JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/11\/2010  \nORAL ORDER<\/pre>\n<p>\tThis<br \/>\napplication has been filed with a prayer to substitute the applicant,<br \/>\nwho is the son of deceased Godavariben Damodarbhai Karia, as<br \/>\npetitioner in Special Civil Application No.5418\/2005, filed by the<br \/>\ndeceased.\n<\/p>\n<p>\tI<br \/>\nhave heard Mr.P.T.Jasani, learned counsel for the applicant and have<br \/>\nperused the averments made in the application. It is stated in the<br \/>\napplication that the applicant is the only surviving son of deceased<br \/>\nGodavariben Damodarbhai Karia, as the other son of the deceased viz.<br \/>\nArvindbhai Damodarbhai Karia, expired on 29.4.1978. Hence, it is<br \/>\nsubmitted by the learned counsel for the applicant that the<br \/>\napplicant, being the only surviving heir and legal representative of<br \/>\ndeceased Godavariben Damodarbhai Karia, may be permitted to be<br \/>\nsubstituted in place of the deceased in Special Civil Application<br \/>\nNo.5418\/2005, filed by her.\n<\/p>\n<p>\tIn<br \/>\nview of the above statement being made by the learned counsel for the<br \/>\napplicant, as well as the averments made in the application, the<br \/>\nprayers made in the application deserve to be granted.\n<\/p>\n<p>\tAccordingly,<br \/>\nthe application is allowed. The applicant Shri Girishbhai Damodarbhai<br \/>\nKaria, is permitted to be substituted as petitioner in Special Civil<br \/>\nApplication No.5418\/2005, in place of deceased Godavariben<br \/>\nDamodarbhai Karia.
