No. 20186\/2010: M\/S<br \/>\n                                      Pankaj Kumar Sinha, with Kamal<br \/>\n                                       Kishore Jha, Advocates.\n<\/p>\n<p>                  For the State:k Mr. Akbar Ali, A.P.P.<\/p>\n<p>                  For the petitioner in Cr.Misc.No. 20252\/2010: M\/S Ambika<br \/>\n                  Bhagat with Kamal Kishore Singh, Advocates.<\/p>\n<p>                                      &#8212;\n<\/p>\n<p>2\/   15.06.2010             Heard the parties.\n<\/p>\n<p>                            In a criminal prosecution for offences under<\/p>\n<p>                  sections 307, 436, 353 and other allied offences of the<\/p>\n<p>                  Indian Penal Code, the petitioners of both the cases are<\/p>\n<p>                  named in the F.I.R. as accused. According to the<\/p>\n<p>                  prosecution case some persons had collected certain bricks<\/p>\n<p>                  for the purpose of constructing a religious structure on a<\/p>\n<p>                  public land. When the police party were getting the bricks<\/p>\n<p>                  removed from there with the help of labourers, then it was<\/p>\n<p>                  found that some of the accused have put up an the idol of<\/p>\n<p>                  Lord Hanumanjee on that place. While idol of Lord<\/p>\n<p>                  Hanumanjee was being removed with full dignity and<br \/>\n<span class=\"hidden_text\">                      -2-<\/span><\/p>\n<p>honour, large number of persons are said to have<\/p>\n<p>assembled there and started pelting stones, as a result of<\/p>\n<p>which some persons sustained injuries.<\/p>\n<p>           It is submitted by learned counsel appearing on<\/p>\n<p>behalf of the petitioners that allegations are general in<\/p>\n<p>nature against all the F.I.R. named accused persons,<\/p>\n<p>including the petitioners as also unknown accused persons<\/p>\n<p>and at best they can be said to be the members of the mob.<\/p>\n<p>It is further submitted that co-accused Sadhu Choudhary<\/p>\n<p>@ Indradeo Choudhary and co-accused Rajesh Kumar with<\/p>\n<p>almost similar and identical allegation with that of the<\/p>\n<p>petitioners have been granted bail by a common order<\/p>\n<p>dated 30.04.2010 passed in Cr. Misc. No. 11569 and<\/p>\n<p>12482, both of 2010 by a Bench of this Court.<\/p>\n<p>           In the aforesaid facts and circumstances let the<\/p>\n<p>above named petitioners of both cases be enlarged on bail<\/p>\n<p>on furnishing bail bonds of Rs. 10,000\/- each with two<\/p>\n<p>sureties of the like amount each to the satisfaction of Chief<\/p>\n<p>Judicial   Magistrate,     Sheikhpura    in   connection    with<\/p>\n<p>Sheikhpura P.S. Case No. 66 of 2010 subject to the<\/p>\n<p>conditions that:\n<\/p>\n<p> (A)               one of the bailors must be government<\/p>\n<p>                   servant or close family members of the<\/p>\n<p>                   petitioners, who will file an affidavit in the<\/p>\n<p>                   court below showing his\/her relationship<br \/>\n<span class=\"hidden_text\">                    -3-<\/span><\/p>\n<p>                 with the petitioners,<\/p>\n<p>           (B)   if the petitioners are found involved in<\/p>\n<p>                 same and similar nature of cases in<\/p>\n<p>                 future, then in that case the informant\/<\/p>\n<p>                 prosecution shall be at liberty to file a<\/p>\n<p>                 petition for cancellation of the bail of the<\/p>\n<p>                 petitioners, and if such a petition is filed,<\/p>\n<p>                 the court below would be obliged to<\/p>\n<p>                 dispose of the same in accordance with<\/p>\n<p>                 law after giving opportunity of hearing to<\/p>\n<p>                 all concerned and<\/p>\n<p>           (C)   the petitioners shall make regular pairvi in<\/p>\n<p>                 the court below in the present case either<\/p>\n<p>                 by appearing themselves in person or<\/p>\n<p>                 through representation by his lawyer on<\/p>\n<p>                 each and every dates, and if on two<\/p>\n<p>                 consecutive dates petitioners fail to make<\/p>\n<p>                 pairvi, then the court below shall be at<\/p>\n<p>                 liberty to cancel the bail bonds of the<\/p>\n<p>                 petitioners.\n<\/p>\n<\/p>\n<p>                         ( Birendra Prasad Verma, J )<\/p>\n<p>BTiwary\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ram Sagar Yadav &amp;Amp; Ors vs State Of Bihar on 15 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
