     It is the settled principle of law that in dealing with<\/p>\n

‘accident  the said lorry either rashly or negligently<\/p>\n
   erueeen and therefore, the judgment and order<\/p>\n

 gttidgmeat ef the Appellate Court: con\ufb01rming the Trial Courtfs<\/p>\n

fact that the lorry driven by the petitioner-ace{1seeI’V’. 4_<\/p>\n
against the said autoriekshaw \ufb01ti\ufb01l’  ‘ ; <\/p>\n
shew that the petitioner-accused  eiereise <\/p>\n
and was not cautious enough  the s\u00e9aikivvddlensjr and<\/p>\n
therefore, the Trial coup; I’ig1*1’tI3\/=A.’Ve\u00a7:jof1vietedA ‘tiievjjletitiener-
\naccused for the said o\ufb01efices   Court was
\njusti\ufb01ed in   ‘erder of conviction<\/p>\n
and    ;\n<\/p>\n
8. the accident on the date, time<\/p>\n
and place, iiiepindrig  lorry and the Auto Rickshaw<\/p>\n

injuries by PW1, are all not disputed. O11<\/p>\n
    izhe evidence of PW.1, it is seen that he has<\/p>\n
 stated  that While the auto rickshaw was proceeding<\/p>\n
‘   National Highway on Panambur Cross Road near<\/p>\n
   Gate, the said 10:13; Came from behind the auto<\/p>\n
V   rickshaw and dashed against him, censequently the driver of<\/p>\n

\nthe said aute rickshaw  Abubackar and 21159 PW1<\/p>\n
himself fell on the mound and the deceased Abu\ufb01aeker<\/p>\n
sustained fatal injuries and succumbed to  <\/p>\n
that he (PW. 1) also sustained some ixijuries I 91′ .t <\/p>\n

as on the said date, time and__\u00bb of’  he was

\nbehind. as  ml-mt} 3 that the said lorry dashed<\/p>\n
against :t–11e_ atitoiielesliiiw and consequently the driver of<\/p>\n
 said’:.ai;itorie1;shattt\u00e9ii1d 22330 the other person sitting in it<\/p>\n
the and sustained severe injuries.\n<\/p>\n
