SURENDRA MOHAN, JJ.\n               ------------------------------------------------------------\n                         W.A.NO: 1451 OF 2010\n                -----------------------------------------------------------\n                Dated this the 31st August, 2010.\n\n                                    JUDGMENT\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>      Appeal is filed against judgment of the learned Single Judge<\/p>\n<p>dismissing the writ petition holding that appellants are not entitled<\/p>\n<p>to be absorbed in the batch of Field Assistants taken for training<\/p>\n<p>for promotion to Junior Health Inspectors. The appellants case is<\/p>\n<p>that on an earlier occasion after commencement of training some<\/p>\n<p>people were absorbed thereby extending the period of training in<\/p>\n<p>that batch. Govt. Pleader appearing for the respondents submitted<\/p>\n<p>that the training for the present batch commenced on 5\/4\/2010<\/p>\n<p>and as of now nearly five months training is over out of the total<\/p>\n<p>period of one year.           The appellants case is only based on a<\/p>\n<p>previous practice of taking people after commencement of training<\/p>\n<p>for the batch. We feel this was an unhealthy practice which was<\/p>\n<p>rightly discontinued.         Therefore, an unhealthy precedent earlier<\/p>\n<p>adopted by respondents does not justify the claim of the appellants<\/p>\n<p>for being taken for training after an expiry of nearly half of the<\/p>\n<p>period. We therefore find no merit in the writ appeal and it is<\/p>\n<p><span class=\"hidden_text\">W.A.1451\/2010                   2<\/span><\/p>\n<p>accordingly dismissed.     However, we are of the view that after<\/p>\n<p>absorbing all the trained persons if vacancies are likely to be there<\/p>\n<p>then the respondents should arrange for commencement of the<\/p>\n<p>training in the next batch without delay.<\/p>\n<p>                                       C.N.RAMACHANDRAN NAIR<br \/>\n                                               Judge<\/p>\n<p>                                         K.
