Petitioners have filed this petition seeking
\nquashing of FIR no. 189\/2008 registered at
\nPolice Station Poonch, under Section 304 R.P.C
\non the grounds that the allegations made in the
\nFIR were incorrect, and the registration of case
\nby the police, on the basis of an order passed by
\n                         2<\/span>
\nJudicial Magistrate First Class, under Section
\n156 (3) Cr.P.C on the complainant’s application,
\nwithout holding any enquiry thereto, was un-
\nwarranted.\n<\/p>\n
    Referring    to  the    photocopies  of   the
\ndocuments    placed   on   the  records,  learned
\ncounsel appearing for the petitioners submitted
\nthat there being no proof on the records that it
\nwas Dalip Kour, who         died because of the
\ninjuries sustained by her in the alleged quarrel,
\nthe investigation into the FIR       needs to be
\nquashed.\n<\/p>\n
    Learned counsel referred to one of the
\ndocuments, placed on the records, indicating
\nthat the person who had died on 16.8.2008
\nbecause of Broncho pneumonia, Septicemia and
\nazotaemia was not, in fact, Dalip Kour, who had
\nlodged the initial complaint with the Police, but
\nwas one    Amrit Kour, wife of Jaswant Singh,
\n                          3<\/span>
\nand, in this view of the matter, investigation into
\nthe FIR would result in abuse of the process of
\nlaw.\n<\/p>\n
     Lastly learned counsel submitted that in
\nview of the facts of the case, no offence under
\nSection 304 R.P.C can be said to have been
\ncommitted by the petitioners; the FIR and
\ninvestigation, therefore, need to be quashed.\n<\/p>\n
     I  have   considered    the  submissions    of
\nlearned counsel for the petitioners as also the
\nState counsel and the learned counsel who had
\nput in appearance on behalf of respondent no.6,
\nthe husband of deceased Dalip Kour.\n<\/p>\n
     Perusal of the FIR reveals that Dalip Kour
\nherself had approached the concerned Police
\nPost on July 24, 2008, in an injured condition,
\nsaying that, on being told not to dump clay in
\nher Courtyard, the petitioners had initially
\nabused her and later severely beat her. It was
\n                         4<\/span>
\nbecause of the intervention of the neighbours
\nthat she was saved from the clutches of the
\npetitioners, otherwise she would have been done
\naway with by the petitioners. The petitioners,
\nwhile having, had threatened to kill her and her
\nfamily members. Her report was registered as
\nReport No. 10 in the Daily Diary Register at 9.30
\na.m.\n<\/p>\n
     It appears that dissatisfied with the inaction
\nof the police in not proceeding further on the
\nreport, the Chief Judicial Magistrate Poonch, too,
\nwas approached, who referred the case to the
\nPolice under Section 156 (3) Cr.P.C.\n<\/p>\n
       It was indicated in the complaint made to
\nthe learned Magistrate that the petitioners had
\ncaused internal and external injuries to Dalip
\nKour and blood had oozed from her mouth
\nbecause of the injuries. Finding Dalip Kour
\nunstable in the Government Hospital Poonch,
\n                           5<\/span>
\nshe was referred to the Medical College Hospital,
\nJammu, on 13th of August, 2008. Keeping in
\nview the condition of the injured, blood too had
\nto be transfused in the hospital, where she
\nhowever, died on 16.08.2008.\n<\/p>\n
    Petitioners’ counsel’s submission that the
\nFIR was based on incorrect facts, is found to be
\nwithout merit, in view of the report lodged by the
\ndeceased    herself   with   the   police  post  on
\n24.07.2008 indicating that she had been beaten
\nby the petitioners. The facts indicated in the
\nreport of the deceased gets support from the
\nsubsequent events of her having been admitted
\nwith injuries initially in District Hospital Poonch
\nand    thereafter  in   the  Government      Medical
\nCollege Hospital, Jammu, where she ultimately
\ndied.\n<\/p>\n
    The other plea of the petitioners’ counsel
\nthat it was Amrit Kour and not Dalip Kour, who
\n                           6<\/span>
\nhad died, too, is found to be without any
\nsubstance, in that, one of the documents placed
\non the records by the petitioners specifically
\nindicates Dalip Kour, wife of Jaswant Singh, to
\nhave been admitted in District Hospital Poonch
\nwith injuries over her both forearms and at the
\nhead of the ring finger, and in this view of the
\nmatter, it cannot be said that Dalip Kour had not
\ndied, when the FIR specifically indicates her to
\nhave been injured, admitted initially in District
\nHospital Poonch and thereafter in Government
\nMedical College Hospital Jammu, where she had
\ndied.\n<\/p>\n
    That apart, mere incorrect mention of the
\nname of the deceased in one of the documents,
\nwould not, of itself, affect the veracity of the facts
\nstated in the FIR, which eloquently indicates
\nDalip Kour to have been injured and later died in
\n                          7<\/span>
\nGovernment Medical College Hospital Jammu on
\nAugust 16, 2008.\n<\/p>\n
     All the pleas raised by the petitioners’
\ncounsel, disputing the facts appearing in the
\nFIR,   are   such,  which   are  required   to  be
\nconsidered initially by the investigating agency
\nand later by the Court, in case the investigating
\nagency finds the petitioners to have committed
\none or the other offence.\n<\/p>\n
     Petitioners’ plea that   no offence     under
\nSection 304 RPC can be said to have been
\ncommitted by them, on the basis of the facts
\nappearing in the FIR, cannot be examined by
\nthis Court at this stage in the absence of
\nrequisite records. Even otherwise, it is the Court
\nseized of the case which has to first examine this
\nquestion and, in this view of the matter, the
\npetitioners’ plea needs to be rejected at this
\nstage.\n<\/p>\n
                          8<\/span><\/p>\n
        For all what has been said above I do not
\nfind any merit in this petition, which is,
\naccordingly, dismissed.\n<\/p>\n
