No.23075 of 2011\n                           Mohan Manjhi, son of Late Ganori Manjhi\n                                            Versus\n                                    The State Of Bihar\n                                          -----------\n<\/pre>\n<p>2.   29.7.2011                  Heard learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                                The petitioner seeks bail in a case instituted for<\/p>\n<p>                 the offence under Section 47(a) of the Excise Act.<\/p>\n<p>                              Considering that the petitioner is in custody since<\/p>\n<p>                 2.12.2010 and he is first offender, let the petitioner above<\/p>\n<p>                 named, be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                 5,000\/- (Five thousand) with two sureties of the like amount<\/p>\n<p>                 each or any other surety to be fixed by the court concerned to<\/p>\n<p>                 the satisfaction of Chief Judicial Magistrate, Munger, in<\/p>\n<p>                 connection with Case No. 273C of 2010 subject to the following<\/p>\n<p>                 conditions: (i) That one of the bailors will be a close relative of<\/p>\n<p>                 the petitioner, who will give an affidavit giving genealogy as to<\/p>\n<p>                 how he is related with the petitioner. The bailor will undertake to<\/p>\n<p>                 furnish information to the court about any change in the address<\/p>\n<p>                 of the petitioner. (ii) That the affidavit shall clearly state that the<\/p>\n<p>                 petitioner is not an accused in any other case and, if he is, he<\/p>\n<p>                 shall not be released on bail. (iii) That the bailor shall also state<\/p>\n<p>                 on affidavit that he will inform the court concerned if the<\/p>\n<p>                 petitioner is implicated in any other case of similar nature after<\/p>\n<p>                 his release in the present case and thereafter the court below<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of bail<\/p>\n<p>        on the ground of misuse.
