Justice K.K.DENESAN\n\n Dated :11\/01\/2007\n\n O R D E R\n                               K.K.DENESAN, J.\n\n                    -----------------------------\n\n                         WP(C)No. 34166 OF 2006\n\n                    -----------------------------\n\n                  Dated this the 11th January, 2007.\n\n\n\n                                   JUDGMENT\n<\/pre>\n<p>      The petitioner is now working as Staff Nurse Gr.I.  She<\/p>\n<p>entered service as Staff Nurse Gr.II.   Subsequently she got<\/p>\n<p>transfer from her parent district to another district.   She<\/p>\n<p>was granted benefits taking into account her seniority from<\/p>\n<p>the   date   of   original   advice.               Subsequently   when   the<\/p>\n<p>seniority   list   has   been   prepared   she   is   not   given   the<\/p>\n<p>credit of service in the parent district on the ground that<\/p>\n<p>incumbents   who   got   transfer   on   request   are   liable   to<\/p>\n<p>forfeit   their   seniority   in   the   parent   district.                     The<\/p>\n<p>petitioner   submits   that   she   did   not   make   a   request   to   get<\/p>\n<p>transfer   to   the   present   district   after   forfeiting   her<\/p>\n<p>seniority         and         therefore         the         matter         requires<\/p>\n<p>reconsideration.           Ext.P9   representation   filed   by   the<\/p>\n<p>petitioner is pending before the first respondent.\n<\/p>\n<p>      2.     Counsel   for   the   petitioner   submits   that   early<\/p>\n<p>decision   on   Ext.P9   is   necessary   and   therefore   this   Court<\/p>\n<p>may issue appropriate directions.\n<\/p>\n<p>      3.  Heard the Govt. Pleader also.  In the circumstances<\/p>\n<p>there   shall   be   an   order   directing   the   first   respondent   to<\/p>\n<p>consider   Ext.P9   with   reference   to   relevant   records,   take<\/p>\n<p>decision in accordance with law and communicate the same to<\/p>\n<p><span class=\"hidden_text\">WPC 34166\/2006                        2<\/span><\/p>\n<p>the   petitioner   within   two   months   from   the   date   of   receipt<\/p>\n<p>of   a   copy   of   the   judgment   along   with   a   copy   of   the   writ<\/p>\n<p>petition.
