DORESWAMY\n\nDATE OF JUDGMENT21\/07\/1994\n\nBENCH:\nKULDIP SINGH (J)\nBENCH:\nKULDIP SINGH (J)\nPUNCHHI, M.M.\nRAMASWAMY, K.\n\nCITATION:\n 1994 SCC  (5) 367\t  JT 1994 (4)\t505\n 1994 SCALE  (3)450\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>The Judgment of the Court was delivered by<br \/>\nKULDIP\tSINGH,\tJ.-  The  Karnataka  State  Road   Transport<br \/>\nCorporation (the Corporation) held selections for the  posts<br \/>\nof Assistant Stores\/Purchase Officers in the year 1972.\t The<br \/>\nfirst  four  candidates selected in order of merit  were  as<br \/>\nunder:\n<\/p>\n<blockquote><p>\t      1.    Shri A.M. Khan<\/p>\n<blockquote><p>\t      2.    Shri S.S. Shirol\n<\/p><\/blockquote>\n<blockquote><p>\t\t      3. Shri K.G. Doddamani\n<\/p><\/blockquote>\n<blockquote><p>\t      4.    Shri B.K. Doreswamy\n<\/p><\/blockquote>\n<p>2.   The  reservation for Scheduled Castes\/Scheduled  Tribes<br \/>\nand  other  backward classes was regulated in the  State  of<br \/>\nKarnataka  by  the Government Instructions  dated  6-9-1969.<br \/>\nAnnexure-I to the said Instructions provides  classification<br \/>\nand  rotation  of vacancies  for  open\tcompetition\/backward<br \/>\nclasses\/Scheduled Castes  and  Scheduled  Tribes  in   the<br \/>\nfollowing manner:\n<\/p>\n<blockquote><p>\t      1.    Scheduled Tribes\n<\/p><\/blockquote>\n<blockquote><p>\t      2.    Scheduled Castes\n<\/p><\/blockquote>\n<blockquote><p>\t      3.    Backward Classes\n<\/p><\/blockquote>\n<blockquote><p>\t      4.    Open competition<br \/>\n+    From  the\tJudgment and Order dated  17-6-1986  of\t the<br \/>\nKarnataka High Court in W.A. No. 1922 of 1983<br \/>\n<span class=\"hidden_text\">368<\/span><br \/>\nPara 6 of the Instructions is as under :\n<\/p><\/blockquote>\n<blockquote><p>\t      &#8220;When a person belonging to Scheduled  Tribes,<br \/>\n\t      the Scheduled Castes or other backward classes<br \/>\n\t      is  not  available for being  selected  for  a<br \/>\n\t      vacancy reserved for such class, such  vacancy<br \/>\n\t      shall  be filled by selection on the basis  of<br \/>\n\t      general merit.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t      3.    The\t  above\t mentioned   four   selected<br \/>\n\t      candidates   were\t  appointed   as   Assistant<br \/>\n\t      Stores\/Purchase  Officers by the\torder  dated<br \/>\n\t      19-11-1972.   The\t appointments  were  in\t the<br \/>\n\t      following order:\n<\/p><\/blockquote>\n<blockquote><p>\t      A.M. Khan (General Category)<br \/>\n\t      B.K. Doreswamy (Scheduled Caste)<br \/>\n\t      S.S. Shirol<br \/>\n\t      K.G. Doddamani\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>4.   Since  no\tScheduled Tribe candidate was  selected\t the<br \/>\nfirst  vacancy which was meant for the Scheduled Tribes\t was<br \/>\ngiven to A.M. Khan, general category candidate, who was even<br \/>\notherwise on the top of the merit list.\n<\/p><\/blockquote>\n<p> 5.  B.K.  Doreswamy  filed  a\twrit,  petition\t before\t the<br \/>\nKarnataka  High\t Court\tseeking\t a  mandamus  directing\t the<br \/>\nCorporation to treat him senior to A.M. Khan in the cadre of<br \/>\nAssistant Stores\/Purchase Officers on the ground that  since<br \/>\nthe  Scheduled Tribe candidate was not available he being  a<br \/>\nmember\tof  the Scheduled Caste was entitled  to  the  first<br \/>\nvacancy.  The writ petition was allowed by a learned  Single<br \/>\nJudge  of  the\tHigh  Court.   Writ  appeal  filed  by\t the<br \/>\nCorporation was dismissed by the Division Bench of the\tHigh<br \/>\nCourt.\t This  appeal  by the  Corporation  is\tagainst\t the<br \/>\njudgments of the High Court.\n<\/p>\n<p> 6. We are of the view that the High Court fell into  patent<br \/>\nerror in interpreting the Government Instructions dated 6-9-<br \/>\n1969.  It is no doubt correct that out of the merit list the<br \/>\nfirst  vacancy\twas to be filled by appointing\ta  Scheduled<br \/>\nTribe  candidate.  Since the Scheduled Tribe  candidate\t was<br \/>\nnot  available\tthe vacancy was to be filled  in  accordance<br \/>\nwith   the   provisions\t of  para  6   of   the\t  Government<br \/>\nInstructions.  Under the said paragraph, quoted above,\twhen<br \/>\na  person belonging to Scheduled Tribe is not available\t for<br \/>\nbeing  selected\t against the vacancy reserved for  the\tsaid<br \/>\nclass,\tsuch  vacancy has to be filled by selection  on\t the<br \/>\nbasis  of  general  merit.  Since in the  present  case\t the<br \/>\nScheduled  Tribe  candidate  was not  available,  the  first<br \/>\nvacancy\t was rightly filled by appointing A.M. Khan who\t was<br \/>\nat number one of the merit list.  It is nowhere provided  in<br \/>\nthe Instructions of the Government of Karnataka that when  a<br \/>\nperson\tbelonging to a reserve class is not  available\tthen<br \/>\nthe  vacancy  is  to be filled by  a  candidate\t of  another<br \/>\nreserve\t  class.   On  the  other  hand\t  the\tInstructions<br \/>\nspecifically  provide that in the absence of  the  candidate<br \/>\nbelonging  to a reserved class the vacancy has to be  filled<br \/>\nby  selection on the basis of general merit.  The  order  of<br \/>\nappointment dated 19-11-1972 issued by the State  Government<br \/>\nwas  in conformity with the Government Instructions  and  no<br \/>\nfault  could be found with the same.  A.M. Khan having\tbeen<br \/>\nrightly appointed at number one in accordance with<br \/>\n<span class=\"hidden_text\">369<\/span><br \/>\nthe  Government\t Instructions he would rank senior  to\tB.K.<br \/>\nDoreswamy   in\tthe  cadre  of\t Assistant   Stores\/Purchase<br \/>\nOfficers.\n<\/p>\n<p>7.   For  the reasons recorded above, we allow\tthe  appeal,<br \/>\nset aside the order of the learned Single Judge dated 26-11-<br \/>\n1982  and of the Division Bench dated 17-6-1986 and  dismiss<br \/>\nthe  writ petition filed by B.K.
