Justice V.K.MOHANAN\n\n Dated :04\/11\/2010\n\n O R D E R\n                     V.K.MOHANAN, J.\n            ---------------------------------------------\n                 Crl.R.P.No. 3243 of 2010\n            ---------------------------------------------\n          Dated this the 4th day of November, 2010\n\n                           O R D E R\n<\/pre>\n<p>            Aggrieved by the order of conviction and<\/p>\n<p>sentence imposed against the revision petitioner\/accused<\/p>\n<p>under Section 138 of the N.I.Act, this revision petition is<\/p>\n<p>preferred.\n<\/p>\n<p>     2.   Counsel for the revision petitioner submitted that<\/p>\n<p>the petitioner has no contention on merit, but he requires<\/p>\n<p>some time to pay the compensation amount. It is also the<\/p>\n<p>submission of the learned counsel that since the revision<\/p>\n<p>petitioner, being a school teacher and working in a<\/p>\n<p>Government School, the substantive sentence imposed<\/p>\n<p>against him may be set aside and the petitioner is ready to<\/p>\n<p>compensate the complainant, but he requires some time for<\/p>\n<p>the same.\n<\/p>\n<p>     3.   Having regard to the facts and circumstances of<\/p>\n<p>the case, I am of the view that the said submission requires<\/p>\n<p>serious consideration.     The Honourable Apex Court in the<\/p>\n<p>decision   reported     in   <a href=\"\/doc\/1594211\/\">Damodar.S.Prabhu v.          Sayed<\/p>\n<p>Crl.R.PNO.<\/a> 3243 of 2010<\/p>\n<p>                              :-2-:\n<\/p>\n<p>Babalal.H. [JT 2010(4) SC 457] has held that in the case of<\/p>\n<p>dishonour of cheques, the compensatory aspect of the<\/p>\n<p>remedy should be given priority over the punitive aspects.<\/p>\n<p>It is also relevant to note that the cheque in question is<\/p>\n<p>dated 29.9.2006 and as per the findings of the courts below,<\/p>\n<p>the amount covered by the cheque in question belongs to<\/p>\n<p>the complainant.       Therefore, I am of the view that the<\/p>\n<p>sentence ordered by the revision petitioner requires some<\/p>\n<p>modification and while granting breathing time to deposit<\/p>\n<p>the amount, the amount can be enhanced slightly.<\/p>\n<p>         In the result, this Criminal Revision Petition is<\/p>\n<p>disposed of confirming the conviction of the revision<\/p>\n<p>petitioner under Section 138 of the N.I.Act as recorded by<\/p>\n<p>the courts below.       Accordingly, in modification of the<\/p>\n<p>sentence ordered by the court below and in suppression of<\/p>\n<p>the substantive sentence, the sentence is confined to fine<\/p>\n<p>only. Accordingly, the revision petitioner is sentenced to pay<\/p>\n<p>a fine of Rs.2,25,000\/- (Rupees Two Lakhs Twenty Five<\/p>\n<p>Thousand only) and the revision petitioner is further<\/p>\n<p>directed to deposit the said amount within 45 days from<\/p>\n<p>Crl.R.PNO. 3243 of 2010<\/p>\n<p>                             :-3-:\n<\/p>\n<p>today. In case of any default in depositing the fine amount,<\/p>\n<p>within the above time limit, the revision petitioner is<\/p>\n<p>directed to undergo simple imprisonment for two months.<\/p>\n<p>Accordingly, the revision petitioner\/accused is directed to<\/p>\n<p>deposit the fine amount of Rs.2,25,000\/- on or before<\/p>\n<p>17.12.2010. On realisation of the fine amount, an amount<\/p>\n<p>of Rs.2,20,000\/- shall be paid to the complainant as<\/p>\n<p>compensation under Section 357(1)(b) of the Cr.P.C. and<\/p>\n<p>the balance shall be paid to the State Exchequer. In case of<\/p>\n<p>any failure on the part of the revision petitioner in making<\/p>\n<p>the deposit of fine amount on or before the above date, the<\/p>\n<p>trial court is free to take coercive steps to secure the<\/p>\n<p>presence of the revision petitioner and to execute the<\/p>\n<p>sentence. OF 200<\/span>\n<\/p>\n<blockquote><p>                                 &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p><\/blockquote>\n<blockquote><p>                                       J U D G M E N T<\/p>\n<p>                                       DATED: -2-2010<\/p>\n<p>Crl.R.PNO. 3243 of 2010<\/p>\n<p>                              :-6-:\n<\/p><\/blockquote>\n<p> Accordingly, this Criminal Revision Petition is disposed of<\/p>\n<p>confirming the conviction of the revision petitioner under<\/p>\n<p>Section 138 of the N.I.Act as recorded by the courts below.<\/p>\n<p>Accordingly, the sentence of imprisonment now ordered by<\/p>\n<p>the    lower      appellate court  is confirmed    and  the<\/p>\n<p>compensation amount is enhanced to Rs.,000\/- which shall<\/p>\n<p>be paid by the revision petitioner within three months from<\/p>\n<p>today and in case of any default in paying the amount, the<\/p>\n<p>revision     petitioner   is directed to   undergo   simple<\/p>\n<p>imprisonment for three months and on realisation of the<\/p>\n<p>compensation amount, the entire amount shall be paid to<\/p>\n<p>the complainant under Section 357(3) of the Cr.P.C.<\/p>\n<p>Crl.R.PNO. 3243 of 2010<\/p>\n<p>                            :-7-:\n<\/p>\n<p>Accordingly, the revision petitioner\/accused is directed to<\/p>\n<p>appear before the trial court on .11.2010 to receive the<\/p>\n<p>sentence and to deposit the compensation amount.
