ABDUL REHIM, J.\n               - - - - - - - - - - - - - - - - - - - - - - -\n                  W.P.(C)No. 33808 of 2009\n               - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 18th day of December, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>     1.   Exts.P4 &amp; P5 assessments completed under the<\/p>\n<p>provisions of Section 17 D of the Kerala General Sales Tax<\/p>\n<p>Act, 1963 (KGST Act) is under challenge. Eventhough the<\/p>\n<p>petitioner filed appeal against those assessments, the same<\/p>\n<p>were not entertained for want of remittance of the tax<\/p>\n<p>amount, as stipulated in 17 D (5) of the KGST Act. The<\/p>\n<p>petitioner has raised challenge against validity of Section 17<\/p>\n<p>D (5). But the question stands covered by a decision of a<\/p>\n<p>Division Bench of this court. Through amendment of the<\/p>\n<p>writ petition, the petitioner raise further challenges to the<\/p>\n<p>effect that Exts.P4 &amp; P5 are not sustainable. It is noticed<\/p>\n<p>that a Division Bench of this court while upholding validity<\/p>\n<p>of Section 17 D observed as follows:\n<\/p>\n<blockquote><p>          &#8220;Eventhough we have upheld the validity of<br \/>\n     the statutory provisions, we are unable to uphold<br \/>\n     the impugned assessments for the simple reason<br \/>\n     that the none of the assessments challenged in<br \/>\n     the Writ appeals or in the Writ petitions was<br \/>\n     completed in accordance with the procedure<\/p>\n<p>W.P.(C)No. 33808 of 2009<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>     contemplated under section 17D. It is clear from<br \/>\n     clause (g) of Section 17 D(2) that the team<br \/>\n     constituted under section 17 (D) should fix the<br \/>\n     venue and date of hearing and hold sitting to hear<br \/>\n     the parties after issuing notice in advance to<br \/>\n     dealers concerned. Further, information in this<br \/>\n     regard should be published in local media as well.<\/p><\/blockquote>\n<p>     It is provided in Sub section (3) of Section 17 D<br \/>\n     that all assessments under Fast Track Method<br \/>\n     should be unanimous decision signed by all team<br \/>\n     members. It is very clear from the scheme that all<br \/>\n     the team members should sit together, consider<br \/>\n     the returns filed, accounts and records produced,<br \/>\n     hear the parties or their representatives and<br \/>\n     suggest proposal for assessment. If an assessment<br \/>\n     by consent can be passed, then assessment order<br \/>\n     should be passed in accordance with the terms<br \/>\n     agreed in first sitting itself. The assessments that<br \/>\n     could be completed in the first sitting are cases<br \/>\n     where team of Assessing Officers accept the<br \/>\n     returns filed or with such additions which the<br \/>\n     party agrees. On the other hand, if assessment is<br \/>\n     proposed in deviation with turnover returned or<br \/>\n     against additions over and above if any agreed by<br \/>\n     the parties, then it is for the very same team to<br \/>\n     issue pre-assessment notice containing proposal<br \/>\n     for assessment and the same should be signed by<br \/>\n     all of them. The party should be given sufficient<br \/>\n     time to file objections and the next date of public<br \/>\n     hearing by the committee should be informed to<br \/>\n     the party. Assessment has to be complete after<br \/>\n     hearing the party by team on the objection filed to<br \/>\n     the pre-assessment notice and in order to have a<br \/>\n     binding assessment, the assessment should be<br \/>\n     one completed with unanimous agreement of all<br \/>\n     the team members, In fact, ex-parte assessment is<br \/>\n     contemplated only when parties who are served<\/p>\n<p>W.P.(C)No. 33808 of 2009<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>     notice informing the venue and date of hearing<br \/>\n     fail to appear. Here again, we are of the view that<br \/>\n     there is no harm in giving one more opportunity,<br \/>\n     if the team of officers feel that the party is not<br \/>\n     absenting deliberately. Since in all these cases<br \/>\n     assessments are completed by issuing pre-<br \/>\n     assessment notice by individual officers, we feel<br \/>\n     that the procedure contemplated and stated by us<br \/>\n     above is not strictly followed and so much so,<br \/>\n     orders passed cannot be sustained under the<br \/>\n     provision of Section 17 D. We, therefore allow the<br \/>\n     writ appeals and writ petitions in part by vacating<br \/>\n     the impugned assessment orders, but with<br \/>\n     direction to the assessment team to complete the<br \/>\n     assessment afresh under section 17 D within a<br \/>\n     period of three months from the date of receipt of<br \/>\n     copy of this judgment after issuing notice to all<br \/>\n     parties and after hearing their objections. We<br \/>\n     make it clear that each and every objection raised<br \/>\n     by the parties in the reply to pre-assessment<br \/>\n     notice should be considered and unanimous<br \/>\n     decision should be taken by the team members.<br \/>\n     We do not want to examine the other issues raised<br \/>\n     in some of the cases like challenge against other<br \/>\n     statutory provisions, challenge against penalty<br \/>\n     orders etc. These issues are left open. We leave<br \/>\n     freedom to the parties to challenge the penalty<br \/>\n     orders before statutory authorities because those<br \/>\n     are not issued under section 17 D. So far as<br \/>\n     challenge against other statutory provision are<br \/>\n     concerned, we leave it open to the parties to raise<br \/>\n     any such challenge, if required, after completion<br \/>\n     of assessments afresh as stated above&#8221;.\n<\/p>\n<p>      2.    In view of the directions contained in the Division<\/p>\n<p>Bench Judgment cited supra (Hindustan Petroleum Corporation<\/p>\n<p>W.P.(C)No. 33808 of 2009<br \/>\n<span class=\"hidden_text\">                               -4-<\/span><\/p>\n<p>Ltd. V. Assistant Commissioner and others: Writ Appeal<\/p>\n<p>No.1714\/2009 and connected cases Jt:dt:8\/10\/ 2009), I am of<\/p>\n<p>the opinion that the impugned assessment in this writ<\/p>\n<p>petition is not sustainable and hence matter needs fresh<\/p>\n<p>disposal by the authority concerned.\n<\/p>\n<p>      3.     Therefore the writ petition is allowed quashing<\/p>\n<p>the impugned assessment finalised under section 17 D and<\/p>\n<p>also the consequential demand raised if any for realisation<\/p>\n<p>of   amounts        covered under  such   assessments.  The<\/p>\n<p>respondent concerned, (The Fast Track Team) is directed to<\/p>\n<p>take fresh steps necessary for completing the assessment<\/p>\n<p>taking into consideration of the directions contained in the<\/p>\n<p>Division Bench judgment. The fresh assessment as directed<\/p>\n<p>above shall be completed as early as possible, at any rate<\/p>\n<p>within a period of three months from the date of receipt of<\/p>\n<p>the copy of this judgment, after affording adequate<\/p>\n<p>opportunities to the petitioner as directed above.\n<\/p>\n<p>                                         C.K.
