\nway of this Intra-Court Letters Patent Appeal, the appellant –
\noriginal petitioner has challenged the judgment and order dated
\n03.04.2001 passed by the Learned Single Judge in Special Civil
\nApplication No.870 of 1991 by which while dismissing the writ
\npetition, the Learned Single Judge by exercising suo motu power of
\nsuperintendence under Article 227 of the Constitution of India,
\nissued the follwing directions :-\n<\/p>\n
“By   exercising   suo   motu   power   of
\nsuperintendence under Article 227 of the Constitution of India, the
\njudgment and decree of  the  District  Judge, Junagadh,  in  Regular
\nCivil Appeal No.55\/82 decided on 4-4-1983 is quashed and set aside.
\nAs a result  of  the quashing  and  setting  aside  of  the  judgment
\n of the learned District Judge, Junagadh in Regular Civil Appeal
\nNo.55\/82 dated 4-4-1983,  the  resolution  of  the  Gram Panchayat
\nunder  which  the  services of the petitioner were brought to an end
\nis  revived  and  the  petitioner shall no  more  be  in  service
\nhenceforth.    However, whatever salary  paid  to  the  petitioner
\nduring  this period  as  well  as the consequential benefits given to
\nhim in pursuance of the decree of the  learned  District Judge,
\nJunagadh  shall  not  be recoverable by the Gram Panchayat from him.
\nRule is accordingly discharged.  In the
\nfacts of this case, no order as to costs.”\n<\/p>\n
2.\t\tWe
\nhave heard Mr. M. D. Rana, learned counsel appearing for the
\nappellant and Mr. Disant Manoj Popat, learned counsel appearing for
\nthe respondents.\n<\/p>\n
3.\t\tLearned
\ncounsel Mr. M. D. Rana has submitted that the petitioner has
\napproached this Court seeking direction to the respondents to grant
\nthe petitioner pay scale as prescribed by the Pay Commission which
\nwas already made available to the Panchayat employees of various
\nPanchayats.  However, while dismissing the writ petition, the Learned
\nSingle Judge exercised suo motu powers under Article 227of the
\nConstitution of India and quashed  and  set  aside  the  judgment  of
\nthe learned District Judge, Junagadh in Regular Civil Appeal No.55\/82
\ndated 4-4-1983 after almost 18 years, which was not the subject
\nmatter of the writ petition.  He, has, therefore, submitted that the
\nLearned Single Judge has travelled beyond his jurisdiction and hence,
\nthe said direction may kindly be quashed and set aside.\n<\/p>\n
4.\t\tLearned
\ncounsel Mr. Popat has submitted that even if the observations made by
\nthe Learned Single Judge in the last paragraph are quashed, the
\npetitioner is not entitled for the pay scale in view of the decision
\nof the Apex Court in the case of Uma Devi, 2006 (4) SCC 1.\n<\/p>\n
5.\t\tWe
\nhave heard learned counsel for the parties.  The petitioner has filed
\nthe writ petition for the following reliefs :-\n<\/p>\n
“(a)\tdirecting
\nthe respondent to grant the prescribed pay scale prescribed by the
\nPay Commissions to the petitioner which is already made available to
\nthe Panchayat employees of the various Panchayats and the State Govt.
\nemployees on regular establishment with arrears for the class IV post
\nwith increments;\n<\/p>\n
(b)\tpending
\nthe admission, hearing and final disposal of this petition, to issue
\ninterim direction to the respondent Panchayat to fix the pay scale
\nfrom the date of the petitioner on proposition of equal wage for
\nequal work.”\n<\/p>\n
6.\t\tIn
\nthe above view of the matter, the contention raised by the appellant
\nregarding the last paragraph of the Learned Single Judge is required
\nto be accepted in as much as the judgment of  the learned District
\nJudge, Junagadh in Regular Civil Appeal No.55\/82 dated 4-4-1983 was
\nnot the subject matter of the petition and it would not be proper for
\nthis Court to exercise the suo-motu powers after almost 18 years.
\nTherefore, the observations made by the Learned Single Judge in the
\nlast paragraph of the impugned judgment, referred to hereinabove, is
\nrequired to be quashed and set aside.\n<\/p>\n
7.\t\tAccordingly,
\nthe Letters Patent Appeal is partly allowed to the above extent.  The
\nimpugned judgment and order of the Learned Single Judge so far as it
\ndismissed the writ petition of the appellant is hereby confirmed.
\nHowever, the observations made by the Learned Single Judge in the
\nlast paragraph, referred to herein above, is hereby quashed and set
\naside.  Rule is made absolute to the above extent.  There shall be no
\norder as to costs.\n<\/p>\n
