The prayer, as made, is accepted. The Special Leave Petition<br \/>\n\tstands disposed of as withdrawn.&#8221;\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid order, present application has been preferred<br \/>\n\tby the applicant.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate, Mr.K.B.Anandjiwala for the applicant and learned<br \/>\n\tAPP, Mr.L.R.Pujari for the respondent-State.\n<\/p>\n<p>Rule.\n<\/p>\n<p>\t Learned APP, Mr.L.R.Pujari, for the respondent-State waives service<br \/>\n\tof rule.\n<\/p>\n<p>Mr.Anandjiwala<br \/>\n\thas taken this Court through the evidence on record as well as the<br \/>\n\tmaterial part of evidence. According to him, in nutshell, the crux<br \/>\n\tof the matter is that the deceased committed suicide due to illicit<br \/>\n\trelation of wife of the deceased(who is also the accused) with the<br \/>\n\tapplicant. It is further submitted that the deceased disclosed these<br \/>\n\tfacts before  his mother, father and brother of the wife of the<br \/>\n\tdeceased and, therefore, the wife of the deceased became annoyed and<br \/>\n\tto teach him a lesson, the alleged false complaint has been filed<br \/>\n\tagainst the deceased, his father, mother and sister for the offence<br \/>\n\tpunishable under Sec.498-A of IPC and, therefore,  the deceased<br \/>\n\tbecame totally upset and committed suicide. It is submitted that the<br \/>\n\tlady accused-wife of the deceased was released on bail by this<br \/>\n\tCourt.\n<\/p>\n<p>The<br \/>\n\tallegation against the present applicant-accused is that of an<br \/>\n\tabater as he kept illicit relation with wife of the deceased and has<br \/>\n\talso sent SMS through mobile phone to her which came to the<br \/>\n\tknowledge of the deceased and, therefore, he broke down and<br \/>\n\tcommitted suicide. However, the police papers prima facie do not<br \/>\n\tsuggest that the present applicant-accused compelled wife of the<br \/>\n\tdeceased or put her under fear to enter into illicit relation<br \/>\n\tagainst her will. As far as suicide note is concerned, it is stated<br \/>\n\ttherein that the deceased was a journalist and with an ulterior<br \/>\n\tmotive to bring pressure on the deceased, a false complaint is filed<br \/>\n\tby Manisha, wife of the deceased(accused) involving sister and<br \/>\n\tmother of the deceased in order that the talk of her illicit<br \/>\n\trelation with the present applicant should not be spread in the<br \/>\n\tsociety.  It was also stated in the suicide note that in the month<br \/>\n\tof February, 2007, the deceased gave slap to Manisha as she refused<br \/>\n\tto give salary and Manisha left her house and deceased did not try<br \/>\n\tto contact her but subsequently in the interest of children,<br \/>\n\tdeceased brought Manisha home to stay with his children.\n<\/p>\n<p>Thus,<br \/>\n\tit prima facie appears that there was a strain relation between the<br \/>\n\tdeceased and the accused Manisha and as Manisha lodged complaint for<br \/>\n\tthe offence under Sec.498-A of IPC against the deceased, his mother<br \/>\n\tand sister, the deceased committed suicide. As far as role<br \/>\n\tattributed to the applicant is concerned, his role appears to be<br \/>\n\tthat of a paramour and the present applicant and accused Manisha<br \/>\n\tvoluntarily entered into relationship and, therefore,  he is joined<br \/>\n\tas an accused as an abater. It is to be noted that the applicant is<br \/>\n\tin jail since 15-10-2008 and thus has completed three years in jail.<br \/>\n\tConsidering the role attributed to the accused, in the opinion of<br \/>\n\tthis Court, as the main accused Manisha was granted bail by this<br \/>\n\taccused, this application deserves to be allowed.\n<\/p>\n<p>This<br \/>\n\tapplication is allowed. Pending hearing and final disposal of<br \/>\n\tCriminal Appeal, the applicant is ordered to be released on bail on<br \/>\n\this executing personal bond of Rs.25,000\/- (Rupees Twentyfive<br \/>\n\tThousand only) with one solvent surety of like amount before the<br \/>\n\ttrial court and on condition that he shall not leave the territory<br \/>\n\tof Gujarat without prior permission of this Court and shall<br \/>\n\tforthwith deposit the passport, if any, with the trial court. Rule<br \/>\n\tis made absolute.
