Justice T.R.RAMACHANDRAN NAIR\n\n Dated :10\/12\/2009\n\n O R D E R\n                T.R RAMACHANDRAN NAIR,J.\n                      -------------------------\n                  W.P ( C) No.35653 of 2009\n                      --------------------------\n            Dated this the 10th December,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      The petitioner is working as High School Assistant<\/p>\n<p>(Natural   Science)   in   Mount      Carmel     High  School,<\/p>\n<p>Mamanna, Jellippara in Attapadi in Palakkad District.<\/p>\n<p>Petitioner was     promoted as        High School Assistant<\/p>\n<p>(Natural Science) with effect from 1.6.1998 and was<\/p>\n<p>continuing in CVM High School, Vandazhi in Palakkad<\/p>\n<p>District.  During the academic year             2008-2009, the<\/p>\n<p>petitioner became surplus and accordingly she was<\/p>\n<p>deployed to 7th respondent school in Attappadi as per the<\/p>\n<p>proceedings Ext. P1 issued by the              3rd respondent.<\/p>\n<p>Accordingly she was relieved from the           5th respondent<\/p>\n<p>school as per Ext.P2 and reported for duty in the 7th<\/p>\n<p>respondent&#8217;s school.\n<\/p>\n<p>      2.   Petitioner&#8217;s case in the writ petition is that the<\/p>\n<p>said school is situated more than 150 kms away from her<\/p>\n<p>house which is a hill track area. The climate conditions<\/p>\n<p>therein is really adverse and it really affects her physical<\/p>\n<p>condition.   Further she is unable to look after the affairs<\/p>\n<p>W.P ( C) No.35653 of 2009<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>of her family also and she is now suffering from facial<\/p>\n<p>paralysis.\n<\/p>\n<p>      3.     Pointing out that there is an existing vacancy in<\/p>\n<p>the     6th respondent&#8217;s school, petitioner has filed a<\/p>\n<p>representation before the Deputy Director of Education as<\/p>\n<p>per    Ext.P4.      Petitioner prays that the same may be<\/p>\n<p>directed to be considered, in accordance with law.<\/p>\n<p>      4.
