 (Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n
\tThe
\npresent application is filed through Jail praying for 45 days
\ntemporary bail so as to see that he is able to undertake engagement
\nceremony of his daughter.\n<\/p>\n
2.\tThe
\napplicant- convict is undergoing life imprisonment for offence under
\nsection 302 of the Indian Penal Code in Sessions Case No.244 of 2006
\nby judgment and order dated 6th
\nMay 2008.  He was arrested on 21st
\nNovember 2005.  By now he has undergone 5 years, 3 months and 19 days
\nin Jail.  He is not able to enjoy furlough as the District
\nSuperintendent of Police, Alwar sent a negative opinion.  Learned APP
\nMr.Shah made available for perusal communication
\ndated 2nd
\nDecember 2010 from the District Superintendent of Police, Alwar.  It
\nis addressed to  the Deputy Superintendent, Ahmedabad Central Prison.
\nThe contents of that letter shows the extent of non application of
\nmind with which this letter is written.  The inquiry was about the
\nconvict being at his native.  As the convict had stated that he wants
\nto be at his village so as to arrange for the required treatment of
\nhis wife. The District Superintendent of Police, Alwar made inquiry
\nat Police Station, ‘Mandavar’, District Alwar.  The inquiry was made
\nat the Village of the convict and as it is stated in the letter, ‘the
\nstatements of certain persons were recorded’.  The letter does not
\nrefer to the contents of the statements.  However, it proceeds to
\nstate that,  <\/p>\n
“The
\nconvict is undergoing life imprisonment in Central Jail for an
\noffence of murder, that the victim-party is resident of Ahmedabad and
\nif the convict is allowed to be on parole any untoward incident can
\ntake place, and its possibility cannot be ruled out.  Therefore, it
\nis not appropriate to release the convict on parole.”\n<\/p>\n
3.\tWhat
\nis important is that there is clear non application of mind.  The
\nconvict is going to be at his Village Mandavar, District Alwar, that
\nbeing so, where is the question of his committing any untoward act at
\nAhmedabad.  Inquiry from  the District Superintendent
\nof Police, Alwar was about his presence in Village,  the victim-party
\nis not from the same village and therefore, there is no question of
\nhis creating any problem in his village.\n<\/p>\n
4.\tThere
\nis another communication dated 1st
\nNovember 2010 from the Deputy Police Commissioner, Zone-V, Ahmedabad
\nCity addressed to the Inspector General of Prisons, Ahmedabad wherein
\nit is stated that one of the co-accused of the convict (Ketan Alias
\nLalo Maheshbhai Panchal) is absconding after he was released on
\nfurlough.  The letter then proceeds to state that, ‘if the convict is
\nreleased on furlough there is a likelihood of breach of peace and of
\nabsconding’.  Again without ascertaining whether the convict is going
\nto stay at Ahmedabad on his release on furlough or parole or
\ntemporary bail this opinion is given.\n<\/p>\n
5.\tIn
\nview of the contents of the application and in light of the fact that
\nsince 2005 till date he has not gone out of Jail the application
\nrequires to be considered favourably.  Only because one of the
\nco-accused, who has absconded after he was granted furlough since
\n19th
\nAugust 2008, cannot disentitle the present applicant of going on
\ntemporary bail for the engagement of his daughter.  The Court also
\nperused the letters written by the convict’s daughter which are
\nenclosed to the application which are dated 6th
\nJuly 2010 and 6th
\nSeptember 2010.  The daughter has written
\nin the letter that elder brother and younger brother of the convict
\nare also not supporting the family of the convict.\n<\/p>\n
6.\tLearned
\nAPP Mr.Shah made available for perusal further communications dated
\n16th
\nMarch 2011 and 23rd
\nMarch 2011 which are sent to to  the Superintendent of Police, Alwar,
\nRajasthan.  It is really painful that  the Superintendent of Police,
\nAlwar has not shown courtesy of replying these two communications.
\nIt is expected from the member of  uniform-force that he should
\nhonour a communication received and he must reply the same.\n<\/p>\n
Director
\nGeneral of Police is requested to take up the matter with the
\nDirector General of Police, Rajasthan to whom also these two
\ncommunications were sent for information.\n<\/p>\n
7.\t RULE.\n<\/p>\n
 Mr.J.K. Shah,  learned Additional Public Prosecutor waives service
\nof rule on  behalf of the respondent-State.\n<\/p>\n
8.\tTaking into
\nconsideration the contents of the application the record of the
\nconvict and the facts narrated hereinabove, the convict is ordered to
\nbe released on  temporary bail for 30 (thirty) days from
\nthe date of his release subject to the following conditions:\n<\/p>\n
\tThe applicant-\n<\/p>\n
\tconvict shall execute a personal bond of Rs.5000\/- (Rupees five
\n\tthousand only) to the satisfaction of the Jail authorities.\n<\/p>\n
\tThe applicant-\n<\/p>\n
\tconvict shall furnish his full and correct address of his proposed
\n\tstay during the temporary bail period.\n<\/p>\n
\tThe applicant-\n<\/p>\n
\tconvict shall report to the nearest Police Station on every Monday
\n\tbetween 08.00 AM and 12.00 Noon.\n<\/p>\n
\tThe applicant
\n\tshall surrender himself to the Jail authorities on expiry of the
\n\tabove temporary bail period.\n<\/p>\n
\t9.\tThe
\n\tapplication is allowed.  \tRule is made absolute.  The Registry is
\n\tdirected to send a copy of this order to the Director General of
\n\tPolice and also give a copy of this order to the learned APP.\n<\/p>\n
