P.C. in<br \/>\nconnection with CR No. I-117 of<br \/>\n2011 registered with Kalavad Police Station, Jamnagar for the<br \/>\noffences punishable under Sections-464, 465, 467, 468, 474, 416, 417,<br \/>\n418, 419, 420 and 120-B of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate appearing for applicants has contended that this is a case<br \/>\nof documentary evidence.  He has contended that present applicants<br \/>\nhave filed criminal complaint before DSP, Jamnagar against the<br \/>\npersons who have executed the documents.  He has also contended that,<br \/>\nprima facie, the applicants have not played any role in the offences<br \/>\nalleged against them.\n<\/p>\n<p>3.\tLearned<br \/>\nAPP Mr. Jani has vehemently opposed this application.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned Counsel for the parties and perused the documents produced on<br \/>\nrecord in detail. From the record, it appears that present applicants<br \/>\nhave paid Rs.10 lacs, and possession of land is still with the<br \/>\ncomplainant.  I am, therefore, of the opinion that this is a fit case<br \/>\nto grant anticipatory bail.  Learned Counsel for the parties do not<br \/>\npress for reasoned order.\n<\/p>\n<p>5.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicants herein being arrested pursuant CR<br \/>\nNo. I-117 of 2011, registered with Kalavad Police<br \/>\nStation, Jamnagar, they shall be released on Bail on their furnishing<br \/>\na Bond of Rs.10,000\/- each (Rupees ten thousand only) with one surety<br \/>\nof like amount on condition that &#8211;\n<\/p>\n<p>a)\tthey<br \/>\nshall co-operate with the investigation and make themselves available<br \/>\nwhenever required;\n<\/p>\n<p>b)\tthey<br \/>\nshall remain present before the Investigating Officer, Kalavad Police<br \/>\nStation, Jamnagar, on 26th September,<br \/>\n2011 at 11.00 a.m. <\/p>\n<p>c)\tthey<br \/>\nshall not hamper the investigation in any manner nor shall directly<br \/>\nor indirectly make any inducement, threat or promise to any witness<br \/>\nso as to dissuade them for disclosing such facts to the Court or to<br \/>\nany Police Officer;\n<\/p>\n<p>d)\tAt<br \/>\nthe time of execution of Bond, they shall furnish their address to<br \/>\nthe I.O. and the Court concerned and shall not change the residence<br \/>\ntill the final disposal of the case or till further orders;\n<\/p>\n<p>e)\tthat<br \/>\nthey will not leave India without the permission of the Court and, if<br \/>\nare holding Passport, surrender the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>f)\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if considers it just and proper and the concerned Magistrate<br \/>\nwould decide it on merits;\n<\/p>\n<p>g)\tthis<br \/>\norder will be operative if the applicants are arrested at any time<br \/>\nwithin a period of 90 days;\n<\/p>\n<p>h)\twithin<br \/>\na period of ten days from the date of arrest, the applicants shall<br \/>\napply for regular bail which application shall be decided by the<br \/>\ncompetent Court in accordance with law without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>6.\tLearned<br \/>\nadvocate for the applicants assured that applicants will appear<br \/>\nbefore concerned police station as per direction of this Court.\n<\/p>\n<p>7.\tWith<br \/>\nthese directions, this Criminal Miscellaneous Application is disposed<br \/>\nof. Rule is made absolute.
