The appellants are aggrieved by the order dated<br \/>\n11.03.2008 passed by the learned trial Court below notice of motion<br \/>\nwhereby the learned trial Court has rejected the notice of motion.<br \/>\nThe suit has been filed seeking restrain order against the Ahmedabad<br \/>\nMunicipal Corporation {hereinafter referred to as  AMC }<br \/>\nrestraining it from regularizing certain constructions which<br \/>\naccording to the plaintiffs-appellants, is illegal construction.<br \/>\nDifferently put, the plaintiffs-appellants desires that the<br \/>\nconstruction in question, which according to them is illegal, should<br \/>\nnot be regularized by the AMC and the suit is filed for such<br \/>\ndeclaration and direction.\n<\/p>\n<p>\tFor<br \/>\nthe reasons recorded in the order, the learned trial Court has<br \/>\nrejected the notice of motion by impugned order dated 11.03.2008.\n<\/p>\n<p>\tThe<br \/>\nplaintiffs-appellants are aggrieved by the said order, however, have<br \/>\ncaused delay in filing the appeal against the impugned order. The<br \/>\ndelay, as aforesaid, is of 523 days. Hence, present application<br \/>\nseeking condonation of delay.\n<\/p>\n<p>\tOut<br \/>\nof all the respondents, the respondent No.3-AMC against whom the<br \/>\nrelief that it should not regularize the illegal construction is<br \/>\nprayed for, has come forward with the affidavit opposing the delay.<br \/>\nThe respondent No.3-AMC has contended that the delay is not<br \/>\nsatisfactorily explained and only vague averments are made and<br \/>\ntherefore, the application may be rejected.\n<\/p>\n<p>\tHaving<br \/>\nregard to the averments made in the application and submissions made<br \/>\nduring the hearing, it does not come out that the delay was caused<br \/>\nwith ill-intention. The reasons which caused delay have been stated<br \/>\nin the application. It appears that instead of rejecting the<br \/>\napplication and depriving the applicants-appellants from prosecuting<br \/>\nthe appeal on merits, it would be in the interest of justice to allow<br \/>\npresent application and condone the delay so that all the parties,<br \/>\nincluding the respondent No.3-AMC, can get an opportunity to<br \/>\nprosecute and\/or defend he appeal on merits.\n<\/p>\n<p>\tIn<br \/>\nview of above, the application is allowed in terms of para<\/p>\n<p> 9(A).\n<\/p>\n<p>Rule is made absolute to the aforesaid extent.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, no order as to cost.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[K.M.Thaker,<br \/>\nJ.] <\/p>\n<p>kdc<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Mohammedhussain vs State on 8 October, 2010 Author: K.M.Thaker,&amp;Nbsp;
