Justice K.M.JOSEPH\n\n Dated :07\/12\/2007\n\n O R D E R\n                        H.L.DATTU, C.J. &amp; K.M.JOSEPH, J.\n                             ------------------------------------------\n                                W.P.(C) No.36276 of 2007\n                             ------------------------------------------\n                      Dated, this the 7th day of December, 2007\n\n                                     JUDGMENT\n<\/pre>\n<p>H.L.Dattu, C.J.\n<\/p>\n<p>        Certain public spirited citizens are before this Court for the following<\/p>\n<p>reliefs:\n<\/p>\n<blockquote><p>                &#8220;a) issue a writ in the nature of mandamus, or any other<\/p>\n<p>        such appropriate writ, order or direction, commanding the<\/p>\n<p>        respondents 3 and 4 to immediately initiate steps necessary<\/p>\n<p>        for the acquisition of the entire building bearing Nos: VI\/794 &#8211;<\/p>\n<p>        806, belonging to the 5th respondent and situated in RS<\/p>\n<p>        No.127\/7 (New No: 127\/11), so as to proceed with the<\/p>\n<p>        widening of the Pappinissery Pilathara Public Road under the<\/p>\n<p>        KST Project, invoking the provisions of the Land Acquisition<\/p>\n<p>        Act;\n<\/p><\/blockquote>\n<blockquote><p>                b) to issue any other such writ, order or direction as this<\/p>\n<p>        Hon&#8217;ble Court may deem fit and necessary to issue in order to<\/p>\n<p>        meet the ends of justice in the facts and circumstances of the<\/p>\n<p>        instant case; and<\/p>\n<\/blockquote>\n<blockquote><p>                c) to award the costs of these petitioners in these<\/p>\n<p>        proceedings.&#8221;<\/p><\/blockquote>\n<p>        2. The 5th respondent in this writ petition was the petitioner in W.P.(C)<\/p>\n<p>No.31421 of 2006. In that she had sought for certain declaration. This Court<\/p>\n<p>by its order dated 31st January, 2007 was pleased to allow the writ petition and<\/p>\n<p>was further pleased to observe as under:<\/p>\n<blockquote><p>               &#8220;It is declared that either the authorities proceed to<\/p>\n<p>        acquire the entire building or forbear from acquiring a part of<\/p>\n<p>        the building. It is open to the authorities to exercise their option<\/p>\n<p>        for acquiring the entire building, within a period of three months<\/p>\n<p>        from the date of this judgment, failing which the proceedings of<\/p>\n<p>        acquiring of the part of the building will stand quashed.&#8221;<\/p>\n<\/blockquote>\n<p>W.P.(C) No.36276\/2007<br \/>\n<span class=\"hidden_text\">                                              2<\/span><\/p>\n<p>       3. In the present writ petition filed by the public spirited citizens, they<\/p>\n<p>request us to direct respondents 3 and 4 to acquire the building which belongs<\/p>\n<p>to the 5th respondent.\n<\/p>\n<p>       4.
