(Oral)\n<\/pre>\n<p>         The present appeal has been filed by Ashok Paswan son of<\/p>\n<p>Rajinder Paswan. He was sentenced by the Court of Special Judge,<\/p>\n<p>Hoshiarpur, to undergo ten years rigorous imprisonment and to pay a<\/p>\n<p>fine of Rs.1,00,000\/-, in default whereof to further undergo six months<\/p>\n<p>rigorous imprisonment. The appellant was found in possession of 40<\/p>\n<p>Kgs. of poppy husk.\n<\/p>\n<p>         The case of prosecution is that Atma Singh, Sub Inspector,<\/p>\n<p>along with his companion police officials, on 17.4.2001 was on patrol<\/p>\n<p>duty. Suspected persons were being checked. The police party when<\/p>\n<p>reached near katcha path leading towards the filed in the area of Urmur,<\/p>\n<p>appellant Ashok Pawan was sighted by him coming from the opposite<br \/>\n<span class=\"hidden_text\"> Criminal Appeal No. 110-SB of 2002                                     2<\/span><\/p>\n<p>side and he was carrying a bag on his head. On suspicion, he was<\/p>\n<p>apprehended by Atma Singh, Sub Inspector. At that time, Balwant Singh<\/p>\n<p>came there on a scooter and he was joined by a police party.<\/p>\n<p>Suspecting that appellant is carrying some contraband article, an offer<\/p>\n<p>was given to him to get himself searched from a Magistrate or a<\/p>\n<p>Gazetted Officer. The appellant disclosed that there was a poppy husk<\/p>\n<p>in the bag and he replied in pursuance of the offer made that he is<\/p>\n<p>willing to get himself searched from a Gazetted Officer. A wireless<\/p>\n<p>message was sent and the Deputy Superintendent of Police was<\/p>\n<p>requested to come at the spot. Necessary procedure for search and<\/p>\n<p>seizure was followed.\n<\/p>\n<p>          At this stage, Mr. J.B.S. Gill, Advocate, at the outset, has<\/p>\n<p>stated that he will not be assailing conviction of the appellant but shall<\/p>\n<p>be making a legal submission regarding quantum of sentence. It is<\/p>\n<p>stated that an amendment was made to the Act on 2.10.2001 by the<\/p>\n<p>amending Act No.9 of 2001, which came into force w.e.f. 2.10.2001.<\/p>\n<p>Small quantity and commercial quantity have been defined and table<\/p>\n<p>has been added, to Sub Clause vii(a) and xxiii(a) of Section 2 of the Act,<\/p>\n<p>as per entry No.110, poppy straw, small quantity defined is 1 Kg. and<\/p>\n<p>commercial quantity has been defined as 50 Kgs. Mr. J.B.S.Gill has<\/p>\n<p>further stated that from the appellant, 40 Kgs. of poppy husk has been<\/p>\n<p>recovered, therefore, same is to be held as non-commercial quantity.<\/p>\n<p>          A reliance has been placed on judgment of Hon&#8217;ble the Apex<\/p>\n<p>Court in Basheer @ <a href=\"\/doc\/1517833\/\">N.P. Basheer v. State of Kerala<\/a> 2004(1) Recent<\/p>\n<p>Criminal Reports 1008. Para 23 of Basheer @ N.P. Basheer&#8217;s case<\/p>\n<p>(supra) read as under:-\n<\/p>\n<p><span class=\"hidden_text\"> Criminal Appeal No. 110-SB of 2002                                   3<\/span><\/p>\n<blockquote><p>                 &#8220;23.      Thus, in our view, the Rubicon indicated<\/p>\n<p>                 by Parliament is the conclusion of the trial and<\/p>\n<p>                 pendency of appeal. In the cases of pending trials,<\/p>\n<p>                 and cases pending investigation, the trial is yet to<\/p>\n<p>                 conclude; hence, the retrospective mollification of<\/p>\n<p>                 the rigour of punishment has been made applicable.