SANKARAN, J.\n                    ---------------------------\n                    B.A. No. 7795 of 2009\n               ------------------------------------\n            Dated this the 21st day of January, 2010\n\n                           O R D E R\n<\/pre>\n<p>    When the Bail Application came up for hearing on<\/p>\n<p>13\/01\/2010, the following order was passed:<\/p>\n<blockquote><p>          &#8220;This is an application for anticipatory bail under<\/p>\n<p>    Section 438 of the Code of Criminal Procedure. The<\/p>\n<p>    petitioner is the accused in Crime No.36 of 2009 of<\/p>\n<p>    Kumbla Excise Range, Kasaragod District. 2.          The<\/p>\n<p>    offence alleged against the petitioner is under Section<\/p>\n<p>    55(a) of the Abkari Act.\n<\/p><\/blockquote>\n<blockquote><p>          3. The prosecution case is that on 11.12.2009<\/p>\n<p>    at 6.10 PM, the petitioner was found in possession of<\/p>\n<p>    twenty bottles of Indian Made Foreign Liquor, each<\/p>\n<p>    bottle containing 180 ml., and five litres of arrack. It<\/p>\n<p>    is alleged that the petitioner was carrying the<\/p>\n<p>    contraband articles and he abandoned the articles and<\/p>\n<p>    left the place on seeing the Excise party. Therefore,<\/p>\n<p>    the petitioner could not be arrested.<\/p><\/blockquote>\n<p>          4.   The petitioner alleges that the case was<\/p>\n<p>    foisted against him.        He has sent a detailed<\/p>\n<p>    representation to the Honourable Minister of Excise<\/p>\n<p>    with copy to the Chief Minister of Kerala, Home<\/p>\n<p>    Minister and Excise Commissioner. Annexure I is the<\/p>\n<p>    petition.   The petition is not dated.      The learned<\/p>\n<p>B.A. No. 7795\/ 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>      counsel for the petitioner has produced the postal<\/p>\n<p>      receipts as Annexure 2 series. It is submitted that<\/p>\n<p>      Annexure 2 series relate to Annexure I representation.<\/p>\n<p>            5. In Annexure I representation, it is stated that<\/p>\n<p>      on 9.12.2009 at about 5.30 PM, while the petitioner<\/p>\n<p>      was driving a jeep, the jeep of the Excise party was<\/p>\n<p>      behind the jeep driven by the petitioner.           The<\/p>\n<p>      petitioner could not give side to the jeep of the Excise<\/p>\n<p>      party because of the condition of the road at the<\/p>\n<p>      relevant place. The jeep of the Excise party overtook<\/p>\n<p>      the vehicle driven by the petitioner and the petitioner<\/p>\n<p>      was threatened with dire consequences for not having<\/p>\n<p>      given side to the jeep. In Annexure I, it is also stated<\/p>\n<p>      that on 10.12.2009 and on 11.12.2009, some<\/p>\n<p>      persons, stating that they are the Excise people, had<\/p>\n<p>      come to the house of the petitioner. At that time the<\/p>\n<p>      petitioner was not in the house. They threatened the<\/p>\n<p>      mother of the petitioner.\n<\/p>\n<p>            6. The prosecution case is that the crime was<\/p>\n<p>      detected by the Circle Inspector of Excise and after<\/p>\n<p>      seizure, it was forwarded to the Excise Inspector,<\/p>\n<p>      Kumbla.\n<\/p>\n<pre>            7.     Taking into    account   the    facts  and\n\n      circumstances of the case,     I am of the view that\n\n<\/pre>\n<p>      before disposing of the Bail Application, an opportunity<\/p>\n<p>      should be given to the petitioner to appear before the<\/p>\n<p>B.A. No. 7795\/ 2009<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>      investigating officer.   Accordingly, there will be a<\/p>\n<p>      direction to the petitioner to appear before the<\/p>\n<p>      investigating officer at 9 AM on 16th and 17th January,<\/p>\n<p>      2010. The petitioner shall produce a copy of the order<\/p>\n<p>      before the investigating officer.\n<\/p>\n<p>            8. Post on 21st January, 2010.\n<\/p>\n<p>            It is submitted by the learned Public Prosecutor<\/p>\n<p>      that the petitioner will not be arrested until further<\/p>\n<p>      orders in connection with Crime No.36 of 2009 of<\/p>\n<p>      Kumbla Excise Range, Kasaragod District. &#8221;<\/p>\n<p>      2.     It is submitted by the learned counsel for the<\/p>\n<p>petitioner as well as the learned Public Prosecutor that the<\/p>\n<p>petitioner has complied with the direction contained in the order<\/p>\n<p>dated 13\/01\/2010.\n<\/p>\n<p>      3.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioner, the officer in charge of the police station shall release<\/p>\n<p>him on bail on his executing bond for Rs.15,000\/- with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>B.A. No. 7795\/ 2009<br \/>\n<span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>         A) The petitioner shall        report    before      the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on alternate Mondays, till the final report is filed<br \/>\n             or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The     petitioner   shall   appear    before     the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioner shall not try to influence the<br \/>\n             prosecution    witnesses   or  tamper     with   the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioner shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.<\/p><\/blockquote>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                    K.T.
