BANKA\n                                                                       ---- PETITIONERS.\n                                                    Versus\n                     STATE OF BIHAR\n                                                                         --- OPP.PARTY.\n                         For the Petitioners           :Mr. Nageshwar Prasad, Advocate.\n                         For the State                 : Mr. Jharkhandi Upadhyaya, APP.\n                                                  -----------\n<\/pre>\n<p>02   01.07.2010                    Heard both sides.\n<\/p>\n<p>                                   Rule confined to question of sentence only.\n<\/p>\n<p>                                   Learned A.P.P. waives notice on behalf of the State of<\/p>\n<p>                       Bihar.\n<\/p>\n<p>                                   With the consent of parties the present revision<\/p>\n<p>                       application is being disposed of at this stage itself<\/p>\n<p>                                   In view of the submissions that have been advanced on<\/p>\n<p>                       behalf of the petitioners and the orders I propose to pass, the facts<\/p>\n<p>                       of the case may not be dealt with in detail. Only the projector<\/p>\n<p>                       contour of the case may be outlined.\n<\/p>\n<p>                                   The two petitioners herein are father and son. They<\/p>\n<p>                       were found to have been arrested with one loaded country made<\/p>\n<p>                       pistol which would kept beneath the bed sheet. Accordingly they<\/p>\n<p>                       were charged and tried for the offence(s) punishable under<\/p>\n<p>                       Sections 25(1-B) A 26 and 35 of the Arms Act. On a consideration<\/p>\n<p>                       of the materials on record, including that of the two seizure list<\/p>\n<p>                       witnesses PW&#8217;s 1 and 2, it was found and held by the trial Court<\/p>\n<p>                       that charges stand proved. Accordingly, they were sentenced to<\/p>\n<p>                       undergo S.I. for one year each under Section 25(1-B)A, and 26 of<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>the Arms Act. They were also imposed fine in both the heads with<\/p>\n<p>default clause(s). Appeal of the petitioners failed without any<\/p>\n<p>relief. Hence the present revision application.<\/p>\n<p>            Learned counsel for the petitioners submits that the<\/p>\n<p>occurrence in the present case had taken place in the year 1998.<\/p>\n<p>The trial of the petitioners consumed nearly 12 years. For all these<\/p>\n<p>years, the father and son were made to undergo threat of being<\/p>\n<p>punished. Fighting criminal litigation for such a long time<\/p>\n<p>definitely tells upon the mental and economical conditions of the<\/p>\n<p>accuseds\/litigants. Referring to the order sheet of the learned Court<\/p>\n<p>below regarding surrender of the petitioners, it is submitted that<\/p>\n<p>petitioner no.1 Gopal Choudhary (Father) is aged about 60 years.<\/p>\n<p>It is next submitted that no recovery admittedly was made from<\/p>\n<p>the possession of petitioner no.2, namely, Sanjeev Choudhary.<\/p>\n<p>Learned trial Court has noted the submissions of the petitioners<\/p>\n<p>that they are the first offenders. It is, therefore, submitted that<\/p>\n<p>lenient view, so far as the imposition of sentence is concerned,<\/p>\n<p>may be taken in the present case.\n<\/p>\n<p>            Learned A.P.P. on the other hand, supported the two<\/p>\n<p>impugned judgments. It is submitted that there is no perversity<\/p>\n<p>and\/or illegality in the approach of the two courts below and as<\/p>\n<p>such the judgment and order impugned may not be interfered with.<\/p>\n<p>            Having heard learned counsel for the petitioners and<\/p>\n<p>after going through the materials on record as reflected from the<\/p>\n<p>two judgments, this Court is satisfied that a lesser punishment<\/p>\n<p>shall meet the ends of justice. Accordingly, while maintaining the<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>      conviction the sentence of one year S.I. awarded under Section<\/p>\n<p>      25(1-B)A and 26 under each head is\/are reduced to 06 months S.I.<\/p>\n<p>      under each head. Other part\/condition of sentence remain<\/p>\n<p>      unaltered.\n<\/p>\n<p>                   With this modification in sentence(s), the application<\/p>\n<p>      is dismissed.\n<\/p>\n<\/p>\n<pre>Sym                                         ( Kishore K.
