The petitioner-Bizal Singh retired on superannuation from
\nGovernment Service on October 31, 2009 when he was drawing
\nsalary in the pay scale of 3050-4910.\n<\/p>\n
His pension case forwarded by the State Government to
\nthe Principal Accountant General, Jammu and Kashmir, Jammu
\nwas returned informing the Executive Engineer, Generation
\nDivision, PDC Udhampur that the award of one step higher pay
\nscale of pay of Rs.410-700 to the petitioner vide Chief Engineer,
\nElectric Maintenance & RE Wing, Jammus Order No.
\nCEJ\/DPC-I\/42 of 2004 dated 23.11.2004 was unauthorized and
\nin violation of Rule 17-13 (1) of the Jammu and Kashmir
\nFinancial Code, in that, the stepping up was not sanctioned by
\nthe State Government and that action in terms of Rule 17-4 of
\n2<\/span>
\nthe Jammu and Kashmir Financial Code be initiated to recover
\nthe excess amount drawn by the Officer so that his claim for full
\nand final pensionary benefits could be authorized in his favour.
\nThe Principal Accountant Generals Communication No.
\nPNRJ-I\/1\/11013\/1441-45 dated 30th March, 2010, referred to
\nhereinabove, has been questioned by the petitioner seeking its
\nquashing besides directing the Accountant General to release
\nthe retiral benefits including pension, gratuity taking into account
\nthe actual last pay drawn by him at the time of his retirement.
\nThe case set up by the petitioner in the Writ Petition is that
\naward of one step higher scale of pay was authorized and that
\ndeductions suggested by the Accountant General were
\nimpermissible. The Accountant General, in its Objections to the
\nPetition has, reiterating its stand appearing in Communication of
\nMarch 30, 2010, stated that the petitioner was not entitled to the
\nfixation of his Pension and other Retiral benefits in the absence
\nof State Governments specific authorization for award of one
\nstep higher pay scale.\n<\/p>\n
In their Response to the Writ Petition, the Staterespondents
\nhave not denied the petitioners entitlement to the
\naward of one step higher pay scale and rather justified the grant
\nof one step higher grade promotion being Skilled Technician-III
\nin the pay scale of 3050-4910 retrospectively w.e.f. 19th July,
\n1980. It is further stated that Jammu and Kashmir PDD
\n(Subordinate Service) Recruitment Rules, 1981 were introduced
\n3<\/span>
\nvide SRO 381 dated 26.08.1981 in terms whereof all promotions
\nagainst available vacancies in the cadre and vacant posts were
\nregulated by the DPC CE M&RE Wing, Jammu which had one
\nmember on the Committee from the Administrative Department
\nof the Power Development Department.\n<\/p>\n
In view of what has been stated by the State-respondents
\nin their Response to the Writ Petition, it becomes clear that one
\nof the members of the DPC being a person from the
\nAdministrative Department of the Power Development
\nDepartment, the State Government is deemed to have agreed to
\nthe grant of one step higher pay scale to the petitioner along
\nwith other similarly situated Officers who were held entitled to
\nthe benefit of pay scale and pension on the basis thereof in
\nterms of the law laid down by this Court in Accountant General,
\nJammu and Kashmir Government, Jammu versus Kartar Chand
\nand others, where while deciding several Letters Patent Appeals
\nwhich included LPA (SWP) No. 189\/06, the recoveries sought to
\nbe initiated at the instance of the Accountant General were held
\nimpermissible.\n<\/p>\n
The petitioners case as to his entitlement to Pension and
\nother Retiral benefits on the basis of award of one step higher
\npay scale, which he had been getting at the time of his
\nretirement, having not been contested and rather acceded to by
\nthe State Government, is, therefore, covered by what was held
\n4<\/span>
\nby this Court in Kartar Chands case (supra), which for facility of
\nreference is reproduced hereunder:-\n<\/p>\n
In view of clear instructions appended to Rule 77-B of Civil
\nService Regulation, it is incumbent upon every
\nAdministrative Department to obtain the prior approval of
\nGeneral Administrative Department before ordering stepping
\nup of the pay of an employee under it. But, whether failure to
\nobtain such prior approval, as a necessary consequence,
\nwould always render the order passed for stepping up the
\npay of an employee invalid? In our considered opinion it
\nwould not be so in every case. Where otherwise entitlement
\nof an employee to the stepping up of his pay is not disputed
\nby the Administrative Department or by the office of
\nAccountant General, the order of stepping up of pay of such
\nan employee would not be rendered invalid for being taken
\ninto account for the purposes of fixation of pension and
\ngratuity the reason being that matter of obtaining prior
\napproval is between the Administrative Department and
\nGeneral Administrative Department in which the employee
\nhas no role to play. By passing an order in violation of the
\nmandate of the Government instructions appended to Rule
\n77-B, the officer concerned may be exposing himself to the
\ndepartmental action, but it cannot per se affect the
\npensionary rights of an employee to which he is otherwise
\nentitled. Therefore, where the right of an employee to have
\nhis pay stepped up is not in dispute, the fact of that before
\npassing the order in that behalf by the competent authority,
\nthe prior approval of General Administrative Department has
\nnot been obtained would only be an irregularity and in such
\ncases the Accountant Generals office would not be justified
\nin not sanctioning the pension, as per the stepped up pay of
\nsuch an employee. However, where the stepping up of the
\npay of an employee is found to have been wrongly made by
\nthe Administrative Department, the failure to obtain such
\nprior approval would be an illegality and in such like cases
\nthe Accountant Generals Office would be justified in not
\naccepting such an order as valid for the purposes of fixation
\nof pension.
\nFor all what has been said above, the Principal
\nAccountant General (A&E), Jammu and Kashmir, Jammus
\nCommunication No. PNRJ-I\/1\/11013\/1441-45 dated 30th March,
\n2010 becomes unsustainable being in contravention of the law
\nsettled by this Court in Kartar Chands case (supra) and is liable
\nto be quashed holding the petitioner entitled to Pension and
\nother Service benefits on the basis of the actual last pay drawn
\nby him at the time of his retirement on superannuation.\n<\/p>\n
5<\/span><\/p>\n
This Petition, therefore, succeeds and is, accordingly,
\nallowed quashing Principal Accountant Generals
\nCommunication dated March 30, 2010.\n<\/p>\n
A direction shall, therefore, issue to the State-respondents
\nand the Accountant General to sanction the release of Pension
\nand other Retiral benefits in favour of the petitioner within a
\nperiod of eight weeks. In case, the Pension and other Retiral
\nbenefits were not released to the petitioner within the stipulated
\nperiod, these will carry interest @ 6% per annum.
