DAVE\n\t\t\n\t\n\n \n\nDate\n: 10\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.27\/2011<br \/>\n\twith Vejalpur Police Station, Panchmahal for the<br \/>\n\toffences punishable under Sections 465,<br \/>\n\t467, 468, 471, 472 and 114 of the Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tCounsel for the applicant submits that<br \/>\n\tthat the applicant as one of the trustees is alleged to have<br \/>\n\tcommitted the above crime.  However, according to the learned<br \/>\n\tAdvocate for the applicant, the applicant at the most may have acted<br \/>\n\tat the instance of her husband who was also the Trustee.  However,<br \/>\n\tthe fact remains that permission was granted by the authority by<br \/>\n\tconverting agricultural land to non-agricultural land for industrial<br \/>\n\tpurpose which was then used for educational purpose.  Further, a<br \/>\n\tbuilding was<br \/>\n\talso constructed for which the signature and seal of the authority<br \/>\n\twas affixed which was ultimately found to be fake.  However, it is<br \/>\n\talso submitted that the matter revolves around documentary evidence<br \/>\n\tand the investigating officer can seize such material for which<br \/>\n\tcustodial interrogation of the applicant &#8211; a female accused is<br \/>\n\tnot necessary, prima-facie and hence, the applicant may<br \/>\n\tbe granted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP Mrs. Manisha L. Shah for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, I am<br \/>\n\tinclined to grant anticipatory bail to the applicant.  This Court<br \/>\n\thas also taken into consideration the law laid down by the Apex<br \/>\n\tCourt in the case of <a href=\"\/doc\/1108032\/\">Siddharam Stalingappa Mhetre v. State of<br \/>\n\tMaharashtra &amp; Ors.<\/a> reported in [2011]1 SCC 694,<br \/>\n\twherein the Apex Court reiterated the law laid down by the<br \/>\n\tConstitutional Bench in the case of Shri Gurubaksh Singh<br \/>\n\tSibbia &amp; Ors. reported in [1980]2 SCC 565.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tI-C.R. No.27\/2011<br \/>\n\twith Vejalpur Police Station, Panchmahal, the<br \/>\n\tapplicant shall be released on bail on furnishing a bond of<br \/>\n\tRs.10,000\/- (Rupees Ten Thousand Only) with one surety of like<br \/>\n\tamount on following conditions :-\n<\/p>\n<p>(a)<br \/>\nshall cooperate with the investigation and make herself available for<br \/>\ninterrogation whenever required;\n<\/p>\n<p>(b)<br \/>\nshall remain present at the concerned Police Station on 16th<br \/>\nAUGUST, 2011 between 11.00 am to 2.00 pm;\n<\/p>\n<p>(c)<br \/>\nshall not hamper the investigation in any manner nor shall directly<br \/>\nor indirectly make any inducement, threat or promise to any witness<br \/>\nso as to dissuade them from disclosing such facts to the Court or to<br \/>\nany Police Officer;\n<\/p>\n<p>(d)<br \/>\nshall at the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>(e)<br \/>\nwill not leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>(f)<br \/>\nIt would be open to the Investigating Officer to file an application<br \/>\nfor remand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>(g)<br \/>\ndespite this order, it would be open for the Investigating Agency to<br \/>\napply to the competent Magistrate, for police remand of the<br \/>\napplicant.  The applicant shall remain present before the learned<br \/>\nMagistrate on the first date of hearing of such an application and on<br \/>\nall subsequent occasions, as may be directed by the learned<br \/>\nMagistrate.  This would be sufficient to treat the accused in the<br \/>\njudicial custody for the purpose of entertaining application of the<br \/>\nprosecution for police remand.  This is, however, without prejudice<br \/>\nto the right of the accused to seek stay against an order of remand,<br \/>\nif ultimately granted, and the power of the learned Magistrate to<br \/>\nconsider such a request in accordance with law.  It is clarified that<br \/>\nthe applicant, even if, remanded to the police custody, upon<br \/>\ncompletion of such period of police remand, shall be set free<br \/>\nimmediately, subject to other conditions of this anticipatory bail<br \/>\norder.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
