State of M.P. &amp; three others)\n\n05-10-2010\n\nShri D.K.Tripathi, learned counsel for the petitioner.\n\nShri Ashish Shroti, learned counsel for the respondent\/bank.<\/pre>\n<p>       The petitioner has filed this petition being aggrieved by the<br \/>\nseizure of his tractor and the amount\/account being taken by the<br \/>\nrespondent-bank towards recovery.\n<\/p>\n<p>       It is submitted by the learned counsel for the petitioner that<br \/>\nbecause of the severe drought in the district during the last five years<br \/>\nand failure of crops, the petitioner has been unable to repay the amount,<br \/>\nhowever, on receiving the impugned notice he has deposited<br \/>\nRs.95,000\/- in the tractor account and Rs.20,000\/- in the Kissan Credit<br \/>\nAccount. He submits that he undertakes to further deposit a sum of<br \/>\nRs.25,000\/- in the tractor account and submits that the respondent\/bank<br \/>\nbe directed to release the tractor forthwith to enable the petitioner to<br \/>\nperform the necessary agricultural activities so that he may repay the<br \/>\nloan. The petitioner further undertakes that he shall regularize both of<br \/>\nhis accounts immediately by the end of the agricultural season i.e. by<br \/>\nMay, 2011.\n<\/p>\n<p>       Shri Ashish Shroti, learned counsel who appears on advance<br \/>\nnotice on behalf of the respondent\/bank, opposes the prayer made by<br \/>\nthe petitioner and prays that the petitioner be directed to make his<br \/>\naccounts regular.\n<\/p>\n<p>       In view of the aforesaid statement made by the learned counsel<br \/>\nfor the petitioner the petition filed by the petitioner is disposed of with a<br \/>\ndirection that in case, the petitioner furnishes a written undertaking<br \/>\nalong with Rs.25,000\/- and a proposal for further repayment before the<br \/>\nrespondent\/bank within one week from today, the respondent\/bank shall<br \/>\n       consider request of the petitioner for release of the tractor as well as the<br \/>\n      proposal and the undertaking that shall be filed by the petitioner along<br \/>\n      with his application for making the accounts regular by the next<br \/>\n      agricultural season and shall take appropriate steps thereon, taking into<br \/>\n      consideration the difficulties placed by the petitioner and the problems<br \/>\n      pointed out by him in respect of severe drought etc.<\/p>\n<p>             With the aforesaid directions the petition filed by the petitioner<br \/>\n      stands disposed of.\n<\/p>\n<p>             C.C. as per rules.<\/p>\n<pre>\n\n\n\n                                                              ( R.S.Jha )\nmct                                                             Judge\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Jairam Dwivedi vs The State Of Madhya Pradesh on 5 October, 2010 W.P.No. 13477 \/ 2010 (Jairam Dwivedi .v.
