Agnihotri, J<\/p>\n<p>                 Dated: 22\/04\/2009<\/p>\n<p>:                 Judgement<\/p>\n<p> WRIT PETITION UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA           <\/p>\n<p>                       ORAL ORDER<br \/>\n          (Passed on 22nd day of  April, 2009)<\/p>\n<p>  1.   Challenge in this petition is to the appointment of<br \/>\n       a male candidate against the post reserved for a woman<br \/>\n       candidate on the post of &#8220;Silai Prashikshak&#8221;.\n<\/p>\n<p>  2.   The  facts,  in  brief, are that pursuant  to  the<br \/>\n       advertisement  dated  2.11.2007  (Annexure   P\/2),<br \/>\n       applications were invited from the candidates  for<br \/>\n       appointment on the post of Silai Prashikshak. It is<br \/>\n       clearly stated in the advertisement that one seat is<br \/>\n       available in unreserved category for male and one for<br \/>\n       women candidate. Learned counsel further submits that the<br \/>\n       petitioner, being a woman, made an application for<br \/>\n       appointment on the said post. The respondents 1 and 2<br \/>\n       have appointed respondent No. 3 against one post under<br \/>\n       unreserved category for male member and the respondent<br \/>\n       No. 4 against the post reserved for a woman candidate<br \/>\n       under the unreserved category. Thus, the appointment of<br \/>\n       respondent No. 4 is bad and contrary to the notification<br \/>\n       as the same defeats the purpose of reservation for a<br \/>\n       woman candidate.\n<\/p>\n<p>  3.   Shri Dubey, learned Panel Lawyer appearing for the<br \/>\n       respondent No. 1 and 2 submits that the respondent No. 3<br \/>\n       and  4  secured  more marks than  the  petitioner,<br \/>\n       accordingly, the respondent No. 3 and 4 were appointed as<br \/>\n       Silai Prashikshak even against the post reserved for a<br \/>\n       woman candidate. There was 25 minimum marks prescribed<br \/>\n       for appointment.\n<\/p>\n<p>  4.   Shri  Dubey  further submits that as  per  General<br \/>\n       Administration Department&#8217;s circular dated 10.02.1997, if<br \/>\n       a suitable women candidate is not available, the post<br \/>\n       shall not be carried forward, but the same may be filled<br \/>\n       up by a male candidate.\n<\/p>\n<p>  5.   Shri  Tulsyan, learned counsel appearing  for  the<br \/>\n       respondent  No. 4 submits that the  minimum  marks<br \/>\n       prescribed was 25 as per clause 9 of the advertisement.<br \/>\n       Smt. Mirza submits that the respondent No. 3 has secured<br \/>\n       maximum marks, thus, the respondent No. 3 is entitled to<br \/>\n       be  appointed against the post reserved for a male<br \/>\n       candidate.\n<\/p>\n<p>  6.   I  have  heard learned counsel appearing  for  the<br \/>\n       parties, perused the pleadings and documents appended<br \/>\n       thereto. I have found that there is no minimum qualifying<br \/>\n       marks prescribed for the post. It has admittedly been<br \/>\n       made clear that out of two posts vacant under unreserved<br \/>\n       category, one post was meant for male and the second was<br \/>\n       for a woman candidate. The basic purpose of reservation<br \/>\n       is to provide assistance to the weaker section of the<br \/>\n       society who cannot compete with the general category<br \/>\n       candidates.\n<\/p>\n<p>  7.   The  contention of Shri Tulsyan that  there  is  a<br \/>\n       provision of minimum qualifying marks is rejected as on<br \/>\n       bare perusal of the advertisement, there is no prescribed<br \/>\n       minimum qualification. No other document or statutory<br \/>\n       provision under rules or regulation have been produced in<br \/>\n       support of the contention that there was a minimum<br \/>\n       qualifying or cut-off marks. Since no minimum qualifying<br \/>\n       marks was fixed, the petitioner cannot be held as not<br \/>\n       suitable candidate. Thus, reliance of the State counsel<br \/>\n       on the above-stated circular is not applicable to the<br \/>\n       facts of the case. If the stand taken by learned counsel<br \/>\n       appearing for the State is accepted that would defeat the<br \/>\n       very purpose of reservation.\n<\/p>\n<p>  8.   For the reasons stated hereinabove, the appointment<br \/>\n       of respondent No. 4 is contrary to the reservation policy<br \/>\n       as  well as the advertisement dated 2.11.2007. The<br \/>\n       petitioner, being a woman candidate having proper marks<br \/>\n       in her category, is entitled to be appointed against the<br \/>\n       post reserved for a woman candidate. Thus, the petition<br \/>\n       is allowed.
