Justice ANTONY DOMINIC\n\n Dated :15\/11\/2007\n\n O R D E R\n                   ANTONY DOMINIC, J.\n\n            = = = = = = = = = = = = = = = =\n              W.P.(C) No. 29519 OF 2007 L\n            = = = = = = = = = = = = = = = =\n\n           Dated this the 15th November, 2007\n\n                    J U D G M E N T\n<\/pre>\n<p>    Revenue recovery proceedings initiated against the<\/p>\n<p>petitioner for realisation of the dues for the period<\/p>\n<p>2003-04  under  the  Kerala   Motor  Transport  Workers<\/p>\n<p>Welfare Fund Act is under challenge.    Pleadings would<\/p>\n<p>disclose that the petitioner was totally ignorant about<\/p>\n<p>the  proceedings   or   the    provisional   and  final<\/p>\n<p>determination orders that were passed.<\/p>\n<p>    2. On instruction, the learned Standing Counsel<\/p>\n<p>for the respondents submits that for the period 2003-<\/p>\n<p>04, provisional determination order dated 22.9.2004 was<\/p>\n<p>passed and was served on the petitioner on 1.10.2005.<\/p>\n<p>It  is  also  stated  that   after  due  enquiry  final<\/p>\n<p>determination order was passed on 27.10.2005 and that<\/p>\n<p>the said order was also served on the petitioner on<\/p>\n<p>9.11.2005.  It is also pointed out that despite   this,<\/p>\n<p>the petitioner did not challenge the order by filing an<\/p>\n<p>appeal as provided under the Act.\n<\/p>\n<p>WPC No. 29519\/07<br \/>\n<span class=\"hidden_text\">                            -2-<\/span><\/p>\n<p>    3. This being the factual situation there is no<\/p>\n<p>doubt that the petitioner has not approached this Court<\/p>\n<p>disclosing the true facts.
