notes or from other answer scripts, the respondents are not<\/p>\n<p>entitled to take action against him for malpractice in the<\/p>\n<p>examination.\n<\/p>\n<p>      3.    The second respondent has filed a counter affidavit.<\/p>\n<p>It is stated that after enquiry by a committee consisting of three<\/p>\n<p>experts, a report was submitted wherein the committee had<\/p>\n<p>come to the conclusion that no punitive action should be taken<\/p>\n<p>against the candidate. It is also stated that the report of the<\/p>\n<p>enquiry committee was placed before the Standing Committee<\/p>\n<p>of the Syndicate which resolved to cancel the examination of the<\/p>\n<p>petitioner and other candidates.       It is also stated that the<\/p>\n<p>Standing Committee had also resolved to recommend to the<\/p>\n<p>Syndicate to take appropriate action against the College. The<\/p>\n<p>second respondent has further stated that the recommendation<\/p>\n<p>was approved by the Pro Vice Chancellor exercising the powers<\/p>\n<p>of the Vice Chancellor and that the appearance of the candidate<\/p>\n<p>including the petitioner in the final BDS Part-I examination<\/p>\n<p>stands cancelled.\n<\/p>\n<p>      4.    Pursuant to the directions issued by this Court, the<\/p>\n<p>W.P.(C).20423\/09<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>files were made available.     The files disclose that the Vice<\/p>\n<p>Chancellor of the University has ordered that the report and<\/p>\n<p>the connected papers should be placed before the Syndicate for<\/p>\n<p>consideration and that the Syndicate is yet to take a decision in<\/p>\n<p>the matter. As per Statute 3(xxiii) of Chapter VII of the Kannur<\/p>\n<p>University First Statutes, 1998, the Syndicate of the University<\/p>\n<p>is the body competent to cancel the examination taken by a<\/p>\n<p>candidate and to debar him\/her from appearing at the<\/p>\n<p>University examination for one or more years. The procedure to<\/p>\n<p>be followed before cancelling the appearance in the examination<\/p>\n<p>and for debarring the candidate from appearing in the<\/p>\n<p>examination for a particular period is also prescribed in the<\/p>\n<p>First Statutes. Since the Syndicate of the University is yet to<\/p>\n<p>take a decision in the matter, I am of the opinion that it would<\/p>\n<p>be premature to this Court to go into the rival contentions at<\/p>\n<p>this stage.\n<\/p>\n<p>      I accordingly dispose of this writ petition with a direction<\/p>\n<p>to the    respondents to pass final orders in the matter after<\/p>\n<p>complying with the provisions in the Statute 3(xxiii) of Chapter<\/p>\n<p>VII of the Kannur University First Statutes, 1998 and after<\/p>\n<p>affording the petitioner a reasonable opportunity of being<\/p>\n<p>W.P.(C).20423\/09<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>heard. Final orders in the matter shall be passed within two<\/p>\n<p>months from today. Depending on the decision taken by the<\/p>\n<p>Syndicate, the result of the petitioner shall be published.
