However, request<br \/>\nfor pass over was made. The request was accepted and granted.\n<\/p>\n<p>2.0<br \/>\n Now when the petition is taken up in second call, again learned<br \/>\nadvocate for respondent company is not present. Again request for<br \/>\npass over is made which is not accepted.\n<\/p>\n<p>3.0<br \/>\n Learned senior counsel Mr. Soparkar for the petitioner has submitted<br \/>\nthat the respondent company had placed orders with the petitioner<br \/>\ncompany and in response to the said orders the petitioner had<br \/>\nmanufactured, sold and delivered the goods (ready-made garments) to<br \/>\nthe respondent company during the period from 3rd October<br \/>\n2009 to 5th December 2009. The petitioner also raised<br \/>\ninvoices for the goods supplied, sold and delivered by it. According<br \/>\nto the petitioner the total value of the goods supplied by the<br \/>\npetitioner to the respondent came to the tune of Rs.68,22,074\/-.\n<\/p>\n<p>4.0<br \/>\n   It is claimed by the petitioner that the respondent company issued<br \/>\nsix cheques aggregating to sum of Rs.63,92,948\/- in part discharge of<br \/>\nliability in respect of the goods supplied by the petitioner. The<br \/>\npetitioner has also claimed that until then any dispute regarding the<br \/>\ngoods or quality of the material supplied, price or delivery or for<br \/>\nany other service or for any other aspect was never raised by the<br \/>\nrespondent company. It is further claimed that for the petitioner on<br \/>\nrespective representation of the first three cheques in the month of<br \/>\nOctober, 2009 the cheques were dishonored. The petitioner has also<br \/>\nclaimed that the respondent company promised to make part payment in<br \/>\nnear future and that therefore, though the amounts paid through<br \/>\ncheques which were dishonored, company had not initiated any<br \/>\nproceedings under Section 138 of the Negotiable Instrument Act.\n<\/p>\n<p>5.0<br \/>\nAt this stage of dictation of the order, Mr. Mangukiya, learned<br \/>\nadvocate for respondent company, submitted that within period of 6-8<br \/>\nweeks the respondent company will deposit a sum of Rs.12 lacs.\n<\/p>\n<p>6.0<br \/>\nTherefore, so as to enable learned advocate for respondent company to<br \/>\ndeposit a sum of Rs.12 lacs by 15th November 2011, the<br \/>\npetition is adjourned. If the respondent company has any sustainable<br \/>\ndispute then it will be considered at the next date of hearing.\n<\/p>\n<p>   Stand over to 18th November, 2011.\n<\/p>\n<p>[K.\n<\/p>\n<p>M.
