It was also found that  the premises were not<br \/>\nbeing used for residential purpose but were being used for<br \/>\nindustrial purpose and, therefore, the order came to be passed by the<br \/>\ncompetent authority under the ULC Act on 30th September,<br \/>\n1992 (Annexure-D) cancelling the scheme under Section 21(1) of the<br \/>\nULC Act allowed by Order dated 12th June, 1980 and<br \/>\ndirecting to initiate proceedings under Sections 6  to 11  of the ULC<br \/>\nAct.\n<\/p>\n<p>1.2\t\tThe<br \/>\nsaid order was challenged before the Urban Land Tribunal by<br \/>\npreferring an Appeal No. Surat\/104\/92, which came to be dismissed by<br \/>\nOrder dated  19th December, 1994 (Annexure-E) and, hence,<br \/>\n this petition seeking following reliefs:<br \/>\n \t(A)\tBe<br \/>\npleased to admit this petition.\n<\/p>\n<p>(B)\tBe<br \/>\npleased to issue a  writ of certiorari or a writ in the nature of<br \/>\ncertiorari or any other  appropriate writ, direction and order<br \/>\nagainst the  respondents calling for the records and  proceedings  of<br \/>\nthe case and after perusing the  records and proceedings of the case<br \/>\nand after perusing  the legality and propriety<br \/>\nof the orders passed by the respondent   at Annexures D and E, be<br \/>\npleased to quash and set aside the same and be pleased to  restore<br \/>\nthe order dated  12.6.1980.\n<\/p>\n<p>(C)\tBe<br \/>\npleased to issue a writ of  mandamus  or a writ in the nature of<br \/>\nmandamus or any other appropriate  writ, direction and order under<br \/>\nArticle  226 of the Constitution  of India against  the respondents<br \/>\ndirecting them  to quash and set aside   the orders at Annexures D<br \/>\nand E  and to restore the orders dated 12.6.1980 and further<br \/>\nforbearing them  from taking any action against   the petitioners<br \/>\nunder the ULC Act.\n<\/p>\n<p>(D)\tBe<br \/>\npleased to  grant interim relief  staying the further proceedings<br \/>\nagainst the petitioners   by the respondent No.1  in furtherance  of<br \/>\nthe Form No.1 filed by the petitioners   under Section 6(1) of the<br \/>\nULC Act in connection with  the land bearing Survey No.10  of the<br \/>\npetitioners till  the final disposal of this petition.\n<\/p>\n<p>(E)\tBe<br \/>\npleased to grant such other and further  reliefs  and to pass such<br \/>\nother further orders   as may be deemed  just and proper  by the<br \/>\nHonourable Court  in the facts and circumstances  of the case.\n<\/p>\n<p>(F)\tBe<br \/>\npleased to allow this petition  with costs.&#8221;\n<\/p>\n<p>2\t\tWhile<br \/>\nthe petition was admitted, an order was passed for the parties  to<br \/>\nmaintain status quo, which is still  operative.\n<\/p>\n<p>2.1\t\tBy<br \/>\nenaction of the Urban Land (Ceiling Regulation) Repeal Act, 1999, the<br \/>\nULC Act, 1976 has been repealed   w.e.f.  22.3.1999.\n<\/p>\n<p>3\t\tSection<br \/>\n4 of the said Urban Land (Ceiling and Regulation) Repeal Act, 1999,<br \/>\nruns as under:\n<\/p>\n<p>&#8220;4.\n<\/p>\n<p>Abatement of legal proceedings.&#8211;\n<\/p>\n<p>All  proceedings relating to  any order made or purported to be made<br \/>\nunder the principal Act pending  immediately before the commencement<br \/>\nof this Act,  before any court, tribunal or other authority shall<br \/>\nabate:\n<\/p>\n<p>Provided<br \/>\nthat  this section  shall not apply to the proceedings relating to<br \/>\nsections 11, 12, 13 and 14 of the principal Act in so far as  such<br \/>\nproceedings are relatable to the land,  possession of which has been<br \/>\ntaken over by the State Government or any person duly authorised by<br \/>\nthe State Government in this behalf or by the competent authority.&#8221;\n<\/p>\n<p>4\t\tNow<br \/>\nexamining the factual aspect, it is not in dispute that the<br \/>\npossession of the land has not been taken  over by the Government<br \/>\nunder the  old ULC Act of 1976. In fact,  the orders make it clear<br \/>\nthat the proceedings under Sections 6 to 11  of the ULC Act, 1976<br \/>\nwere ordered to be  initiated and have yet not been initiated till<br \/>\ndate. Therefore, in light of  provisions contained in Section-4 of<br \/>\nthe Repealing Act,  this proceedings stands abated.
