1.\tThis
\napplication is preferred under Section 439 of the Code of Criminal
\nProcedure, 1973 seeking regular bail by the applicant, who came to be
\narrested in connection with FIR registered as M. Case No. 36  of
\n2007  before learned Judicial Magistrate, First Class, Gandhidham for
\nthe offence punishable under Sections 406 and 420  of the Indian
\nPenal Code.\n<\/p>\n
2.\tLearned
\nadvocate Mr. Saiyed submitted that the applicant is an innocent
\nperson and he has been falsely implicated in the commission of the
\nalleged offence. He further submitted that the applicant is a victim
\nof circumstances and at best it can be stated that the applicant
\nfailed in fulfilling the promise made by him, but the same has not
\nbeen done with any ulterior motive or pre-determination. He submitted
\nthat though the applicant started a scheme, it went beyond his
\ncontrol for various reasons.  Learned advocate for the applicant,
\nhowever, submitted that the applicant is willing to repay the entire
\namount to the complainant and he will deposit 1\/3rd amount
\ndue to the complainant before the trial Court and the remaining
\namount will also be deposited before the trial Court within one month
\nfrom the date of release and since the accused is willing to deposit
\nthe amount, his case may be considered sympathetically.\n<\/p>\n
3.\tLearned
\nPublic Prosecutor Mr. Jani, while opposing bail application submitted
\nthat the applicant has cheated large number of persons coming from
\nthe lower strata of the Society. He submitted that considering the
\nrole attributed to the applicant and the manner in which the offence
\nis committed, discretionary relief may not be exercised in favour of
\nthe applicant, and the application deserves to be dismissed.\n<\/p>\n
4.\tHeard
\nlearned counsel appearing for the applicant and learned APP at length
\nand in great detail. I have also perused the averments made in the
\napplication, submissions canvassed by learned advocate before me as
\nwell as the FIR produced on record. I have also considered the
\nprovisions of Sections 406 and 420 of the Indian Penal Code, gravity
\nof the offence and quantum of punishment which can be imposed in the
\nevent of conviction of the applicant.  Though the applicant has
\ncollected huge amount from persons belonging to the lower strata of
\nthe Society with the promise of providing accommodation and later on
\ndid not do so, considering the fact that the applicant has
\nvolunteered and shown willingness to deposit 1\/3rd amount
\nimmediately and the remaining amount within one month of his release
\non bail,  I am of the view that taking into consideration the
\ninterest of the complainant in the peculiar facts and circumstances
\nof the case and without making it as a precedent, the  applicant is
\nrequired to be enlarged on regular bail at this stage, without
\nentering into the merits of the case and without discussing the
\nevidence in detail.\n<\/p>\n
5.\tThe
\nparties do not press for further reasoned order.\n<\/p>\n
6.\tIn
\nthe facts and circumstances of the case, the application is allowed.
\nThe applicant is ordered to be enlarged on bail in connection with M.
\nCase No. 36  of  2007  registered before Gandhidham ‘A’ Division
\nPolice Station, subject also to the conditions that he shall:\n<\/p>\n
[i].\tDeposit
\n1\/3rd amount due to the complainant before the learned
\nJMFC Gandhidham before being enlarged on bail, as volunteered by the
\napplicant.\n<\/p>\n
[ii].\tBefore
\nbeing enlarged on bail, file an undertaking before this Court in the
\npresent proceedings and produce a copy thereof to the learned JMFC,
\nGandhidham to the effect that he volunteers to deposit 1\/3rd
\namount due to the complainant before being enlarged on bail and the
\nremaining amount within a period of one month from the date of his
\nrelease.\n<\/p>\n
[iii].\tExecute
\na bond of Rs.5,000\/- [Rupees five thousand only] before the trial
\nCourt with one surety of the like amount to the satisfaction of the
\ntrial court.\n<\/p>\n
[iv]\tNot
\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n
[v].\tNot
\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n
[vi].\tSurrender
\nhis passport, if any, to the lower court within a week;\n<\/p>\n
[vii].\tNot
\nleave the State of Gujarat without the prior permission of the
\nSessions court concerned;\n<\/p>\n
[viii].\tMark
\nhis presence at Gandhidham ‘A’ Division Police Station twice in a
\nmonth, i.e. on 1st and 15th of every English
\ncalendar month between 9.00 AM and 2.00 PM. till the trial is over;\n<\/p>\n
[ix].\tFurnish
\nthe present address of his residence to the I.O. and also to the
\nCourt at the time of execution of the bond and shall not change his
\nresidence without prior permission of this Court;\n<\/p>\n
[x].\tMaintain
\nlaw and order.\n<\/p>\n
[xi].\tIf
\n1\/3rd amount due to the complainant is not deposited as
\nvolunteered, and if undertaking to pay 1\/3rd amount
\ninitially and the remaining amount within a month from the date of
\nhis release as volunteered by the applicant is not filed, the
\napplicant shall not be released.\n<\/p>\n
[xii]\tIf
\nthe remaining amount is not deposited within one month from the date
\nof his release as per the undertaking, bail granted by this Court
\nshall stand automatically cancelled.\n<\/p>\n
7.\tIf
\nbreach of any of the above conditions is committed, then also the
\nlearned Judge concerned will be free to issue warrant or to take
\nappropriate action in the matter.\n<\/p>\n
8.\tBail
\nbond to be executed before the lower Court having jurisdiction to try
\nthe case.\n<\/p>\n
9.\tAt
\nthe trial, the trial Court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the  applicant on bail.\n<\/p>\n
10.\tRule
\nis made absolute to the aforesaid extent.\n<\/p>\n
11.\tDirect
\nService is permitted.\n<\/p>\n
