Bishnoi, Public Prosecutor for the State.\n\nBY THE COURT :<\/pre>\n<p>       State     has     preferred      leave   to   appeal<\/p>\n<p>application, whereby, the State has sought to<\/p>\n<p>challenge the judgment dated 24.03.2009 passed<\/p>\n<p>by the Addl. Sessions Judge (Fast Track), Balotra<\/p>\n<p>(Headquarters Barmer) in Sessions Case No.71\/08<\/p>\n<p>(46\/08),       whereby,      accused-respondents          were<\/p>\n<p>acquitted      from    the   charge    for   commission     of<\/p>\n<p>offences under Sections 498 A, 304 B\/alternatively<\/p>\n<p>302, I.P.C.     Another revision petition has been filed<\/p>\n<p>by the complainant against the same judgment.<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>Hence, this common order in both these cases.<\/p>\n<p>     It   is   contended      by   the     learned   Public<\/p>\n<p>Prosecutor for the State as well as learned counsel<\/p>\n<p>for the complainant that the judgment impugned is<\/p>\n<p>totally erroneous and passed without application of<\/p>\n<p>mind.     The prosecution proved its case beyond<\/p>\n<p>reasonable doubt for committing offences under<\/p>\n<p>Sections 498 A and 304 Part B, I.P.C. but the<\/p>\n<p>learned   trial    Court     without     appreciating   the<\/p>\n<p>prosecution       evidence    acquitted     the   accused-<\/p>\n<p>respondents from the charges levelled against them<\/p>\n<p>which is contrary to the basic principles of law.        It<\/p>\n<p>is argued that ample evidence was produced before<\/p>\n<p>the Court to prove the allegations of demand of<\/p>\n<p>dowry and, admittedly, deceased was married to<\/p>\n<p>accused Bhanwara Ram on 27.05.2007 and she<\/p>\n<p>died within seven years of marriage, therefore,<\/p>\n<p>upon this reason alone, presumption was to be<\/p>\n<p>drawn for convicting the accused-respondents for<\/p>\n<p>offences under Sections 304 Pt B and 498A, I.P.C.<\/p>\n<p>but the learned trial Court erroneously gave finding<\/p>\n<p>that there is no evidence on record to convict the<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>accused-respondents for commission of the alleged<\/p>\n<p>offences.\n<\/p>\n<p>      Learned counsel for the complainant invited<\/p>\n<p>our   attention   towards   one     of   the   facts   that<\/p>\n<p>judgment was delivered by the trial Court on<\/p>\n<p>24.03.2009 and FSL report was received after the<\/p>\n<p>judgment was rendered in the case and in the FSL<\/p>\n<p>report it was observed that poison was found in the<\/p>\n<p>stomach of the deceased but the said document<\/p>\n<p>was not on record on the date of the judgment,<\/p>\n<p>therefore, the judgment impugned may be quashed<\/p>\n<p>and case may be remitted to the trial Court for re-<\/p>\n<p>considering the matter afresh while taking into<\/p>\n<p>consideration the FSL report which is said to be<\/p>\n<p>received after the judgment and was not brought to<\/p>\n<p>the notice of the trial Court when the judgment was<\/p>\n<p>delivered in the case.          Learned counsel for the<\/p>\n<p>revisionist vehemently argued that the FSL report<\/p>\n<p>was to be considered at the time of deciding the<\/p>\n<p>case by the trial Court.\n<\/p>\n<p>      We have considered the submissions made by<\/p>\n<p>learned Public Prosecutor as well as learned counsel<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>for the complainant and perused the judgment<\/p>\n<p>impugned alongwith application for leave to appeal<\/p>\n<p>and revision petition.\n<\/p>\n<p>     After perusing the judgment, we are of the<\/p>\n<p>opinion that the learned trial Court after considering<\/p>\n<p>the entire material on record gave the finding that<\/p>\n<p>prosecution has failed to prove that soon before the<\/p>\n<p>death of the deceased, there was any demand of<\/p>\n<p>dowry, so also, no injury was found upon the body<\/p>\n<p>of deceased Kamla and cause of death was also not<\/p>\n<p>ascertained.      In whole of the discussion, it has<\/p>\n<p>been categorically found by the learned trial Court<\/p>\n<p>that the prosecution has not proved its case beyond<\/p>\n<p>reasonable doubt because no injury was found upon<\/p>\n<p>the body of the deceased.      Further, the prosecution<\/p>\n<p>case with regard to demand of dowry soon before<\/p>\n<p>the occurrence has also not been proved by the<\/p>\n<p>prosecution, therefore, the finding arrived at by the<\/p>\n<p>learned   trial   Court   does     not   require   any<\/p>\n<p>interference.\n<\/p>\n<p>     With regard to argument of learned counsel<\/p>\n<p>for the appellant\/petitioner for remanding the case<br \/>\n<span class=\"hidden_text\">                           5<\/span><\/p>\n<p>to the trial Court for re-consideration on the ground<\/p>\n<p>that FSL report was received after the judgment<\/p>\n<p>was delivered, we are of the opinion that at this<\/p>\n<p>stage after perusal of the FSL report, we do not find<\/p>\n<p>sufficient cause made out to remit the case for<\/p>\n<p>retrial because upon perusal of the FSL report also<\/p>\n<p>there is still doubt what was the cause of death.   In<\/p>\n<p>this view of the matter, in our opinion, the<\/p>\n<p>judgment impugned does not suffer from any<\/p>\n<p>perversity or illegality and the finding arrived at by<\/p>\n<p>the learned trial    Court does not require any<\/p>\n<p>interference.\n<\/p>\n<p>      Consequently, both, criminal leave to appeal<\/p>\n<p>application as well as revision petition are hereby<\/p>\n<p>dismissed.\n<\/p>\n<p>(Gopal Krishan Vyas) J.
