The allegation is that<\/p>\n<p>the accused had cut, removed and transported  27 Kgs. of<\/p>\n<p>sandal   wooden   logs   in   an   autorickshaw,   bearing<\/p>\n<p>registration No. KL 14F 4066,  at Periya village.  The first<\/p>\n<p>accused   had   been   arrested   on   the   spot.     The   second<\/p>\n<p>accused escaped and   thereafter, he   absconded.     Hence<\/p>\n<p>this application, under Section 438 Cr.P.C.<\/p>\n<p>      2.    I heard both sides.  During the pendency of the<\/p>\n<p>investigation,   the police had made over the investigation<\/p>\n<p>to   the   Forest   Range   Officer,   Kanjagad.     However<\/p>\n<p>considering the submissions made by both sides, I direct<\/p>\n<p>the petitioner to surrender before the Judicial Magistrate<\/p>\n<p>of First Class-I, Hosdurg,  on 26.7.2006 at 11.00 a.m.  The<\/p>\n<p>petitioner may move an  application for bail, after serving<\/p>\n<p>copy of the same, to the APP and if there is no prayer for<\/p>\n<p>B.A.4234\/2006<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>the   custody   of   the   accused,   for   the   completion   of   the<\/p>\n<p>investigation,   the   learned   Magistrate   shall   pass<\/p>\n<p>appropriate orders on the bail application, that may be<\/p>\n<p>filed by the petitioner before that Court,  and pass orders<\/p>\n<p>on merit, on the same day itself.\n<\/p>\n<p>             The application is disposed of as above.<\/p>\n<p>                                              J.M.JAMES<br \/>\n                                              JUDGE<\/p>\n<p>mrcs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Khalid.
