Heard learned counsel for the appellant.\n\n2.           Since all relatable documents, being the plaint of\n\nSuit No.259\/2003 and the written statement filed by the\n\nRFA-453\/08                                                Page 1 of 7\n contesting defendants in said suit as also the judgment and\n\ndecree dated 20.3.2004 dismissing said suit; the pleadings in\n\nthe instant suit out of which the instant appeal arises have\n\nbeen produced before us which have been perused by us, we\n\nare disposing of the appeal in limine.\n\n3.           Vide   impugned   judgment    and    decree   dated\n\n14.8.2008 the suit filed by the appellant has been dismissed\n\nholding the same to be an abuse of the process of Court. We\n\nalso note that the learned Trial Judge has held that the issue\n\nraised in the suit was litigated on an earlier occasion by the\n\nappellant resulting in the claim being dismissed vide judgment\n\nand decree dated 20.3.2004 which has attained finality and\n\nhence the suit is barred.\n\n4.           Way back, in the year 1999, the appellant had filed\n\na suit for permanent injunction alleging that he was the owner\n\nof 150 sq.yds. of land bearing Municipal No.IX\/5249-B Old\n\nSeelampur situated on a part of land comprised in Khasra\n\nNo.604\/301 Village Seelampur. The appellant alleged that the\n\ndefendants of the suit namely Anoop Sharma, Rakesh Sharma,\n\nBaljeet Singh, Arjun and Lakhi were obstructing the use and\n\noccupation of the subject property by the plaintiff.\n\n5.           Prayer made in the suit was to restrain the\n\ndefendants from dispossessing the plaintiff from the subject\n\nproperty and from preventing the plaintiff from raising\n\nRFA-453\/08                                             Page 2 of 7\n constructions thereon.\n\n6.           Anoop Sharma, Rakesh Sharma, Baljeet Singh,\n\nArjun and Lakhi filed a written statement alleging that the land\n\nin question is Patwar Ghar.\n\n7.           On the pleading of the parties following issues were\n\nsettled in the suit:-\n\n      \"(1) Whether the plaintiff is in possession of House\n           No.9\/5249-B Old Seelam Pur, Delhi in Khasra\n           No.604\/301 Seelam Pur Village, Delhi? OPP\n\n      (2)    Whether the plaintiff has any cause of action to file\n             the present suit?\n\n      (3)    Whether the plaintiff is entitled to relief as claimed\n             by him? OPP\n\n      (4)    Relief.\"\n\n8.           Parties led evidence.      Official witnesses were\n\nsummoned. Revenue record was summoned. Record of MCD\n\nwas summoned.\n\n9.           The finding returned by the learned Trial Judge vide\n\njudgment and decree dated 20.3.2004 was that the plaintiff\n\nhas obtained certain documents in collusion with officers of the\n\nMunicipal Corporation of Delhi. With reference to the evidence\n\nof the Halka Patwari who was examined as DW-2, the finding\n\nreturned was that the land in question is not comprised in\n\nKhasra No.604\/301.         On the said finding the suit was\n\ndismissed.\n\n10.          We may note that the suit filed by the appellant in\n\nRFA-453\/08                                                Page 3 of 7\n the year 1999 to which we have noted herein above, on\n\ntransfer was re-assigned No.259\/03 in the year 2003.\n\n11.          Having been disarmed by virtue of the judgment\n\nand decree dated 20.3.2004, the appellant resorted to the\n\nstratagem of contrivance.          Very cleverly he filed the instant\n\nsuit impleading Government of NCT of Delhi as defendant\n\nNo.1, the SDM (East Delhi) as defendant No.2, Halka Patwari as\n\ndefendant     No.3,       the     Tehsildar   as     defendant     No.4,\n\nCommissioner (MCD) as defendant No.5, the Additional Deputy\n\nCommissioner (Land &amp; Estate Department) MCD as defendant\n\nNo.6 and Assessor &amp; Collector of the MCD as defendant No.7.\n\nIn the suit, the appellant claimed a relief of declaration that he\n\nbe    declared      the   owner    of   property    No.IX\/5249-B     Old\n\nSeelampur. He also sought various consequential reliefs\n\nagainst the defendants.\n\n12.          Anoop Sharma, Rakesh Sharma, Baljeet Singh,\n\nArjun and Lakhi learned about the strategy adopted by the\n\nplaintiff and sought impleadment in the second suit filed by\n\nthe plaintiff. Impleadment was allowed. They were impleaded\n\nas defendants No.8 to 12.\n\n13.          Vide    impugned       judgment       and   decree   dated\n\n14.8.2008, learned Trial Judge has held that the plaintiff has\n\nresorted to abusing the judicial process by impleading\n\ngovernment officials as defendants by suppressing that on the\n\nRFA-453\/08                                                    Page 4 of 7\n same issue he had fought the battle with the private\n\nrespondents, who with reference to government record\n\nsuccessfully non-suited the appellant.\n\n14.           Finding   returned   is   that   the   decision   dated\n\n20.3.2004 estoppes the plaintiff to re-agitate the issue of title\n\nqua the property in dispute.\n\n15.           Learned counsel for the appellant urges that the\n\ndefendants No.1 to 7 impleaded by him in the instant suit were\n\nnot defendants in the earlier suit and no relief was claimed\n\nagainst the said defendants in the earlier suit.            Learned\n\ncounsel urges that the bar of res judicata requires that in the\n\npreviously instituted suit, the parties or their predecessors are\n\nthe same as in the subsequent suit.\n\n16.           Suffice would it be to state that Section 11 of the\n\nCode of Civil Procedure does not exhaust the principles of res\n\njudicata and on general principles of res judicata a plea of\n\nissue estoppel can always be urged.\n\n17.           Where a finding of fact has been returned inter se\n\nlitigation between different parties the same can operate as an\n\nissue estoppel in a subsequent litigation between different\n\nparties subject to the condition that the party against whom\n\nthe plea of issue estoppel is raised was a party in the earlier\n\nlitigation.\n\n18.           In the instant case, it has to be noted that the\n\nRFA-453\/08                                                  Page 5 of 7\n defence of Anoop Sharma and others in the previous suit was\n\nthat the suit property was a Patwar Ghar i.e. belonged to the\n\nGovernment.       They successfully established the same with\n\nreference to the record of the Government. The said finding\n\nthus operates as an issue estoppel and the appellant cannot\n\nlitigate on the same cause for a second time.\n\n19.          We note that the learned Trial Judge has been\n\nextremely lenient on the appellant by simply dismissing the\n\nsuit leaving the parties to bear their own costs.\n\n20.          Frivolous litigation has to be dispatched with a\n\nheavy hand.\n\n21.          We do so.\n\n22.          We      dismiss    the   appeal    imposing    costs      of\n\nRs.50,000\/- (Rupees Fifty Thousand only) on the appellant for\n\nwasting judicial time and misusing the process of law.\n\n23.          The costs shall be deposited by the appellant with\n\nthe Delhi High Court Legal Services Committee within a period\n\nof 4 weeks from today.\n\n24.          Proof    thereof   would   be     furnished   before    the\n\nRegistrar (Appeals).\n\n25.          The appeal shall be formally listed before the\n\nRegistrar (Appeals) on 19.1.2009.\n\n26.
