SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/09\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Shri R.C.Kodekar,learned Additional Public Prosecutor,waives service<br \/>\nof notice of rule on behalf of respondent-State.\n<\/p>\n<p>2.\tPresent<br \/>\napplication is filed by the applicants original accused Nos.1,5 and 6<br \/>\nunder Sections 439 of the Code of Criminal Procedure for releasing<br \/>\nthem on bail in connection with complaint being C.R.No.I-180 of 2008<br \/>\nregistered with Adalaj Police Station for the offences punishable<br \/>\nunder Sections 147,148,149 and 302 of the Indian Penal Code and under<br \/>\nSection 135 of the Bombay Police Act.\n<\/p>\n<p>3.\tShri<br \/>\nY.S.Lakhani, learned senior advocate appearing for the applicants,<br \/>\nhas submitted that cross complaints have been filed and in fact<br \/>\npersons of the complainant side attacked first and one person on the<br \/>\nside of the applicants side died for which cross complaints came to<br \/>\nbe filed on side of the applicants prior in time and thereafter, the<br \/>\npresent complaint has been filed. It is  submitted that considering<br \/>\nthe cause of death and the role attributed to the applicants and that<br \/>\nnow the chargesheet is already filed and the investigation has been<br \/>\nconcluded, there is no possibility to hamper or tamper with the<br \/>\nevidence on record. Therefore, it is requested to release the<br \/>\napplicants on bail.\n<\/p>\n<p>4.\tShri<br \/>\nR.C.Kodekar, learned Additional Public Prosecutor appearing on behalf<br \/>\nof respondent-State, while opposing the present application, has<br \/>\nsubmitted that considering the role attributed to the applicants that<br \/>\nthey have also beaten the other persons including Sajanbhai, who has<br \/>\ndied, they may not be released on bail.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned advocate for the respective parties and considering<br \/>\nthe police papers and the role attributed to the applicants and the<br \/>\novert act alleged against the applicants and the cause of death of<br \/>\nSajanbhai and that it is a case of cross complaints and the first<br \/>\ncomplaint was filed on behalf of applicants&#8217; side prior in time and<br \/>\nas the investigation is already concluded and the chargesheet is<br \/>\nalready filed, there is no possibility  of hampering or tampering<br \/>\nwith the evidence on record. Therefore, application submitted by the<br \/>\napplicants for releasing them on bail deserves to be considered.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe submissions made on behalf of the parties and having regard to<br \/>\nthe circumstances and facts of the case, the application is allowed<br \/>\nand the applicants are ordered to be released on bail in connection<br \/>\nwith C.R.No.I-180 of 2008<br \/>\nregistered with Adalaj Police Station on their<br \/>\nexecuting a bond of Rs.5,000\/- (Rupees Five Thousand only) each with<br \/>\none  surety of the like amount to the satisfaction of the lower Court<br \/>\nand subject to the conditions that they shall ;\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty:\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution:\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>(d)\tmark<br \/>\ntheir presence before concerned Police Station on 2nd Sunday of every<br \/>\nEnglish calendar month between 9.00 a.m. and 2.00 p.m.  for a period<br \/>\nof 12 months.\n<\/p>\n<p>(e)\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of their residence at the time of execution of the bond<br \/>\nand shall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>(g)\tsurrender<br \/>\ntheir  passport, if any, to the lower Court within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
