    Petitioners  are  the  accused   and  first<\/p>\n
respondent  the   de   facto   complainant   in<\/p>\n
C.C.511\/2010 on the file of Chief Judicial<\/p>\n
Magistrate, Kasaragod.  First respondent filed<\/p>\n
Annexure II complaint before Chief Judicial<\/p>\n
Magistrate,     Kasaragod     alleging     that<\/p>\n
petitioners,  along  with  the   first  accused<\/p>\n
therein, the husband of the first respondent<\/p>\n
committed the offence under section 498A read<\/p>\n
with section 34 of Indian Penal Code.   It was<\/p>\n
sent for investigation under section 156(3) of<\/p>\n
Code of Criminal Procedure.   Crime 12\/2009 of<\/p>\n
Manjeshwar Police Station was registered. After<\/p>\n
investigation Annexure III final report was<\/p>\n
submitted  as  against  the  husband     alone,<\/p>\n
stating  that  there  is  no  material  against<\/p>\n

others and deleting       petitioners from the array of<\/p>\n
the accused.         The learned Magistrate has taken<\/p>\n
cognizance of the offence under section 498A, 323,<\/p>\n
and 324 read with section 34 of Indian Penal Code<\/p>\n
on    Annexure     III  final  report  as  C.C.233\/2009.<\/p>\n
First respondent filed Annexure I complaint as<\/p>\n
against       petitioners  incorporating  paragraph  11,<\/p>\n
which was not there originally in Annexure II<\/p>\n
complaint stating that petitioners also tortured<\/p>\n
and     harassed     her  demanding   dowry.     Learned<\/p>\n
Magistrate after conducting inquiry under section<\/p>\n
202 of Code of Criminal Procedure took cognizance<\/p>\n
of the offence as C.C.511\/2010.        This petition is<\/p>\n
filed     under    section  482  of  Code  of   Criminal<\/p>\n
Procedure to quash the cognizance taken.<\/p>\n
      2.         Learned  counsel  appearing   for   the<\/p>\n
petitioners was heard.\n<\/p>\n
      3.    The argument of the learned counsel is that<\/p>\n
when learned Magistrate has taken cognizance on<\/p>\n
Annexure III report accepting the final report<\/p>\n
whereunder after investigation the Investigating<\/p>\n
Crl.M.C.4294\/2010             3<\/span><\/p>\n
Officer has reported that there is no material to<\/p>\n
show     that     petitioners  committed  any   offence,<\/p>\n
learned Magistrate should not have taken cognizance<\/p>\n
on Annexure I complaint, which could only be a<\/p>\n
second       complaint   which  is   not   maintainable.<\/p>\n
Learned       counsel  also   argued  that  when   after<\/p>\n
investigation, no material was disclosed as against<\/p>\n
petitioners, learned Magistrate should not have<\/p>\n
taken cognizance of the offence on Annexure I<\/p>\n
complaint.\n<\/p>\n
      4.     On hearing the learned counsel, I cannot<\/p>\n
agree with the submission that for the reason that<\/p>\n
Annexure        II  final   report  was   accepted   and<\/p>\n
cognizance was taken       against the husband,  learned<\/p>\n
Magistrate cannot take cognizance of the offence<\/p>\n
against petitioners on a protest complaint filed by<\/p>\n
the first respondent he is satisfied of a prima<\/p>\n
facie case.         When a final report is submitted<\/p>\n
stating that one of the accused committed the<\/p>\n
alleged offence,       no notice will be issued by the<\/p>\n
learned Magistrate,        to the de facto complainant.<\/p>\n

So    first respondent has no opportunity to oppose<\/p>\n
the findings or        acceptance of Annexure III final<\/p>\n
report as such.         In Annexure I complaint first<\/p>\n
respondent       specifically alleged the ingredients of<\/p>\n
the offence as against the petitioners.           It is<\/p>\n
after satisfying on the inquiry conducted under<\/p>\n
section 202 of Code of Criminal Procedure, learned<\/p>\n
Magistrate has taken cognizance.       It cannot be said<\/p>\n
that cognizance taken is illegal.       Petitioners are<\/p>\n
at liberty to raise all the contentions including<\/p>\n
the absence of specific allegations in Annexure II<\/p>\n
complaint        originally   filed       against    the<\/p>\n
petitioners.        Petitioners are entitled to cross<\/p>\n
examine the witnesses to be examined under section<\/p>\n
244 of Code of Criminal Procedure and seek an order<\/p>\n
of    discharge    under   section  245(1) of   Code  of<\/p>\n
Criminal       Procedure.     If  petitioners  file   an<\/p>\n
application to dispense with their presence for the<\/p>\n
purpose of claiming discharge under section 245(1)<\/p>\n
of Code of Criminal Procedure or recording the<\/p>\n
evidence under section 244 of Code of Criminal<\/p>\n
