VENKATASWAMI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t       THE 1ST DAY OF SEPTEMBER, 1997<br \/>\nPresent:\n<\/p>\n<p>\t\tHon&#8217;ble Dr.Justice A.S.Anand<br \/>\n\t\tHon&#8217;ble Dr.Justice K.Venkataswami<br \/>\nMs.Madhu Tewatia,  Adv.\t for  Ranbir  Yadav,  Adv.  for\t the<br \/>\nappellant<br \/>\nKeshav Dayal,  Sr.Adv., R.K.Sainai,  Rishi Kesh,  Advs. with<br \/>\nhim for the Respondents.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\n     The following Order of the Court was delivered:<br \/>\n\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     The High  Court, after  hearing arguments in Civil Writ<br \/>\nPetition filed\tby the respondents held that since the Award<br \/>\nhad not\t been made  within  the\t period\t stipulated  by\t the<br \/>\nstatute\t  (Section   11A),   the   notification\t  concerning<br \/>\nacquisition of Khasra Nos. 127 and 173 had to be declared to<br \/>\nbe of  no effect  and after  making that order, released the<br \/>\ntwo Khasra  numbers from  the acquisition notifications vide<br \/>\norder dated  22.8.1996. This  appeal  calls  that  order  in<br \/>\nquestion.\n<\/p>\n<p>     The attention  of the  High Court had been drown to the<br \/>\nstay order  dated 25.4.1985,  whereby during the pendency of<br \/>\nthe Writ  Petition, the dispossession of the petitioners had<br \/>\nbeen stayed   by  the High  Court to  urge that\t the  period<br \/>\nduring which  the stay\torder was  in operation\t had  to  be<br \/>\nexcluded for  computing the  prescribed period under Section<br \/>\n11A of\tthe Act.  According to\tthe High Court , however the<br \/>\norder  dated   25.4.1985  concerned   only   the   stay\t  of<br \/>\ndispossession of  the writ  petitioners and it could not, in<br \/>\nany way\t be  interpreted  to  imply  stay    of\t acquisition<br \/>\nproceedings. The  approach of  the High\t Court is erroneous.<br \/>\nThis question  is no  longer res-integra.  <a href=\"\/doc\/656813\/\">In Government  of<br \/>\nTamil Nadu  &amp; Anr. vs. Vasantha Bai<\/a> ( 1995 (Supp.) 2 SCC 423<br \/>\n), a Bench of this Court has held that the stay order of the<br \/>\ntype that  was granted\tin the\tinstant case, tantamounts to<br \/>\nstay of\t further proceedings  being taken  and therefore the<br \/>\nentire period  during which  the stay order was in operation<br \/>\nwas to\tbe excluded  while computing the period of two years<br \/>\nprescribed for\tmaking an  Award under\tSection 11A the Act.<br \/>\nThe view  taken\t by  the  High\tCourt,\tis,  therefore,\t not<br \/>\nsustainable.\n<\/p>\n<p>     We, however,  find that  the High\tCourt has  not dealt<br \/>\nwith the  merits  of  the  writ\t petition  and\tquashed\t the<br \/>\nnotification on\t an erroneous  interpretation  of  the\tstay<br \/>\norder.\tWe,  therefore,\t while\taccepting  this\t appeal\t and<br \/>\nsetting aside  the order  of the High Court, remand the Writ<br \/>\nPetition to  the  High\tCourt  for  its\t fresh\tdisposal  in<br \/>\naccordance with\t law on\t the other points raised in the writ<br \/>\npetition. It  shall be open to the parties to raise all such<br \/>\npleas, as  are available  to them,  including the subsequent<br \/>\nevents during  the arguments  in the  High Court. We request<br \/>\nthe High  Court. We request the High Court to dispose of the<br \/>\nwrit  petition\t expeditiously\tand   not  to  construe\t any<br \/>\nobservation made  by us\t in this  order as  an expression of<br \/>\nopinion on the merits of the case.
