The Tribunal has awarded the\n\nA ;oOr'npc.r:_1sationvo_f 125.92 ,20o\/ --.\n\n2,.  learned Counsel for the appellant while seeking\n\n enhancement would point out that the Tribunal has\n\n e.rro'r_:eouSly deducted 1\/ 3\"\" of the income reckoned though\n\nit the claim in the instant case was for the 'loss of future\n\nearning' as per the disability stated by the doctor. It is\n\n\n\nfurther contended that even under the heads under which it\n\nhas been granted, the amount is on the lower side and\u00e9iiwith\n\nregard to the 'loss of amenities', no amount wh_a'tsoeve_r h;._as~.\n\nbeen granted. With regard to the medical ex,pe.n_sesals0,  is ._ \n\ncontended that what is granted is on thelgllower    if\n\n3. The learned Couns'e1rf'e.r the\"respondent\"hovsfever,*VV<\/pre>\n
seeks to justify the award passied ‘by the “‘I’ri_bun\u00a7al. It is
\ncontended that the Tribunal  entjtae -evidence available<\/p>\n
on record has come ,to”*its’ conclusion ” and the Tribunal<\/p>\n
having””de’cided “3’u’st_”coIn;$ensation, the same does not
\ncall for’*en’l1ance1ne’nt.    V\u00bb ”\n<\/p>\n
_ _4. In’the 1igl1tAo–fiw’liiat has been contended, firstly, it is<\/p>\n
 tovlb’e istated that”–in”the facts and circumstances of the<\/p>\n
 V preseent.’:ctaseu,\ufb02’ the Tribunal was not justified in deductin.g<\/p>\n
‘ls,\/331 ofltlie amount for self–expenses. in the instant case,<\/p>\n
 what to be considered was the loss of future earning, in<\/p>\n
 Aiviewgofiithe disability and as such having estimated the loss<\/p>\n
‘due to disability suffered, the entire amount ought to have<\/p>\n
“been awarded since the injured himself is the claimant. On<\/p>\n
it<\/p>\n
that aspect of the matter, the compensation _aw_a-rded<\/p>\n
requires to be corrected. Hence if the compensatioin”=o;n–.. _<\/p>\n
said head is calculated taking into co.ns’i’der_ation *_thel <\/p>\n
parameters adopted except the (‘iedu’cet.ioni,’tt..the” <\/p>\n
would be entitled to the eutn’et_VRs.1″,’ao”;sQo,=;.;”iteeriithe j2o’% <\/p>\n
disability. Since the Tribunal h\u00a7e.i,gwg’rded’-ae_.’\u00e97,\u00e9oo\/–, the
\nclaimant would be    of l\u00a7si.l33,600\/~.\n<\/p>\n
With regard to .the Apsufilerin:\u00a7;pV—-‘considering the
\nnature of the  suffered,  the fracture
\nand since hlasvltstlaited higher percentage
\nwith riegarci anidllthe Tribunal has taken the
\nsame at ‘towards pain and suffering is<\/p>\n
inadequateiii’ .i’Xceoi”dii’;gl\u00a7}; a further sum of Rs.15,000\/~ is<\/p>\n
 awa.rde”d. Since “noiamount is awarded towards ‘loss of<\/p>\n
    of Rs.10,000\/– is awarded. Towards ‘loss<\/p>\n
dtiringetreattnent period’ and also towards expenses towards<\/p>\n
treatment, a sum of Rs. 10,000 \/ — is awarded.<\/p>\n
5. Therefore, in all the claimant is entitled to the<\/p>\n
“enhanced compensation of Rs.68,600\/- with interest at the<\/p>\n
same rate as awarded by the Tribunal. The enhanced<\/p>\n
