Kodekar, learned Additional Public Prosecutor waives<br \/>\nservice of notice of rule on behalf of respondent no.1 and Shri<br \/>\nHardik Dave, learned advocate waives service of notice of rule on<br \/>\nbehalf of respondent no. 2.\n<\/p>\n<p>\tWith<br \/>\nthe consent of the learned advocates appearing for the respective<br \/>\nparties, the application is taken up for final hearing today.\n<\/p>\n<p>\tBy<br \/>\nway of this application under Section 482 of the Code of Criminal<br \/>\nProcedure, the applicant-original accused no. 7 has prayed for an<br \/>\nappropriate order to quash and set aside Crime Register No.<br \/>\nI-121\/2008 registered at J.P. Road Police Station, Vadodara filed for<br \/>\nthe offences punishable under Sections  420, 406 and 114 of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>\tShri<br \/>\nMajmudar, learned advocate appearing on behalf of the<br \/>\napplicant-original accused no. 7 has submitted that as such the civil<br \/>\ndispute has been converted into criminal complaint and in fact for<br \/>\nthe very transaction, the civil proceedings were pending.  It is<br \/>\nfurther submitted that continuing with the criminal proceedings<br \/>\nagainst the applicant would be abuse of process of law.  Shri<br \/>\nMajmudar, learned advocate appearing on behalf of the applicant, Shri<br \/>\nR.C. Kodekar, learned APP  appearing on behalf of respondent no. 1<br \/>\nand Shri Hardik Dave, learned advocate appearing on behalf of<br \/>\nrespondent no. 2  have jointly submitted that even otherwise the<br \/>\nparties have settled the dispute amicably  and the civil proceedings<br \/>\nhave been disposed of.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the averments<br \/>\nand the allegations in the impugned complaint, prima facie it appears<br \/>\nthat the civil dispute has been converted into criminal proceedings.<br \/>\nUnder the circumstances, to continue with the proceedings against the<br \/>\napplicant, would be abuse of process of law.  Under the peculiar<br \/>\nfacts and circumstances of the case, prima facie it cannot be said<br \/>\nthat the applicant has committed any offence as alleged  under<br \/>\nSections 420, 406 and 114 of the Indian Penal Code and, therefore,<br \/>\nthe impugned complaint requires to be quashed and set aside.\n<\/p>\n<p>\tFor<br \/>\nthe reasons stated hereinabove, the application succeeds.  The<br \/>\nimpugned complaint, being Crime Register No. I-121\/2008 registered at<br \/>\nJ.P. Road Police Station, Vadodara, is hereby quashed and set aside<br \/>\nso far as the applicant is concerned.
