Kuriakose, J<\/p>\n<p>     Under challenge in this Writ Petition filed by<\/p>\n<p>the tenant under Article 227 of the Constitution<\/p>\n<p>who is facing proceedings for eviction by way of<\/p>\n<p>RCP.9\/08    before    the    Rent    Control    Court,<\/p>\n<p>Wadakanchery      is  Ext.P3.   Under     Ext.P3,  an<\/p>\n<p>application filed by the petitioner for setting aside<\/p>\n<p>the Advocate Commissioner&#8217;s Report and another<\/p>\n<p>application filed by him for examining the<\/p>\n<p>Commissioner for deciding the application to set<\/p>\n<p>aside    the    Commissioner&#8217;s      Report      stands<\/p>\n<p>dismissed.    Sri.P.Ramachandran,       the    learned<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.10287 of 2010      -2-<\/span><\/p>\n<p>      counsel for the petitioner took us to the full text of<\/p>\n<p>      Ext.P3 order and submitted that Ext.P3 order<\/p>\n<p>      results in serious prejudice to the petitioner. We<\/p>\n<p>      do not think so. The RCP is filed against the<\/p>\n<p>      petitioner invoking the grounds under sub section<\/p>\n<p>      3 of section 9. It seems that the Commissioner<\/p>\n<p>      has filed a report which is to the effect that the<\/p>\n<p>      claim of the petitioner\/tenant that he is making<\/p>\n<p>      use of the entire area in the petition scheduled<\/p>\n<p>      premises for conducting his nursing home is not<\/p>\n<p>      correct. According to the learned counsel for the<\/p>\n<p>      petitioner, such a report is likely to prejudice the<\/p>\n<p>      mind of the Rent Control Court when the RCP<\/p>\n<p>      itself is taken up for decision. We do not think so.<\/p>\n<p>      We are sure that the Rent Control Court will<\/p>\n<p>      decide the Rent Control Petition in favour of the<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.10287 of 2010        -3-<\/span><\/p>\n<p>      landlord only if the evidence adduced by the<\/p>\n<p>      landlord is convincing and the same establishes<\/p>\n<p>      that the need urged by the landlord is a bona fide<\/p>\n<p>      one. We are also sure that all valid and relevant<\/p>\n<p>      contentions raised by the tenant will also be<\/p>\n<p>      enquired into by the Rent Control Court. The<\/p>\n<p>      Commission Report will be just one item of<\/p>\n<p>      evidence in the case. The Commissioner can be<\/p>\n<p>      cited as a witness and he will certainly get the<\/p>\n<p>      opportunity when the RCP is listed for trial. We<\/p>\n<p>      notice that the Rent Control Court itself has under<\/p>\n<p>      Ext.P3     observed    that    examination    of   the<\/p>\n<p>      Commissioner can be deferred to the stage of<\/p>\n<p>      trial. The visitorial jurisdiction of this Court under<\/p>\n<p>      Article 227 of the Constitution is invoked only in<\/p>\n<p>      exceptional circumstances. We do not think that<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.10287 of 2010       -4-<\/span><\/p>\n<p>      Ext.P3 can be branded as an order warranting<\/p>\n<p>      invocation of visitorial jurisdiction. We dismiss this<\/p>\n<p>      Writ Petition. However, we make it clear that the<\/p>\n<p>      Rent Control Court will be bound to permit the<\/p>\n<p>      petitioner to cite the Advocate Commissioner as a<\/p>\n<p>      witness for the purpose of cross examination, if<\/p>\n<p>      the Commissioner is not cited as a witness by the<\/p>\n<p>      landlords.\n<\/p>\n<\/p>\n<p>                                       PIUS C.
