II\n                          ------\n\n2\/ 26.03.2010<\/pre>\n<p>       Heard the parties.\n<\/p>\n<p>                    This appeal is directed against the judgment and order dated<br \/>\n             22.1.2010 passed in W.P. (C ) No. 3663 of 2004 whereby the<br \/>\n             learned Single Judge dismissed the writ petition. For better<br \/>\n             appreciation, the impugned judgment is quoted herein below:\n<\/p>\n<blockquote><p>                                         &#8220;Learned counsel for the petitioner<br \/>\n                                 acknowledges the fact that the petitioner had<br \/>\n                                 earlier filed a writ application before the Patna<br \/>\n                                 High Court against the same order which has<br \/>\n                                 been impugned in the present writ application<br \/>\n                                 and the earlier writ application was dismissed<br \/>\n                                 on merits. Learned counsel however argues<br \/>\n                                 that after the bifurcation of the State of Bihar<br \/>\n                                 and formation of this Court, the order of the<br \/>\n                                 Patna High Court passed in the petitioner&#8217;s writ<br \/>\n                                 application, may not be considered as binding<br \/>\n                                 upon this Court.\n<\/p><\/blockquote>\n<blockquote><p>                                           Learned counsel for the respondent<br \/>\n                                 State of Bihar objects to such submission on<br \/>\n                                 the ground that the adjudication on the disputed<br \/>\n                                 issue has already been made by the competent<br \/>\n                                 Court and the petitioner cannot raise the same<br \/>\n                                 issue before this Bench. If at all the petitioner<br \/>\n                                 was aggrieved by the judgement passed in the<br \/>\n                                 earlier writ application, he would have preferred<br \/>\n                                 an appeal against the same or at least a review<br \/>\n                                 application.\n<\/p><\/blockquote>\n<blockquote><p>                                         I am inclined to accept the submission of<br \/>\n                                 the learned counsel for the respondent State of<br \/>\n                                 Bihar. The decision taken by the Patna High<br \/>\n                                 Court on the issue raised by the petitioner has<br \/>\n                                 attained finality and the same could have been<br \/>\n                                 set aside only either in appeal or the same<br \/>\n                                 could have been modified by the same Court<br \/>\n                               upon a review being filed.\n<\/p><\/blockquote>\n<blockquote><p>                                     In the light of the submissions, this<br \/>\n                              application is dismissed. The petitioner shall<br \/>\n                              however be at liberty to take recourse to<br \/>\n                              appropriate remedial measures, if he is<br \/>\n                              aggrieved by the orders of the Court passed in<br \/>\n                              the earlier writ application.&#8221;<\/p><\/blockquote>\n<p>                 We do not find any illegality in the impugned judgment<br \/>\n           passed by the learned Single Judge.
