Justice PIUS C.KURIAKOSE\n\n Dated :06\/08\/2008\n\n O R D E R\n                          PIUS.C.KURIAKOSE, J.\n                         - - - - - - - - - - - - - - - - - - - - -\n                          W.P.(c).No.36880 OF 2007\n                     - - - - - - - - - - - - - - - - - - - - - - - - - -\n                     Dated this the 6th day of August, 2008\n\n                                   JUDGMENT\n<\/pre>\n<p>      Petitioner who is aggrieved by the proposal of the respondents to<\/p>\n<p>acquire his property extending to 11 cents for the construction of a bus<\/p>\n<p>bay at the request of the 4th respondent TRIDA has filed this writ<\/p>\n<p>petition seeking the following reliefs;\n<\/p>\n<p>                  &#8220;i)     To declare the notice dated 26-11-2007<\/p>\n<p>           served on M\/s. Narmada Building Enterprises (P)<\/p>\n<p>           Ltd for taking over 11 cents of land in survey No.7<\/p>\n<p>           as illegal and to stay all further proceedings thereon.<\/p>\n<p>                  ii)     Issue a writ of mandamus or any other<\/p>\n<p>           appropriate writ, order or direction of the nature of<\/p>\n<p>           mandamus directing the respondents 1 to 5 not to<\/p>\n<p>           initiate any proceedings for acquisition of the<\/p>\n<p>           property belonging to the petitioner without notice<\/p>\n<p>           as contemplated under the provisions of Land<\/p>\n<p>           Acquisition Act, 1894 and not to exceed the extent<\/p>\n<p>           of acquisition in Survey No.7.\n<\/p>\n<p>                  iii)    Issue a writ of mandamus or any other<\/p>\n<p>           appropriate writ, order or direction of the nature of<\/p>\n<p><span class=\"hidden_text\">WPC.No.36880\/07                     2<\/span><\/p>\n<p>           mandamus directing the respondents 1 to 5 not to<\/p>\n<p>           exceed the extent of acquisition in Survey No. 7 of<\/p>\n<p>           Perurkada village beyond 0.0160 hectares (4 cents)<\/p>\n<p>           shown in the original gazette notification dated<\/p>\n<p>           03-05-2007 (Ext.P9)<\/p>\n<p>                 iv)   Issue a writ of mandamus or any other<\/p>\n<p>           appropriate writ, order or direction of the nature of<\/p>\n<p>           mandamus directing the respondents to consider the<\/p>\n<p>           other sites pointed out by the petitioner available for<\/p>\n<p>           locating the bus bay which is situated near to the<\/p>\n<p>           petitioner&#8217;s property in government land which<\/p>\n<p>           would ultimately reduce the land acquisition<\/p>\n<p>           expenses and would be in public interest.&#8221;\n<\/p>\n<p>      2.    Counter affidavits have been filed wherein it is contended<\/p>\n<p>that advance possession of the petitioner&#8217;s property has been taken.<\/p>\n<p>When the above contention was seriously disputed, this court appointed<\/p>\n<p>Sri.Thoufeek Ahamed as Advocate commissioner for conducting a<\/p>\n<p>local inspection. Sri.Thoufeek has conducted local inspection and filed<\/p>\n<p>his report.   Sri.Thoufeek Ahamed&#8217;s report is to the effect that the<\/p>\n<p>petitioner continues to carry on business in Iron, steel and cement in the<\/p>\n<p>premises in question.\n<\/p>\n<p><span class=\"hidden_text\">WPC.No.36880\/07                      3<\/span><\/p>\n<p>      3.    Today the petitioner has produced photographs taken on<\/p>\n<p>30\/7\/2008. These photographs also will reveal that the version of the<\/p>\n<p>petitioner that he has not been dis-possessed and he is now carrying on<\/p>\n<p>business is probable. Apart from the photographs petitioner has also<\/p>\n<p>produced copy of the notice under section 9(3) which was received by<\/p>\n<p>him inviting him to an award enquiry.\n<\/p>\n<p>      4.    Sri.Basant Balaji, learned Government Pleader and<\/p>\n<p>Sri.K.A.Jaleel, standing counsel for TRIDA would submit that the<\/p>\n<p>order of the Government according sanction for invocation of the<\/p>\n<p>emergency provision of section 17(1) and order of the Land Revenue<\/p>\n<p>Commissioner directing enquiry under section 5A need not be<\/p>\n<p>conducted in this case are not under challenge. Learned counsel would<\/p>\n<p>therefore request that the respondents be permitted to continue with the<\/p>\n<p>acquisition from the stage of the declaration under section 6 which also<\/p>\n<p>they pointed out, is not specifically under challenge.<\/p>\n<p>      5.    Sri.R.S.Kalkura, learned counsel for the petitioner would<\/p>\n<p>concede that the petitioner is yet to challenge the order the government<\/p>\n<p>according sanction and order of the land revenue commissioner<\/p>\n<p><span class=\"hidden_text\">WPC.No.36880\/07                     4<\/span><\/p>\n<p>dispensing with enquiry under section 5A. He took exception to the<\/p>\n<p>submission that declaration 6 has not been challenged. According to<\/p>\n<p>him, declaration has been challenged. He drew my attention to the<\/p>\n<p>various grounds raised in the writ petition and submitted that<\/p>\n<p>malafides tainting the entire acquisition is evident.<\/p>\n<p>      Having considered the rival submissions, I am of the view that so<\/p>\n<p>long as the order of the Government under section 17(1) and the order<\/p>\n<p>the land revenue commissioner under section 17(4) stand, the petitioner<\/p>\n<p>cannot aspire for the reliefs sought for in this writ petition. The<\/p>\n<p>allegation of malafides remains as allegations not yet substantiated by<\/p>\n<p>producing any convincing material. I am therefore, not inclined to<\/p>\n<p>grant the reliefs sought for. However, considering the submission of<\/p>\n<p>Sri.Kalkura that the petitioner is collecting materials so that he can<\/p>\n<p>challenge the order of the Government under section 17(1) and the<\/p>\n<p>order of the land revenue commissioner under section 17(4), even as<\/p>\n<p>I dismiss the writ petition declining the reliefs sought for, there will be<\/p>\n<p>a direction that the petitioner will be permitted to maintain status quo<\/p>\n<p>as obtaining today as revealed by the Commissioner&#8217;s report and the<\/p>\n<p><span class=\"hidden_text\">WPC.No.36880\/07                       5<\/span><\/p>\n<p>three photographs produced today for a period of 15 days from today.<\/p>\n<p>It is open to the petitioner to participate in the award enquiry for which<\/p>\n<p>he has been given notice without prejudice to his contentions in this<\/p>\n<p>writ petition and the prospective writ petition. This judgment also will<\/p>\n<p>not stand in the way of the petitioner filing appropriate petition before<\/p>\n<p>the High Level Committee          for Capital Region development for<\/p>\n<p>Thiruvananthapuram city within seven days from the date of receipt of<\/p>\n<p>a copy of this judgment.
