LAKSHMANAN\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>O R D E R<br \/>\n(Arising out of SLP(C) No. 24145 of 2004)<\/p>\n<p>\t\tLeave granted.\n<\/p>\n<p>\t\tThe respondent&#8217;s husband was a<br \/>\ncanteen employee.  He was appointed on Ist<br \/>\nDecember 1979.  On 12.7.1990 he retired on<br \/>\nmedical grounds.  In the meanwhile, the<br \/>\nGovernment had issued a Notification on<br \/>\n11.12.1979 by which with effect from 1.10.1979<br \/>\nthe Government would treat all posts in<br \/>\ncanteen and tiffin rooms run departmentally by<br \/>\nthe Government of India as civil posts.  It<br \/>\nwas made clear by Notification dated<br \/>\n11.12.1979 that all present and future<br \/>\nincumbents of the posts would qualify as<br \/>\nholders of Civil posts under the Central<br \/>\nGovernment and that necessary rules governing<br \/>\ntheir conditions of service would be framed<br \/>\nunder proviso to Art.309 of the Constitution<br \/>\nof India to have retrospective effect from<br \/>\nfirst day of October, 1979.\n<\/p>\n<p>\tThe workers of the canteens then filed<br \/>\nproceedings under Art.32 before this Court for<br \/>\nenforcement of their rights claiming inter<br \/>\nalia parity with Railway employees. The<br \/>\nworkers of three classes of canteens were the<br \/>\nclaimants viz.(i) Statutory canteens (ii) Non-<br \/>\nstatutory recognized canteens and (iii) non-<br \/>\nstatutory non-recognized canteens.\n<\/p>\n<p><span class=\"hidden_text\">-2-<\/span><\/p>\n<p>\tThe issue as to whether all the canteen<br \/>\nemployees should be treated as Railway<br \/>\nemployees and whether all service conditions<br \/>\nbe extended to them which are available to<br \/>\nRailway employees was decided by this Court in<br \/>\n<a href=\"\/doc\/1205244\/\">M.M.R.Khan &amp; Others vs. Union of India &amp; Ors.<\/a><br \/>\nreported in 1990 (Supp.) SCC 191.  This Court<br \/>\nheld that the relationship of employer and<br \/>\nemployee has been created between the Railway<br \/>\nAdministration and the canteen employees from<br \/>\nthe very inception and that it would not be<br \/>\ngainsaid that for the purposes of the<br \/>\nFactories Act, the employees in the statutory<br \/>\ncanteen were the employees of the Railway.  It<br \/>\nwas noted that the Railway Board had already<br \/>\ntreated the employees of all statutory and<br \/>\neleven daily basis non-statutory recognised<br \/>\ncanteens as Railway employees with effect from<br \/>\nOctober 27, 1980.  However, the Court went on<br \/>\nto say that the employees of the other non-<br \/>\nstatutory recognised canteens would, however,<br \/>\nbe treated as Railway employees with effect<br \/>\nfrom Ist April 1990, and that they would be<br \/>\nextended all the benefits as such Railway<br \/>\nemployees with effect from that date,<br \/>\naccording to the service conditions prescribed<br \/>\nfor them under the relevant rules and orders.<br \/>\nThe claim of the non-statutory non-recognized<br \/>\ncanteen workers was negatived.<br \/>\n\tThe husband of the respondent together with<br \/>\nother employees of non-statutory recognized<br \/>\ncanteens filed writ petitions in which similar<br \/>\nreliefs as <\/p>\n<p><span class=\"hidden_text\">-3-<\/span><br \/>\nwere considered and granted in M.M.R. Khan&#8217;s<br \/>\ncase were prayed for.  The Court disposed of<br \/>\nthe writ petition by the following order on<br \/>\n11.10.1991:\n<\/p>\n<p>\t&#8220;We are of the view that the<br \/>\nfacts before us in these cases<br \/>\nsquarely attract the decision in<br \/>\nthe reported case to be applied to<br \/>\nthem.  In that view of the matter,<br \/>\nwe allow the Writ Petitions for the<br \/>\nreasons indicated in the said<br \/>\nJudgement and direct the benefits<br \/>\nto be given to the Petitioners in<br \/>\nthe following way.\n<\/p>\n<p>\tBy an interim order dated<br \/>\n26.9.1983 certain reliefs had been<br \/>\ngranted.  In respect of the reliefs<br \/>\nalready granted  this order shall<br \/>\nbe deemed to be operative from that<br \/>\ndate.  In case any further benefits<br \/>\nare admissible, those will be<br \/>\nadmissible from 1.10.1991.