Mr. K.T.\n<\/p>\n<p>Dave, learned Additional Public Prosecutor waives service of rule on<br \/>\nbehalf of the respondent.  At the request of the learned counsel<br \/>\nappearing for the parties, this application is taken up for hearing<br \/>\ntoday.\n<\/p>\n<p>\tThis application<br \/>\nis filed under section 439 of the Code of Criminal Procedure in<br \/>\nconnection with First Information Report registered as C.R. No.I \u00fd<br \/>\n26 of 2008 dated 16.05.2008 filed before the Vichhiya Police Station,<br \/>\nDist. Rajkot for the offence punishable under section 395, 397,<br \/>\n506(2) of the Indian Penal Code.\n<\/p>\n<p>\tIt is submitted<br \/>\nby learned advocate for the petitioner that on 15.05.08 when the<br \/>\ncomplainant Magajiben and her nephew Thakersibhai were going on motor<br \/>\ncycle and passing through Motamatra village, a scuffle took place<br \/>\nwith the petitioner.  It is also alleged that thepetitioner No.1,<br \/>\nRanchhodbhai has inflicted an axe blow on Magajiben and petitioners<br \/>\nNo. 1 and 3 have also inflicted axe blow on witness Thakersibhai on<br \/>\nthe head. It is further alleged that petitioner No.2, 3 and 5 have<br \/>\ninflicted lathi blow. It is further alleged that petitioners No. 1<br \/>\nand 3 have also looted cash amount. However, learned advocate for the<br \/>\npetitioners submitted that during remand nothing was recovered in<br \/>\ncash. Learned advocate for the petitioners submitted that the<br \/>\nincident had taken place because of enmity with the other side, and,<br \/>\ntherefore, it is a fit case to release the petitioner on regular<br \/>\nbail.\n<\/p>\n<p>\tAs against the<br \/>\naforesaid submissions, Mr. K.T. Dave, learned APP submitted that the<br \/>\nincident took place out of enmity between both the sides, and,<br \/>\ntherefore, strict condition is required to be imposed on the<br \/>\npetitioner while granting bail to the petitioner.\n<\/p>\n<p>\tHeard learned<br \/>\nadvocate Mr. Mehul Shah for the petitioners and Mr. K.T. Dave,<br \/>\nlearned APP at length and in great detail.  I have also perused the<br \/>\naverments made in the application as well as the FIR produced on<br \/>\nrecord at Annexure &#8216;A&#8217;to the petition.  Considering the gravity of<br \/>\nthe offence, the involvement of the petitioner in the commission of<br \/>\noffence and the fact that the injured who were admitted in the<br \/>\nhospital have now been discharged from the hospital and taking into<br \/>\nconsideration the fact that there was enmity between the parties, I<br \/>\nam of the view that the the applicant is required tobe enlarged on<br \/>\nregular bail at this stage, without discussing the evidence in<br \/>\ndetail.\n<\/p>\n<p>\tThe parties do<br \/>\nnot press for further reasoned order.\n<\/p>\n<p>\tIn the facts and<br \/>\ncircumstances of the case, the application is allowed and the<br \/>\napplicants are ordered to be enlarged on bail in connection with C.R.<br \/>\nNo.I-26 of 2008 registered at the Vichhiya Polie Station on executing<br \/>\na bond of Rs.10,000\/- each [Rupees ten thousand only] with one surety<br \/>\neach of the like amount to the satisfaction of the trial court and<br \/>\nsubject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b].\tnot act in a<br \/>\nmanner injurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender his<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot to enter<br \/>\nthe territorial limits of Sayala Taluka situated in Surendranagar<br \/>\nDistrict.\n<\/p>\n<p>[e].\tnot leave the<br \/>\nState of Gujarat without the prior permission of the Sessions court<br \/>\nconcerned;\n<\/p>\n<p>[f].\tmark their<br \/>\npresence at Vicchiya police station on any day of every first week of<br \/>\nEnglish calendar month between 9.00 AM and 2.00 PM. till the trial is<br \/>\nover;\n<\/p>\n<p>[g].\tfurnish the<br \/>\npresent address of their residence to the I.O. and also to the Court<br \/>\nat the time of execution of the bond and shall not change their<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[h].\tmaintain law<br \/>\nand order.\n<\/p>\n<p>\tIf breach of any<br \/>\nof the above conditions is committed, the Sessions Judge concerned<br \/>\nwill be free to issue warrant or to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail bond to be<br \/>\nexecuted before the lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tAt the trial, the<br \/>\ntrial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p>\tRule is made<br \/>\nabsolute to the aforesaid extent.\n<\/p>\n<p>\tDirect Service is<br \/>\npermitted.\n<\/p>\n<pre>mathew\t\t\t\t\t\t[H.B.ANTANI,\nJ.]\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Appearance : vs Mr Kt Dave on 7 July, 2008 Bench: H.B.Antani CR.MA\/8470\/2008 4\/ 4 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD CRIMINAL MISC.APPLICATION No. 8470 of 2008 ========================================================= RANCHHODBHAI CHHELABHAI BHARVAD &amp; OTHERS Versus STATE OF GUJARAT ========================================================= Appearance : MR MEHUL SHARAD SHAH for Applicants.