<\/p>\n<p>                 In the cases where the trials are concluded and<\/p>\n<p>                 appeals are pending, the application of the amended<\/p>\n<p>                 Act appears to have been excluded so as to<\/p>\n<p>                 preclude the possible contingency of reopening<\/p>\n<p>                 concluded trials. In our judgment, the classification is<\/p>\n<p>                 very much rational and based on clearly intelligible<\/p>\n<p>                 differentia, which has rational nexus with one of the<\/p>\n<p>                 objectives to be achieved by the classification. There<\/p>\n<p>                 is one exceptional situation, however, which may<\/p>\n<p>                 produce an anomalous result. If the trial had just<\/p>\n<p>                 concluded before 2.10.2001, but the appeal is filed<\/p>\n<p>                 after 2.10.2001, it cannot be said that the appeal<\/p>\n<p>                 was pending as on the date of the coming into force<\/p>\n<p>                 the Amending Act, and the amendment would be<\/p>\n<p>                 applicable even in such cases. The observations of<\/p>\n<p>                 this Court in Nallamilli&#8217;s case (supra) would apply to<\/p>\n<p>                 such a case. The possibility of such a fortuitous case<\/p>\n<p>                 would not be strong enough reason to attract the<\/p>\n<p>                 wrath    of   Article   14   and     is   constitutional<\/p>\n<p>                 consequences. Hence, we are unable to accept the<br \/>\n<span class=\"hidden_text\"> Criminal Appeal No. 110-SB of 2002                                    4<\/span><\/p>\n<p>                     contention that the proviso to Section 41 of the<\/p>\n<p>                     amending Act is hit by Article 14&#8243;.<\/p><\/blockquote>\n<p>          It will be necessary to examine this contention raised in the<\/p>\n<p>facts of the present case.\n<\/p>\n<p>          In the present case, recovery was effected on 17.4.2001. The<\/p>\n<p>judgment of conviction and sentence was pronounced on 25.10.2001<\/p>\n<p>The amendment has been made on 2.10.2001. Appeal in the present<\/p>\n<p>case was fled on 17.11.2001. Therefore, the appellant will be entitled to<\/p>\n<p>the benefit of the amendment as per ratio of judgment of Hon&#8217;ble the<\/p>\n<p>Apex Court rendered in Basheer @ N.P. Basheer&#8217;s case (supra).<\/p>\n<p>Therefore, the contraband recovered being non-commercial on the<\/p>\n<p>quantum of sentence, appellant is to be dealt with under Section 15(b) of<\/p>\n<p>the Act. Section 15(a) defines punishment for small quantity. Section 15<\/p>\n<p>(b) defines punishment for quantity lesser than commercial quantity but<\/p>\n<p>greater than small quantity. Section 15(b) read as under:-<\/p>\n<blockquote><p>                     &#8220;15(b) where the contravention involves      quantity<\/p>\n<p>                     lesser than commercial quantity but greater than<\/p>\n<p>                     small quantity, with rigorous imprisonment for a term<\/p>\n<p>                     which may extend to ten years and with fine which<\/p>\n<p>                     may extent to one lakh rupees&#8221;.<\/p><\/blockquote>\n<p>          Therefore, the maximum punishment which can be awarded<\/p>\n<p>can extend to ten years. Therefore, appellant can be sentenced to<\/p>\n<p>imprisonment less than ten years also.\n<\/p>\n<p>          It has been urged before me that in the present case the<\/p>\n<p>appellant was arrested on 17.4.2001 and he has suffered protracted<\/p>\n<p>trial for eight years.\n<\/p>\n<p><span class=\"hidden_text\"> Criminal Appeal No. 110-SB of 2002                                    5<\/span><\/p>\n<p>          Therefore, sentence awarded upon the appellant for ten years<\/p>\n<p>is set aside.
