NO.2112 OF 2011\n             DILIP SADA @ DILIP SADA (MUKHIYA), SON OF BASUDEO\n             SADA, RESIDENT OF VILLAGE-DUMRA, POLICE STATION-\n             NAUHATTA, DISTRICT-SAHARSA.     .........PETITIONER.\n                                    VERSUS\n              THE STATE OF BIHAR             ...........OPPOSITE PARTY.\n                                            -----------\n<\/pre>\n<p>2   19.02.2011              Perused the record.<\/p>\n<p>                            The     petitioners         are    apprehending<\/p>\n<p>                 their   arrest      in    a   case     registered       under<\/p>\n<p>                 Section 25(1-B)A, 26, 35 of the Arms Act.<\/p>\n<p>                            There    was       allegation      of   assault<\/p>\n<p>                 against Naresh Kumar Verma on 14.11.2008 for<\/p>\n<p>                 which a substantive case was lodged against<\/p>\n<p>                 Naresh Kumar Verma and Ashok Kumar Verma. In<\/p>\n<p>                 the F.I.R. it was allged that from Naresh<\/p>\n<p>                 Kumar Verma villagers snatched the country<\/p>\n<p>                 made gun, but for the said occurrence, it is<\/p>\n<p>                 shocking     that     after      two    years,     on     the<\/p>\n<p>                 direction of the S.P., the present case has<\/p>\n<p>                 been lodged against the persons who snatched<\/p>\n<p>                 the gun from the assailant.\n<\/p>\n<p>                            The     pleading      of     the    petitioner<\/p>\n<p>                 appears to be convincing that in order to<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>     save the main accused this frivolous case<\/p>\n<p>     has     been     lodged.         Under       the    criminal<\/p>\n<p>     procedure       code    there    was    no   occasion    for<\/p>\n<p>     lodging     a    separate       case,    rather     if   the<\/p>\n<p>     materials came anybody could had been made<\/p>\n<p>     accused in the earlier case. Let the matter<\/p>\n<p>     be    verified     by    the    I.G.    of    the    Saharsa<\/p>\n<p>     range.\n<\/p>\n<p>               Considering the aforesaid facts, let<\/p>\n<p>     the petitioners above named be released on<\/p>\n<p>     anticipatory bail in the event of arrest or<\/p>\n<p>     surrender before the court below within a<\/p>\n<p>     period of 12 weeks from today, on furnishing<\/p>\n<p>     bail bonds of Rs.10,000\/-(ten thousand) with<\/p>\n<p>     two sureties of the like amount each to the<\/p>\n<p>     satisfaction of learned C.J.M., Saharsa in<\/p>\n<p>     connection with Nauhatta P.S.
