The petitioner without assigning any reasons, orally<br \/>\nterminated the services of the respondent workmen. Being aggrieved by<br \/>\nthe said order, the respondent workmen raised a dispute which was<br \/>\nultimately referred to the Labour Court for adjudication. Before the<br \/>\nLabour Court, both the parties adduced evidence and after<br \/>\nappreciating the material produced before it, the Labour Court partly<br \/>\nallowed the references with the aforesaid directions. Hence, these<br \/>\npetitions.\n<\/p>\n<p>4.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record.   The main contention of the petitioner is that the<br \/>\nrespondent workmen were working purely on temporary basis and<br \/>\ntherefore, the impugned award passed by the Labour Court is illegal<br \/>\nand unjust. On perusal of the record it transpires that the<br \/>\nrespondent workmen had worked for more than 240 days in a year and<br \/>\nbefore terminating their services, the petitioner had not issued any<br \/>\nnotice or paid retrenchment compensation. Apart from that the<br \/>\npetitioner had appointed new persons in place of the respondent<br \/>\nworkmen.  In view of these findings there is violation of provisions<br \/>\nof Sections 25F, 25G &amp; 25H of the Industrial Disputes Act.  The<br \/>\nlearned AGP appearing on behalf of the petitioner is not able to<br \/>\npoint out anything contrary  from the record that the findings of the<br \/>\nLabour Court in this regard are perverse. Therefore, I am of the view<br \/>\nthat the Labour Court has rightly passed the award of reinstatement<br \/>\nin service.\n<\/p>\n<p>5.\t\tSo<br \/>\nfar as the question of back wages is concerned, the Labour Court has<br \/>\nnot given any cogent reasons for awarding back wages to the<br \/>\nrespondent workman. In view of the principle laid down by the Apex<br \/>\nCourt in the case of <a href=\"\/doc\/800069\/\">Ram Ashrey Singh v. Ram Bux Singh<\/a><br \/>\nreported in (2003) II L.L.J. 176 a workman has no automatic<br \/>\nentitlement to back wages since it is discretionary and has to be<br \/>\ndealt with in accordance with the facts and circumstances of each<br \/>\ncase. Similar principle has been laid down by the Apex Court in the<br \/>\ncase of <a href=\"\/doc\/1628125\/\">General Manager, Haryana Roadways v. Rudhan Singh<\/a><br \/>\nreported in J.T. 2005(6) SC 137 [2005(5) SCC 591], wherein it<br \/>\nhas been held that an order for payment of back wages should not be<br \/>\npassed in a mechanical manner but a host of factors are to be taken<br \/>\ninto consideration before passing any such order.\n<\/p>\n<p>6.\t\tIt<br \/>\nwould also be relevant to refer to a decision of the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/309814\/\">A.P. State Road Transport &amp; Ors. v. Abdul Kareem<\/a><br \/>\nreported in (2005) 6 SCC 36, wherein it has been held that a<br \/>\nworkman is not entitled to any consequential relief on reinstatement<br \/>\nas a matter of course unless specifically directed by forum granting<br \/>\nreinstatement. In above view of the matter, I am of the opinion that<br \/>\nthe respondent cannot be said to be entitled for back wages.\n<\/p>\n<p>7.\t\tFor<br \/>\nthe foregoing reasons, the following order is passed ;\n<\/p>\n<p>(i)<br \/>\nSpecial Civil Application No. 6139 of 2007 is partly allowed. The<br \/>\nimpugned award dated 23.11.2006 passed by the Labour Court, Ahmedabad<br \/>\nin Reference [LCA] No. 416\/1999 qua back wages is quashed and set<br \/>\naside. The impugned award qua reinstatement with continuity of<br \/>\nservice is confirmed. Rule is made absolute to the above extent.\n<\/p>\n<p>(ii)<br \/>\nSpecial Civil Application Nos. 941 of 2007  and 2096 of 2007 are<br \/>\ndismissed. Rule is discharged. Interim relief, if any, stands<br \/>\nvacated.\n<\/p>\n<p>(iii)<br \/>\nIt is, however, made clear that the respondent workman of Special<br \/>\nCivil Application No. 6139 of 2007 will be granted benefit of<br \/>\ncontinuity of service within a period of six months from today and<br \/>\nthe respondent workmen shall be granted difference of the amount from<br \/>\nthe date of award till actual reinstatement within a period of six<br \/>\nmonths from the date of receipt of this order.\n<\/p>\n<p>[K.S.\n<\/p>\n<p>JHAVERI, J.]<\/p>\n<p>\/phalguni\/<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Acharya vs Thakor on 9 August, 2010 Author: Ks Jhaveri,&amp;Nbsp;
