Shri Haribhai Khimabhai Kavatra (which is wrongly typed<br \/>\nas Karotra) and the Director of Kachchh District Shri Haribhai<br \/>\nNanjibhai Patel.\n<\/p>\n<p>2.\tHeard<br \/>\nMr. Dagli, learned counsel for the petitioner, Ms. Lilu K. Bhaya,<br \/>\nlearned counsel for the respondents Nos. 1 and 2 and Mr.<br \/>\nS.P.Majmudar, learned counsel for the respondent No.3 viz. Shri<br \/>\nHaribhai Khimabhai Kavatra (which is wrongly<br \/>\ntyped as Karotra).\n<\/p>\n<p>3.\tUpon<br \/>\nhearing the learned counsels appearing on both the sides, it appears<br \/>\nthat the grievance on the part of the petitioner was that the Branch<br \/>\nManager of the Bank was compelling the loanee to purchase the<br \/>\ntractors from the agency which was owned by the relatives of the<br \/>\nBranch Manager. It has also been alleged by the petitioner that the<br \/>\nson of the Director Shri Haribhai Nanjibhai Patel was also holding<br \/>\nthe agency and same situation continued against the Director if<br \/>\nanybody was desirous to take loan from the Bank. The petitioner also<br \/>\npreferred Special Civil Application before this Court being Special<br \/>\nCivil Application No.19887 of 2007 and this Court (Coram : Hon&#8217;ble<br \/>\nMr. Justice Akshay H. Mehta, J) vide order dated 18.09.2007 had<br \/>\ndirected the bank to take action. Since no action was taken, the<br \/>\npresent petition.\n<\/p>\n<p>4.\tIt<br \/>\nalso appears from the affidavit in reply filed on behalf of the<br \/>\nrespondent bank as well as the subsequent development which has<br \/>\nhappened thereafter, as per the submissions made at the Bar, that the<br \/>\nrespondents Nos.1 and 2 bank has initiated departmental action<br \/>\nagainst the respondent No.3 in capacity as the Branch Manager of the<br \/>\nbank and such departmental proceedings are pending. However, the<br \/>\nrespondent No.3, as per the police investigation, was alleged to have<br \/>\nbeen found involved in the murder of the father of the petitioner, in<br \/>\nconnection of which the criminal case is pending and he was arrested<br \/>\nand he is in custody. On account of the same the respondent No.1 bank<br \/>\nhas placed respondent No.3 under suspension. Under these<br \/>\ncircumstances, the bank, as such, has already initiated the action of<br \/>\ndepartmental inquiry as well as of suspension. It appears that the<br \/>\nsuspension and arrest of the respondent No.3 is on account of the<br \/>\ncriminal proceedings, and therefore, such may continue until the<br \/>\ncriminal proceedings are terminated or prior thereto the departmental<br \/>\ninquiry is concluded and the decision of same is against the<br \/>\nrespondent No.3. In any case it will be required for the respondent<br \/>\nNo.1 to conclude the departmental inquiry in respect to the<br \/>\nallegations made for misusing the position as the Branch Manager. Ms.<br \/>\nLilu Bhaya, learned counsel appearing for the respondent No.1 bank<br \/>\nsubmitted that the inquiry is likely to take reasonable time, more<br \/>\nparticularly when the respondent No.3 is already in jail. Under these<br \/>\ncircumstances, the respondent No.1 shall conclude the proceedings of<br \/>\nthe departmental inquiry as early as possible preferably within the<br \/>\nperiod of 6 months from the receipt of the order of this Court unless<br \/>\nthe availability of the respondent No.3 is not possible on account of<br \/>\nhe being in the jail.\n<\/p>\n<p>5.\tSo<br \/>\nfar as the action against the Director Shri Haribhai Nanjibhai Patel<br \/>\nis concerned, as per the affidavit in reply filed on behalf of the<br \/>\nbank, nothing has been found against Shri Haribhai Nanjibhai Patel.<br \/>\nThe petitioner has not even joined said Shri Haribhai Nanjibhai Patel<br \/>\nas party in the proceedings. No authenticated document is produced on<br \/>\nrecord to show the relationship of Bharatbhai Haribhai Patel with<br \/>\nHaribhai Nanjibhai Patel and also to show that whether the Director<br \/>\nHaribhai Nanjibhai Patel has played any role in getting the purchase<br \/>\nof the Tractors by the loanee or not. Therefore, if the petitioner<br \/>\nhas any authenticated material for such purpose, the petitioner may<br \/>\nmove to the respondent No.1 bank by production of the documentary<br \/>\nevidence showing the involvement of Haribhai Nanjibhai Pate for the<br \/>\ndisqualification, if any, is to be considered as per the bye laws of<br \/>\nthe bank. If such an application is made, the bank shall examine the<br \/>\nsame after giving opportunity of hearing to the Haribhai Nanjibhai<br \/>\nPatel, who is the Director of the bank and shall take proper decision<br \/>\npreferably within a period of 3 months from preferring of any such<br \/>\napplication by the petitioner.\n<\/p>\n<p>6.\tIn<br \/>\nview of the aforesaid, no further order deserves to be passed.
