Justice P.R.RAMAN\n\n Dated :02\/01\/2007\n\n O R D E R\n                                 P.R.RAMAN, J.\n\n                          ```````````````````````````\n\n                       W.P.(C) NO. 22468 OF 2003\n\n                          ```````````````````````````\n\n               Dated this the 2nd day of January, 2007\n\n\n                                J U D G M E N T\n<\/pre>\n<p>       Petitioner   is   an   inter   state   stage   carriage   operator   on   the<\/p>\n<p>route   Mangalore-Badiyadka   granted   by   the   Karnataka   State<\/p>\n<p>Transport   Authority   and   duly   countersigned   by   the   STA,   Kerala.<\/p>\n<p>Subsequently   the   petitioner   applied   for   regular   variation   by<\/p>\n<p>extending   the   route   from   Kumbala   to   Kasargode   and   curtailing<\/p>\n<p>the   route   from   Kumbala   to   Badiyadka.     The   State   Transport<\/p>\n<p>Authority   ,   Bangalore   granted   the   variation   sought   for,   but   the<\/p>\n<p>counter   signature   was   rejected   by   the   STA,   Kerala.   At   the   time<\/p>\n<p>when   he   applied   for   counter   signature,   he   also   wanted   a<\/p>\n<p>replacement   of   the   vehicle   by   substituting   the   vehicle     KA.21\/A<\/p>\n<p>2777 in the place of KA.16\/A 3393.  The capacity of the proposed<\/p>\n<p>vehicle to be substituted was only 35 in all, as against 48 plus two<\/p>\n<p>capacity   of   the   existing   vehicle   KA.16\/A   3393.     Since   the<\/p>\n<p>difference between the two vehicles exceeds 25%, applying note<\/p>\n<p>to Sub Rule 3 to Rule 174 of K.M.V. Rules 1989, the replacement<\/p>\n<p>sought   for   was   rejected   and   considered   the   claim   for   counter<\/p>\n<p>signature   in   respect   of   KA.21\/A   2777   as   though   it   is   for   a   fresh<\/p>\n<p>WPC 22468\/2003<\/p>\n<p><span class=\"hidden_text\">                                        : 2 :<\/span><\/p>\n<p>permit.     In   that   regard   it   was   held   that   there   should   be   mutual<\/p>\n<p>agreement between the concerned states in respect of inter state<\/p>\n<p>route   and   applying   the   principles   in   the   decision   reported   in<\/p>\n<p><a href=\"\/doc\/804583\/\">Ashwani Kumar v. Regional Transport Authority (AIR<\/a> 1999<\/p>\n<p>SC 3888), it was held that in the present case there was no such<\/p>\n<p>mutual   agreement   and   an   application   for   counter   signature   for<\/p>\n<p>permit was rejected.  The petitioner though filed an appeal before<\/p>\n<p>the   State   Transport   Appellate   Tribunal   has   not   challenged   the<\/p>\n<p>finding as regards the replacement of the vehicle is concerned.  In<\/p>\n<p>other words, the finding as regards the claim for replacement of<\/p>\n<p>the   vehicle   stood   concluded   by   the   decision   of   the   STA.   The<\/p>\n<p>Tribunal   however  held   that     the   principle   contained   in   AIR   1999<\/p>\n<p>SC   3888   will   apply   even   to   counter   signature   of   existing   route.<\/p>\n<p>Challenging  the   same,  the   petitioner  has  come   up   with  this  writ<\/p>\n<p>petition seeking to quash Exhibits P5 and P6.<\/p>\n<p>       2.     Heard both sides.\n<\/p>\n<\/p>\n<p>       3.     As far as application for  replacement of  the vehicle is<\/p>\n<p>concerned,   since   the   petitioner   did   not   challenge   the   finding   in<\/p>\n<p>Exhibit   P5   before   the   Appellate   Tribunal,   the   same   has   become<\/p>\n<p>final   and   as   such  the  petitioner  is   now  running  vehicle  KA.   16\/A<\/p>\n<p>WPC 22468\/2003<\/p>\n<p><span class=\"hidden_text\">                                          : 3 :<\/span><\/p>\n<p>3393  in the  same  route  as  originally  granted.   The STA   rejected<\/p>\n<p>the   application   for   counter   signature   as   against   the   vehicle<\/p>\n<p>KA.21\/A   2777,   but   did   not   consider   the   application   for   counter<\/p>\n<p>signature   as   against   the   vehicle   KA.16\/A   3393.   As   a   matter   of<\/p>\n<p>fact,   even   the   Tribunal   did   not   address   this   question   in   this<\/p>\n<p>regard.\n<\/p>\n<\/p>\n<p>       4.     It   is   averred   by   the   petitioner   that   he   applied   before<\/p>\n<p>the 1st  respondent for the grant of counter signature for variation<\/p>\n<p>of   the   existing   permit.     He   also   preferred   an   application   for<\/p>\n<p>replacement   of   the   vehicle   by   stage   carriage   KA.21\/A   2777   and<\/p>\n<p>both the applications came up for consideration.   Exhibit P5 is a<\/p>\n<p>common order passed in those applications.  In Exhibit P5, though<\/p>\n<p>the   STA   rejected   the   application   for   replacement,   he   did   not<\/p>\n<p>consider   the   application   for   counter   signature   in   respect   of   the<\/p>\n<p>existing   stage   carriage.     On   the   other   hand,   he   considered   the<\/p>\n<p>application   for   counter   signature   in   respect   of   the   proposed<\/p>\n<p>vehicle to be replaced namely KA.21\/A 2777.\n<\/p>\n<\/p>\n<p>       5.     In the circumstances, Exhibit  P6  is quashed. As far as<\/p>\n<p>Exhibit   P5   is   concerned,   it   is   set   aside   to   the   limited   extent   of<\/p>\n<p>refusal to consider the claim for counter signature as against the<\/p>\n<p>WPC 22468\/2003<\/p>\n<p><span class=\"hidden_text\">                                      : 4 :<\/span><\/p>\n<p>vehicle KA.16\/A 3393.   In other words, the finding as regards the<\/p>\n<p>replacement   of   the   vehicle   with   another  vehicle   is   concerned,   it<\/p>\n<p>has already reached the finality.   In the circumstances, there will<\/p>\n<p>be a direction to the STA to reconsider the matter as to whether<\/p>\n<p>the counter signature in the permit could be issued  in respect of<\/p>\n<p>the vehicle KA.16\/A 3393 as applied for.
