Justice J.M.JAMES\n\n Dated :01\/09\/2006\n\n O R D E R\n                           J.M.JAMES, J.\n\n                              --------------\n\n                          B.A. 5392\/2006\n\n                            ------------------\n\n  DATED THIS THE 1ST DAY OF SEPTEMBER, 2006\n\n\n\n\n                              O R D E R\n<\/pre>\n<p>             The   petitioners   are   accused   1   to   3,   in<\/p>\n<p>C.R.No.66\/2006   of   Excise   Range,   Kollam.     3824   liters   of<\/p>\n<p>toddy had  been  seized from T.S.No.43\/2006-07,   which is<\/p>\n<p>in excess of the permitted quantity.\n<\/p>\n<p>      2.     The   prosecution   submits   that   the   first   accused<\/p>\n<p>is   the   salesman   and   accused   Nos.   2   and   3   are   preparing<\/p>\n<p>toddy with the help of various materials and sell the same<\/p>\n<p>in   the   shop,   other   than   the   toddy   supplied   from   the<\/p>\n<p>authorised shops.   The counsel for the petitioners, on the<\/p>\n<p>other hand,  submits   that if the toddy is adulterated,  the<\/p>\n<p>same   could   be   ascertained   only   if   the   chemical   analysis<\/p>\n<p>report   is   available.     Further   submission   of   the   counsel   is<\/p>\n<p>that  if the toddy  is not destroyed after 48 hours,  it is only<\/p>\n<p>violation of the licensing condition and that would attract<\/p>\n<p>the penal provision under Section 56(b) of the Abkari Act.\n<\/p>\n<p>B.A.5392\/2006<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>        3.
