       These review petitions are filed for reviewing the common judgment<\/p>\n
in a batch of cases rendered by this Court on 5.9.2000 All the review<\/p>\n
petitions are accompanied by delay condonation petition and the delay is<\/p>\n
around 5 years.   The reasons caused for the delay in filing the review<\/p>\n
petitions are administrative reasons such as communication gap etc.<\/p>\n
While considering   the   delay condonation            petitions, we have also<\/p>\n
considered these cases on merits.\n<\/p>\n
       2.   The Trust of the Sankaramangalam Devaswom leased out<\/p>\n
some extent of property to different persons for cultivation. The lands<\/p>\n
have been held by the lessees and subsequently by their successors.<\/p>\n
When the Kerala Land Reforms Act came into force, most of the lessees<\/p>\n
have applied for purchase certificate under the said Act as cultivating<\/p>\n
tenants. None of the trustees of the Devaswom raised any objections<\/p>\n
before the Commissioner for Hindu Religious and Charitable Endowments<\/p>\n
about the issuance of the purchase certificates. By virtue of the purchse<\/p>\n
certiifcates they became absolute owners of the property. The learned<\/p>\n

Government Pleader       submitted that    sometime in 1985,      the then<\/p>\n
Managing Trustee of the Devaswom filed complaint before the<\/p>\n
Commissioner for Hindu Religious and Charitable Endowments stating<\/p>\n
that   Certificate of Purchase have been issued without prior approval of<\/p>\n
the Commissioner . The Commissioner challenged the issuance of the<\/p>\n
purchase certificates on the ground that the leases held by some of the<\/p>\n
lessees are invalid for want of prior sanction from him under Section<\/p>\n
29 of the Madras Hindu Religious and Charitable Endowments Act 1951.<\/p>\n
Against this order 18 Original Petitions have been filed by the aggrieved<\/p>\n
persons and a Division Bench of this Court considered the matter in detail<\/p>\n
and     by the common judgment dated            5.9.2000, found that the<\/p>\n
Commissioner has no authority to unsettle the rights conferred on the<\/p>\n
lessees who are the then land owners under the K.L.R Act, even though<\/p>\n
the question whether the temple is a public temple or not was raised before<\/p>\n
this Court. This Court allowed the Original petitions on the ground that<\/p>\n
the Commissioner has no authoirty to interfere with the leases held by the<\/p>\n
lessees.   The review petitions are filed by the Commissioner raising the<\/p>\n
the very same issues which were decided in the original Petitions. The<\/p>\n
Managing Trusteee of the Devaswom who was in charge at that time<\/p>\n
appears to have died in 1993 The present Managing trustee who is the<\/p>\n
petitioner in the connected Writ petition, has no grievance against the<\/p>\n
extent of property of the Devaswom being enjoyed by the lessees after<\/p>\n

obtaining certificate of purchase . No other trustees of the Devaswom has<\/p>\n
any    grievance against the possession of the properties by various<\/p>\n
lessees. The purchase certificate obtained by most of them are under<\/p>\n
Section 72-K of the Kerala Land Reforms Act.         In other words, nobody<\/p>\n
has any grievance about the properties         being owned and enjoyed by<\/p>\n
the lessees.    On merits, we find no ground to deviate from the common<\/p>\n
judgment that the Certificate of purchase issued under the K.L.R.Act<\/p>\n
cannot be interfered with by the Commissioner in exercise of his powers<\/p>\n
under Section 18 of the HR&CE Act.          Since we are agreeing with the<\/p>\n
findings of the Division Bench, we do not find any ground to interfere<\/p>\n
with the common judgment in review. Moreover there is no one, not even<\/p>\n
a devotee aggrieved by the loss of property to the temple.. Since we find<\/p>\n
no ground to condone the delay in filing the review petitions and it is also<\/p>\n
not explained properly by the State, we dismiss the delay petitions and<\/p>\n
consequently the review petitions.\n<\/p>\n
       3.    The writ petition is an offshoot for the proceedings initiated by<\/p>\n
the Commissioner against the lessees for the reason that the petitioner in<\/p>\n
the Writ petition supported the case of the Lessees\/land owners, taking<\/p>\n
the stand that the temple is not a public temple. We do think             the<\/p>\n
petitioner in the Writ petition can proceed against the Commissioner for<\/p>\n
a remedy in this regard . It is for the Commissioner to establish whether<\/p>\n
the temple is a public temple or not and if so in accordance with the<\/p>\n

procedure recognised under the HR & CE Act etc. Since the Division<\/p>\n
Bench in the common judgment has left open the issue, we are leaving<\/p>\n
open this issue, with a direction to the Commissioner to decide as and<\/p>\n
when it arises.     Accordingly we allow the Writ petition No. 180\/2005<\/p>\n
setting aside Ext.P4 memo of charges.\n<\/p>\n
       4.   The Government Pleader pointed out that the temple is notified<\/p>\n
as a public temple in the year 1994. We do not want to go into the legality<\/p>\n
or correctness of the notification declaring that the temple is a public<\/p>\n
temple because the writ petitioner has not challenged the notification and<\/p>\n
since the prayer in the writ petition is mainly to set aside Ext.P4 memo<\/p>\n
of charges issued against the petitioner,we allow this prayer by setting<\/p>\n
aside Ext.P4. In this context, we are of the view that there is no need for<\/p>\n
us to decide whether the temple is a public temple or not. It is open to<\/p>\n
the Commissioner to decide whether the temple is a public temple or a<\/p>\n
private one .\n<\/p>\n<\/p>\n