\n<\/p>\n<p>\tFor the purpose of calculation of<br \/>\npension service from the date of<br \/>\nthe interlocutory order shall be<br \/>\ncounted.\n<\/p>\n<p>\tBy the interim order dated 22.9.1983<br \/>\nreferred to in the body of the quotation<br \/>\nabove, a direction was given given to the<br \/>\neffect that pending hearing and disposal of<br \/>\nthe writ petitions, including the petition<br \/>\nwherein the respondent&#8217;s husband was a party,<br \/>\nall employees of non-statutory recognized<br \/>\ncanteens would be paid at the same rate and on<br \/>\nthe same basis on which employees of statutory<br \/>\ncanteens were being paid.\n<\/p>\n<p>\tOn the application of the Union of India for<br \/>\nclarification of the order dated 11.10.1991,<br \/>\nquoted earlier, on 10th August 1993 this Court<br \/>\npassed the following order:\n<\/p>\n<p><span class=\"hidden_text\">-4-<\/span><\/p>\n<p>\t&#8220;The learned Additional Solicitor<br \/>\nGeneral appearing for Union of India<br \/>\nstates that the pension will be given<br \/>\nto all those who retired after<br \/>\n1.10.1991.  However, for the purpose<br \/>\ncalculating the pension their<br \/>\nservices on and from 26.9.83 be taken<br \/>\ninto consideration.  In case of those<br \/>\nwhose service falls short of the<br \/>\nqualifying period, the service<br \/>\nrendered them prior to 26.9.83 will<br \/>\nbe taken into consideration to extent<br \/>\nof the short fall.  On these<br \/>\nclarifications we find that there is<br \/>\nnothing further to be done in the<br \/>\nmatter. It is disposed of<br \/>\naccordingly.&#8221;\n<\/p>\n<p>\tAdmittedly, the respondent&#8217;s husband had<br \/>\nretired before 11.10.1991.  Indeed, he had<br \/>\ndied on 28.3.1991. In 1994, the Federation of<br \/>\nAll India Central Government Canteens<br \/>\nEmployees Association filed another writ<br \/>\npetition in which it appears that the<br \/>\npetitioners had asked for a change of the cut<br \/>\noff date as fixed by the order dated<br \/>\n10.8.1993.  The writ petition was dismissed<br \/>\nbut this Court said that<br \/>\nthe dismissal would not preclude the<br \/>\nFederation from approaching the High Court or<br \/>\nthe Central Administrative Tribunal whichever<br \/>\nhad the jurisdiction.  In other words, the<br \/>\norder dated 10th August 1993 was not<br \/>\ninterfered with.\n<\/p>\n<p>\tTaking a cue from this order, the canteen<br \/>\nworkers sought to reopen the issue of the cut<br \/>\noff date before the Central Administrative<br \/>\nTribunal. The respondent&#8217;s husband filed an<br \/>\nindependent application before the Central<br \/>\nAdministrative Tribunal. The CAT directed the<br \/>\nUnion of India to <\/p>\n<p><span class=\"hidden_text\">-5-<\/span><br \/>\ngrant the benefits of the entire period of<br \/>\nservice prior to the applicants having been<br \/>\ndeclared as Government Servants for counting<br \/>\ntowards pensionary benefits. The respondent&#8217;s<br \/>\nhusband sought to contend that the benefits of<br \/>\nthe Tribunal&#8217;s order should also be made<br \/>\navailable in respect of persons when they<br \/>\nretired prior to the cut off  date i.e. prior<br \/>\nto 11.10.1991.  This was allowed by the<br \/>\nTribunal.  The Union of India preferred a writ<br \/>\npetition. The writ petition was dismissed.<br \/>\nChallenging this order the appellants have<br \/>\napproached this Court.\n<\/p>\n<p>\tWe are of the view that the issue as far as<br \/>\ncut-off date of classification of non-<br \/>\nstatutory canteen employees is concerned, it<br \/>\nmust be taken to have been concluded by the<br \/>\norder dated 10.8.1993 passed by this Court.<br \/>\nIt was not open to the respondent to seek<br \/>\nvariation of the same either before the CAT or<br \/>\nthe High Court.  The order dated 10th August<br \/>\n1993 has attained finality and there can be no<br \/>\ndispute as to the language of the order. The<br \/>\nrespondent could not reopen the issue.  In<br \/>\nthis view of the matter, the decisions of the<br \/>\ncourts below are set aside and the appeal is<br \/>\nallowed.
